1.
Section
331.301,
Code
2024,
is
amended
by
adding

the
following
new
subsection:

NEW
SUBSECTION

23.
a.
A
county
shall
not
adopt
or
enforce

an
ordinance,
motion,
resolution,
or
amendment,
or
use
any

other
means,
to
regulate
behavioral
health
and
human
services
5
that
are
subject
to
licensing
or
certification
requirements
6
by
a
board,
or
performed
by
persons
exempt
from
licensing
or
7
certification
requirements
by
a
board,
including
professors,
8
government
employees
acting
within
the
scope
of
the
position,
9
students
and
trainees,
clergy,
and
employees
or
volunteers
of
10
nonprofit
organizations,
when
the
person’s
services
include
any
11
of
the
following:

(1)
Behavioral
health
services
under
chapter
147
or
154D.

(2)
Psychology
services
under
chapter
154B.
14
(3)
Social
work
services
under
chapter
154C.

b.
This
section
does
not
prohibit
county
regulations

consistent
with
traditional
zoning
considerations.

2024,
is
amended
by
adding
the

following
new
subsection:

city

This
bill
prohibits
counties
and
cities
from
adopting
or

an
ordinance,

or
amendment,

regulate
certain
behavioral

health
and
human
services
that
are
subject
to
licensing
or

certification
requirements
by
a
board,
including
behavioral

health,
psychology,
and
social
work.
The
bill
also
prohibits

counties
and
cities
from
regulating
those
behavioral
health
9
and
human
services
when
performed
by
persons
exempt
from
10
licensing
and
certification
requirements
by
a
board,
including
11
professors,
government
employees
acting
within
the
scope
of
12
the
position,
students
and
trainees,
clergy,
and
employees
13
or
volunteers
of
nonprofit
organizations.
The
bill
does
14
not
prohibit
county
and
city
regulations
consistent
with
15
traditional
zoning
considerations.
