  1 An Act relating to the department of public defense
  2    by providing for the gold star military museum and
  3    modifying funding provisions for the national guard

  1  1    Section 1.  Section 29.1, Code 2016, is amended to read as
  1  2 follows:
  1  3    29.1  Department of public defense.
  1  4    The department of public defense is composed of the office
  1  5 of the adjutant general and, the military forces of the state
  1  6 of Iowa, and the Iowa gold star military museum as established
  1  7 in section 29.4. The adjutant general is the director of the
  1  8 department of public defense and shall perform all functions,
  1  9 responsibilities, powers, and duties concerning the military
  1 10 forces of the state of Iowa and the Iowa gold star military
  1 11 museum as provided in the laws of the state.
  1 12    Sec. 2.  NEW SECTION.  29.4  Iowa gold star military museum.
  1 13    1.  The department of public defense shall establish a
  1 14 military historical museum located at Camp Dodge which shall
  1 15 be known as the "Iowa gold star military museum". The museum
  1 16 shall be administered by the adjutant general.
  1 17    2.  The adjutant general may appoint a museum director and
  1 18 such other personnel from the full=time equivalent positions
  1 19 authorized the department for the purposes of maintaining and
  1 20 operating the Iowa gold star military museum.  The museum
  1 21 director shall have such responsibilities as may be assigned
  1 22 by the adjutant general.
  1 23    Sec. 3.  Section 261.86, subsection 6, Code 2016, is amended
  1 24 to read as follows:
  1 25    6.  Notwithstanding section 8.33, until one year after the
  1 26 date the president of the United States or the Congress of
  1 27 the United States declares a cessation of hostilities ending
  1 28 operation Iraqi freedom, operation new dawn, and operation
  1 29 enduring freedom, funds appropriated for purposes of this
  1 30 section which remain unencumbered or unobligated at the close
  1 31 of the fiscal year for which the funds were appropriated shall
  1 32 not revert but shall be available for expenditure for the
  1 33 following fiscal year for purposes of this section.
  1 34    Sec. 4.  Section 261.86, Code 2016, is amended by adding the
  1 35 following new subsection:
  2  1    NEW SUBSECTION.  7.  Not more than one percent of the moneys
  2  2 appropriated for purposes of this section may be used by the
  2  3 college student aid commission for purposes of administering
  2  4 this section.
  2  5    Sec. 5.  EFFECTIVE UPON ENACTMENT.  The following provision
  2  6 of this Act, being deemed of immediate importance, takes effect
  2  7 upon enactment:
  2  8    1.  The section of this Act amending section 261.86,
  2  9 subsection 6.
  2 10    Sec. 6.  RETROACTIVE APPLICABILITY.  The following provision
  2 11 of this Act applies retroactively to June 30, 2015:
  2 12    1.  The section of this Act amending section 261.86,
  2 13 subsection 6.
  2 14                           EXPLANATION
  2 15 The inclusion of this explanation does not constitute agreement with
  2 16 the explanation's substance by the members of the general assembly.
  2 17    This bill concerns the department of public defense.
  2 18    Code section 29.1 is amended to provide that the department
  2 19 of public defense is also composed of the Iowa gold star
  2 20 military museum and that the adjutant general shall perform all
  2 21 functions, responsibilities, powers, and duties concerning the
  2 22 museum.
  2 23    New Code section 29.4 provides that the department of public
  2 24 defense shall establish a military museum located at Camp Dodge
  2 25 which shall be known as the Iowa gold star military museum.
  2 26 The bill provides that the adjutant general shall administer
  2 27 the museum and may appoint a museum director and such other
  2 28 personnel for the purposes of maintaining and operating the
  2 29 museum.
  2 30    Code section 261.86, concerning the national guard education
  2 31 assistance program, is amended.  The bill eliminates the
  2 32 provision that moneys appropriated for purposes of this program
  2 33 shall not revert for the following fiscal year only until one
  2 34 year after operation Iraqi freedom, operation new dawn, and
  2 35 operation enduring freedom are concluded.  This provision takes
  3  1 effect upon enactment and applies retroactively to June 30,
  3  2 2015.  The Code section is further amended to provide that the
  3  3 college student aid commission may use no more than 1 percent
  3  4 of the moneys appropriated for the program for costs associated
  3  5 with administering the program.
