S.F. 2037 Section 1. Section 331.301, Code 2024, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 23. a. A county shall not adopt or enforce 3 an ordinance, motion, resolution, or amendment, or use any 4 other means, to regulate behavioral health and human services 5 that are subject to licensing or certification requirements 6 by a board, or performed by persons exempt from licensing or 7 certification requirements by a board, including professors, 8 government employees acting within the scope of the position, 9 students and trainees, clergy, and employees or volunteers of 10 nonprofit organizations, when the person’s services include any 11 of the following: 12 (1) Behavioral health services under chapter 147 or 154D. 13 (2) Psychology services under chapter 154B. 14 (3) Social work services under chapter 154C. 15 b. This section does not prohibit county regulations 16 consistent with traditional zoning considerations. 17 Sec. 2. Section 364.3, Code 2024, is amended by adding the 18 following new subsection: 19 NEW SUBSECTION . 18. a. A city shall not adopt or enforce 20 an ordinance, motion, resolution, or amendment, or use any 21 other means, to regulate behavioral health and human services 22 that are subject to licensing or certification requirements 23 by a board, or performed by persons exempt from licensing or 24 certification requirements by a board, including professors, 25 government employees acting within the scope of the position, 26 students and trainees, clergy, and employees or volunteers of 27 nonprofit organizations, when the person’s services include any 28 of the following: 29 (1) Behavioral health services under chapter 147 or 154D. 30 (2) Psychology services under chapter 154B. 31 (3) Social work services under chapter 154C. 32 b. S.F. 2037 The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 This bill prohibits counties and cities from adopting or 3 enforcing an ordinance, motion, resolution, or amendment, 4 or using any other means, to regulate certain behavioral 5 health and human services that are subject to licensing or 6 certification requirements by a board, including behavioral 7 health, psychology, and social work. The bill also prohibits 8 counties and cities from regulating those behavioral health 9 and human services when performed by persons exempt from 10 licensing and certification requirements by a board, including 11 professors, government employees acting within the scope of 12 the position, students and trainees, clergy, and employees 13 or volunteers of nonprofit organizations.
