Section 232.2, subsection 39, Code 2016, is 1 2 amended to read as follows: 1 3 39. "Parent" means a biological or adoptive mother or 1 4 father of a childbut; or a father whose paternity has been 1 5 established by operation of law due to the individual's 1 6 marriage to the mother at the time of conception, birth, or 1 7 at any time during the period between conception and birth of 1 8 the child, by order of a court of competent jurisdiction, or 1 9 by administrative order when authorized by state law. "Parent" 1 10 does not include a mother or father whose parental rights have 1 11 been terminated. 1 12 EXPLANATION 1 13 The inclusion of this explanation does not constitute agreement with 1 14 the explanation's substance by the members of the general assembly. 1 15 This bill amends the definition of "parent" relative to the 1 16 rights, duties, and privileges parents have in the parent=child 1 17 relationship under the juvenile justice chapter of the Code 1 18 (chapter 232) to provide that in addition to a biological or 1 19 adoptive mother or father of a child, the definition includes 1 20 a father whose paternity has been established by operation 1 21 of law due to the individual's marriage to the mother at the 1 22 time of conception, birth, or at any time during the period 1 23 between conception and birth of the child; by order of a court 1 24 of competent jurisdiction; or by administrative order when 1 25 authorized by state law. The definition retains the current 1 26 provision that "parent" does not include a mother or father 1 27 whose parental rights have been terminated. LSB 5319SV (1) 86 pf/rj
