Section
217.41B,
subsection
2,
Code
2020,
is

amended
to
read
as
follows:

planning
services
program
funds

this
section

made

a

services
and
only
to
entities
that

provide
the
broad
range
of
acceptable
and
effective
family

planning
methods
and
services
as
required
pursuant
to
42
C.F.R.

pt.
59
.

Section
217.41B,
subsection
3,
paragraph
a,
9
subparagraph
(3),
Code
2020,
is
amended
to
read
as
follows:

(3)
For
the
purposes
of
this
section
,
“nonprofit
health
care
11
delivery
system”
means
an
any
of
the
following:

(a)
An
Iowa
nonprofit
corporation
that
controls,
directly
13
or
indirectly,
a
regional
health
care
network
consisting
of
14
hospital
facilities
and
various
ambulatory
and
clinic
locations
15
that
provide
a
range
of
primary,
secondary,
and
tertiary
16
inpatient,
outpatient,
and
physician
services.
17
(b)
A
global
nonprofit
corporation
that
operates,
through
18
affiliates,
as
the
largest
single
provider
of
reproductive
19
health
services
in
the
United
States
and
provides
a
range
20
of
services
including
general
health
care
services,
women’s
21
health
care
services,
men’s
health
care
services,
and
patient
22
education.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
providers
under
the
state
family
27
planning
services
program.
28
The
bill
provides
that
in
addition
to
the
current
29
requirement
that
distribution
of
family
planning
services
30
program
funds
be
made
in
a
manner
that
continues
access
to
31
family
planning
services,
the
bill
adds
a
requirement
that
32
distribution
be
made
only
to
entities
that
provide
the
broad
33
range
of
acceptable
and
effective
family
planning
methods

and
services
as
required
for
federal

services
grants.

Additionally,
the
program
prohibits
the
distribution
of
2
family
planning
services
program
funds
to
an
entity
that
3
performs
abortions
or
that
maintains
or
operates
a
facility
4
where
abortions
are
performed.
However,
this
prohibition
5
is
not
to
be
interpreted
to
include
a
nonpublic
entity
that
6
is
a
distinct
location
of
a
nonprofit
health
care
delivery
7
system
if
the
distinct
location
provides
family
planning
8
services
but
does
not
perform
abortions
or
maintain
or
operate
9
as
a
facility
where
abortions
are
performed
and
if,
as
a
10
condition
of
such
eligibility,
each
distinct
location
of
the
11
nonprofit
health
care
delivery
system
enrolls
in
the
state
12
family
planning
services
program
as
a
separate
provider,
13
is
assigned
a
distinct
provider
identification
number,
and
14
completes
an
attestation
that
abortions
are
not
performed
15
at
the
distinct
location.
Under
current
law,
a
“nonprofit
16
health
care
delivery
system”
is
defined
as
an
Iowa
nonprofit
17
corporation
that
controls,
directly
or
indirectly,
a
regional
18
health
care
network
consisting
of
hospital
facilities
and
19
various
ambulatory
and
clinic
locations
that
provide
a
range
20
of
primary,
secondary,
and
tertiary
inpatient,
outpatient,
and
21
physician
services.
The
bill
expands
this
definition
to
also
22
include
as
a
“nonprofit
health
care
delivery
system”
a
global
23
nonprofit
corporation
that
operates,
through

a

of
