  1  1    Section 1.  NEW SECTION.  614.28A  Persons without valid
  1  2 driver's licenses or financial liability coverage.
  1  3    No action for damages for death, personal injury, or
  1  4 property damage resulting from a motor vehicle accident or
  1  5 collision shall be brought by a person involved in the accident
  1  6 or collision, regardless of fault, if the person, at the time
  1  7 of the accident or collision, was operating a motor vehicle
  1  8 with a denied, canceled, suspended, or revoked driver's license
  1  9 in violation of section 321.218, 321A.32, or 321J.21, or
  1 10 without financial liability coverage in effect for the vehicle
  1 11 in violation of section 321.20B, subsection 1.
  1 12    Sec. 2.  Section 726.6, subsection 1, Code 2016, is amended
  1 13 by adding the following new paragraph:
  1 14    NEW PARAGRAPH.  i.  Knowingly operates a motor vehicle with
  1 15 a denied, canceled, suspended, or revoked driver's license in
  1 16 violation of section 321.218, 321A.32, or 321J.21, or without
  1 17 financial liability coverage in effect for the vehicle in
  1 18 violation of section 321.20B, subsection 1, while the child or
  1 19 minor is a passenger in the vehicle.
  1 20                           EXPLANATION
  1 21 The inclusion of this explanation does not constitute agreement with
  1 22 the explanation's substance by the members of the general assembly.
  1 23    If a person operates a motor vehicle with a denied, canceled,
  1 24 suspended, or revoked driver's license or without financial
  1 25 liability coverage in effect for the vehicle and an accident or
  1 26 collision occurs, this bill prohibits the person from bringing
  1 27 a civil action for property damage, personal injury, or death
  1 28 resulting from the accident or collision, regardless of fault.
  1 29    In addition, the bill provides that knowingly operating a
  1 30 motor vehicle with a denied, canceled, suspended, or revoked
  1 31 driver's license or without financial liability coverage in
  1 32 effect for the vehicle, while a child under 14 years of age
  1 33 or a minor under 18 years of age with a mental or physical
  1 34 disability is a passenger in the vehicle, constitutes child
  1 35 endangerment. Child endangerment is punishable as a class "B"
  2  1 felony if the child or minor dies, a class "C" felony if the
  2  2 child or minor is seriously injured, a class "D" felony if the
  2  3 child or minor is injured, and an aggravated misdemeanor if the
  2  4 child or minor is not injured.
