The appropriations made in this subsection are in the 8 amounts anticipated to be received from the federal government 9 for the designated federal fiscal years under 42 U.S.C., ch. 10 6A, subch. XVII, part B, subpart ii, which provides for the 11 prevention and treatment of substance abuse block grant. 12 The department shall expend the funds appropriated in this 13 subsection as provided in the federal law making the funds 14 available and in conformance with chapter 17A . 15 b. Of the funds appropriated for each federal fiscal year 16 in this subsection, an amount not exceeding 5 percent shall be 17 used by the department for administrative expenses. 18 c. (1) For the state fiscal year beginning July 1, 2019, 19 the department shall expend no less than an amount equal to 20 the amount expended for treatment services in the state fiscal 21 year beginning July 1, 2018, for pregnant women and women with 22 dependent children. 23 (2) For the state fiscal year beginning July 1, 2020, the 24 department shall expend no less than an amount equal to the 25 amount expended for treatment services in the state fiscal 26 year beginning July 1, 2019, for pregnant women and women with 27 dependent children. 28 2. At least 20 percent of the funds remaining from the 29 appropriation made in subsection 1 for each federal fiscal year 30 shall be allocated for prevention programs. 31 3. In implementing the federal prevention and treatment of 32 substance abuse block grant under 42 U.S.C., ch. 6A, subch. 33 XVII, and any other applicable provisions of the federal Public 34 Health Service Act under 42 U.S.C., ch. 6A, the department 35 -1- LSB 1021XG (13) 88 hb/tm 1/ 18

No. 106-310, §3305, 1 as codified in 42 U.S.C. §300x-65, relating to services 2 under such federal law being provided by religious and other 3 nongovernmental organizations. 4 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION. 5 1. a. XVII, part B, subpart i, which provides for the 15 community mental health services block grant. The department 16 shall expend the funds appropriated in this subsection as 17 provided in the federal law making the funds available and in 18 conformance with chapter 17A . 19 c. The department shall allocate not less than 95 percent 20 of the amount of the block grant each federal fiscal year for 21 eligible community mental health services for carrying out 22 the plan submitted to and approved by the federal substance 23 abuse and mental health services administration or required 24 by the federal substance abuse and mental health services 25 administration for the fiscal year involved. 26 d. Of the amount allocated to eligible services providers 27 in paragraph “c” minus expenditures required by the federal 28 substance abuse and mental health services administration, 29 70 percent of the amount each federal fiscal year shall be 30 distributed to mental health and disability services regions 31 established consistent with section 331.389. The moneys 32 distributed shall be used for the purpose of funding services 33 required by section 331.397 and core services for children as 34 identified by the children’s system state board established 35 -2- LSB 1021XG (13) 88 hb/tm 2/ 18

An amount not exceeding 5 percent of the funds 2 appropriated in subsection 1 for each federal fiscal year shall 3 be used by the department of human services for administrative 4 expenses. From the funds set aside by this subsection for 5 administrative expenses, the department shall pay to the 6 auditor of state an amount sufficient to pay the cost of 7 auditing the use and administration of the state’s portion of 8 the funds appropriated in subsection 1. The auditor of state 9 shall bill the department for the costs of the audits. 10 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS. 11 1. The department shall expend the funds 22 appropriated in this subsection as provided in the federal law 23 making the funds available and in conformance with chapter 17A . 24 b. Funds appropriated in this subsection shall not be used 25 by the university of Iowa hospitals and clinics for indirect 26 costs. 27 2. An amount not exceeding 10 percent of the funds 28 appropriated in subsection 1 for each federal fiscal year shall 29 be used by the department of public health for administrative 30 expenses. 31 3. The departments of public health, human services, and 32 education and the university of Iowa’s mobile and regional 33 child health specialty clinics shall continue to pursue to the 34 maximum extent feasible the coordination and integration of 35 -3- LSB 1021XG (13) 88 hb/tm 3/ 18

Sixty-three percent of the amount remaining after 2 the allocation made in subsection 2 for each federal fiscal 3 year shall be allocated to supplement appropriations for 4 maternal and child health programs within the department of 5 public health. The 15 university of Iowa hospitals and clinics shall not receive an 16 allocation for indirect costs from the funds for this program. 17 Priority shall be given to establishment and maintenance of a 18 statewide system of mobile and regional child health specialty 19 clinics. 20 5. The department of public health shall administer the 21 statewide maternal and child health program and the disabled 22 children’s program by conducting mobile and regional child 23 health specialty clinics and conducting other activities to 24 improve the health of low-income women and children and to 25 promote the welfare of children with actual or potential 26 handicapping conditions and chronic illnesses in accordance 27 with the requirements of Tit. V of the federal Social Security 28 Act. 29 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES 30 APPROPRIATIONS. 31 1. XVII, part A, which provides for the preventive 6 health and health services block grant. The department shall 7 expend the funds appropriated in this subsection as provided in 8 the federal law making the funds available and in conformance 9 with chapter 17A . 10 2. Of the funds appropriated in subsection 1 for each 11 federal fiscal year, an amount not exceeding 10 percent shall 12 be used by the department for administrative expenses. 13 3. Of the funds appropriated in subsection 1 for each 14 federal fiscal year, the specific amount of funds stipulated 15 by the notice of the block grant award shall be allocated for 16 services to victims of sex offenses and for rape prevention 17 education. 18 4. After deducting the funds allocated in subsections 2 and 19 3, the remaining funds appropriated in subsection 1 for each 20 federal fiscal year may be used by the department for healthy 21 people 2020 and Iowa’s health improvement plan 2012-2016 22 program objectives, preventive health advisory committee, and 23 risk reduction services, including nutrition programs, health 24 incentive programs, chronic disease services, emergency medical 25 services, monitoring of the fluoridation program and start-up 26 fluoridation grants, and acquired immune deficiency syndrome 27 services. The moneys specified in this subsection shall not be 28 used by the university of Iowa hospitals and clinics or by the 29 state hygienic laboratory for the funding of indirect costs. 30 Sec. 5. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM 31 APPROPRIATION. 32 1. There is appropriated from the fund created by section 33 8.41 to the department of justice for the following federal 34 fiscal years beginning October 1, and ending September 30, the 35 -5- LSB 1021XG (13) 88 hb/tm 5/ 18

RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE 19 PRISONERS FORMULA GRANT PROGRAM. Each federal fiscal year, the administrator of the 31 division of community action agencies of the department 32 of human rights shall allocate not less than 96 percent of 33 the amount of the block grants to eligible community action 34 agencies for programs benefiting low-income persons. Each 35 -7- LSB 1021XG (13) 88 hb/tm 7/ 18
S.F. _____ H.F. _____ eligible agency shall receive a minimum allocation of not 1 less than $100,000. The minimum allocation shall be achieved 2 by redistributing increased funds from agencies experiencing 3 a greater share of available funds. The funds shall be 4 distributed on the basis of the poverty-level population in the 5 area represented by the community action areas compared to the 6 size of the poverty-level population in the state. 7 2. An amount not exceeding 4 percent of the funds 8 appropriated in subsection 1 for each federal fiscal year shall 9 be used by the division of community action agencies of the 10 department of human rights for administrative expenses. From 11 the funds set aside by this subsection for administrative 12 expenses, the division of community action agencies of the 13 department of human rights shall pay to the auditor of state 14 an amount sufficient to pay the cost of auditing the use and 15 administration of the state’s portion of the funds appropriated 16 in subsection 1. The auditor of state shall bill the division 17 of community action agencies for the costs of the audits. 18 Sec. 9. COMMUNITY DEVELOPMENT APPROPRIATIONS. 19 1. An amount not exceeding $1,100,000 for the federal 33 fiscal year beginning October 1, 2019, shall be used by the 34 economic development authority for administrative expenses for 35 -8- LSB 1021XG (13) 88 hb/tm 8/ 18

The total amount used 1 for administrative expenses includes $600,000 for the federal 2 fiscal year beginning October 1, 2019, of funds appropriated 3 in subsection 1 and a matching contribution from the state 4 equal to $500,000 from the appropriation of state funds for 5 the community development block grant and state appropriations 6 for related activities of the economic development authority. 7 From the funds set aside for administrative expenses by this 8 subsection, the economic development authority shall pay to 9 the auditor of state an amount sufficient to pay the cost of 10 auditing the use and administration of the state’s portion of 11 the funds appropriated in subsection 1. The auditor of state 12 shall bill the authority for the costs of the audit. 13 b. An amount not exceeding $1,100,000 for the federal 14 fiscal year beginning October 1, 2020, shall be used by the 15 economic development authority for administrative expenses for 16 the community development block grant. The total amount used 17 for administrative expenses includes $600,000 for the federal 18 fiscal year beginning October 1, 2020, of funds appropriated 19 in subsection 1 and a matching contribution from the state 20 equal to $500,000 from the appropriation of state funds for 21 the community development block grant and state appropriations 22 for related activities of the economic development authority. 23 From the funds set aside for administrative expenses by this 24 subsection, the economic development authority shall pay to 25 the auditor of state an amount sufficient to pay the cost of 26 auditing the use and administration of the state’s portion of 27 the funds appropriated in subsection 1. The auditor of state 28 shall bill the authority for the costs of the audit. 29 Sec. 10. SURFACE TRANSPORTATION BLOCK GRANT PROGRAM 30 APPROPRIATION. The 6 department shall expend the moneys appropriated in this section 7 as provided in the federal law making the funds available and 8 in conformance with chapter 17A . 9 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS. 10 1. II, which provides for the low-income home energy 21 assistance block grants. The division of community action 22 agencies of the department of human rights shall expend the 23 funds appropriated in this subsection as provided in the 24 federal law making the funds available and in conformance with 25 chapter 17A . 26 2. Up to 15 percent, or up to 25 percent if a waiver is 27 approved by the United States department of health and human 28 services, of the amount appropriated in this section that is 29 actually received for each federal fiscal year shall be used 30 for residential weatherization or other related home repairs 31 for low-income households. Of this allocation amount, not more 32 than 10 percent may be used for administrative expenses. 33 3. After subtracting the allocation in subsection 2, up to 34 10 percent of the remaining moneys for each federal fiscal year 35 -10- LSB 1021XG (13) 88 hb/tm 10/ 18
S.F. _____ H.F. _____ are allocated for administrative expenses of the low-income 1 home energy assistance program of which $377,000 is allocated 2 each federal fiscal year for administrative expenses of the 3 division. The costs of auditing the use and administration 4 of the portion of the appropriation in this section that is 5 retained by the state shall be paid from the amount allocated 6 in this subsection each federal fiscal year to the division. 7 The auditor of state shall bill the division for the audit 8 costs. 9 4. The remaining moneys of the appropriation made in this 10 section for each federal fiscal year following the allocations 11 made in subsections 2 and 3, shall be used to help eligible 12 households as defined in 42 U.S.C., ch. 94, subch. II, to meet 13 home energy costs. 14 5. Not more than 10 percent of the amount appropriated in 15 this section each federal fiscal year that is actually received 16 may be carried forward for use in the succeeding federal fiscal 17 year. 18 6. Expenditures for assessment and resolution of energy 19 problems shall be limited to not more than 5 percent of the 20 amount appropriated in this section for each federal fiscal 21 year that is actually received. 22 Sec. 12. SOCIAL SERVICES APPROPRIATIONS. 23 1. SOCIAL SERVICES BLOCK GRANT PLAN. The department 7 of human services during each state fiscal year shall develop a 8 plan for the use of federal social services block grant funds 9 for the subsequent state fiscal year. 10 The proposed plan shall include all programs and services 11 at the state level which the department proposes to fund with 12 federal social services block grant funds, and shall identify 13 state and other funds which the department proposes to use to 14 fund the state programs and services. 15 The proposed plan shall also include all local programs and 16 services which are eligible to be funded with federal social 17 services block grant funds, the total amount of federal social 18 services block grant funds available for the local programs and 19 services, and the manner of distribution of the federal social 20 services block grant funds to the counties. The proposed plan 21 shall identify state and local funds which will be used to fund 22 the local programs and services. 23 The proposed plan shall be submitted with the department’s 24 budget requests to the governor and the general assembly. 25 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM 26 HOMELESSNESS. 27 1. Upon receipt of the minimum formula grant from 28 the federal substance abuse and mental health services 29 administration to provide mental health services for the 30 homeless, for the federal fiscal years beginning October 1, 31 2019, and October 1, 2020, the department of human services 32 shall assure that a project which receives funds under the 33 formula grant shall do all of the following: 34 a. Provide outreach and engagement to homeless individuals 35 -13- LSB 1021XG (13) 88 hb/tm 13/ 18
S.F. _____ H.F. _____ and individuals at risk of homelessness and assesses those 1 individuals for serious mental illness. 2 b. Enroll those individuals with serious mental illness who 3 are willing to accept services through the project. 4 c. Provide case management to homeless persons. 5 d. Provide appropriate training to persons who provide 6 services to persons targeted by the grant. 7 e. Assure a local match share of 25 percent. 8 f. Refer homeless individuals and individuals at risk of 9 homelessness to primary health care, job training, educational 10 services, and relevant housing services. 11 2. A project may expend funds for community mental health 12 services, diagnostic services, crisis intervention services, 13 habilitation and rehabilitation services, substance-related 14 disorder services, supportive and supervisory services to 15 homeless persons living in residential settings that are 16 not otherwise supported, and housing services including 17 minor renovation, expansion, and repair of housing, security 18 deposits, planning of housing, technical assistance in 19 applying for housing, improving the coordination of housing 20 services, the costs associated with matching eligible homeless 21 individuals with appropriate housing, and one-time rental 22 payments to prevent eviction. 23 Sec. 15. CHILD CARE AND DEVELOPMENT APPROPRIATION. II-B, which provides for the child care and 34 development block grant. The department shall expend the funds 35 -14- LSB 1021XG (13) 88 hb/tm 14/ 18
S.F. _____ H.F. _____ appropriated in this section as provided in the federal law 1 making the funds available and in conformance with chapter 17A . 2 Moneys appropriated in this section that remain unencumbered 3 or unobligated at the close of the fiscal year shall revert to 4 be available for appropriation for purposes of the child care 5 and development block grant in the succeeding fiscal year. 6 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS. 7 1. Unless otherwise necessary to meet federal requirements, 8 if the funds received from the federal government for the 9 block grants specified in this Act are less than the amounts 10 appropriated, the funds actually received shall be prorated 11 by the governor for the various programs, other than for the 12 services to victims of sex offenses and for rape prevention 13 education under section 4, subsection 3, of this Act, for which 14 each block grant is available according to the percentages that 15 each program is to receive as specified in this Act. However, 16 if the governor determines that the funds allocated by the 17 percentages will not be sufficient to accomplish the purposes 18 of a particular program, or if the appropriation is not 19 allocated by percentage, the governor may allocate the funds in 20 a manner which will accomplish to the greatest extent possible 21 the purposes of the various programs for which the block grants 22 are available. 23 2. Before the governor implements the actions provided for 24 in subsection 1, the following procedures shall be taken: 25 a. The chairpersons and ranking members of the senate and 26 house standing committees on appropriations, the appropriate 27 chairpersons and ranking members of subcommittees of those 28 committees, and the director of the legislative services agency 29 shall be notified of the proposed action. 30 b. The notice shall include the proposed allocations, 31 and information on the reasons why particular percentages or 32 amounts of funds are allocated to the individual programs, 33 the departments and programs affected, and other information 34 deemed useful. S.F. _____ H.F. _____ be allowed at least two weeks to review and comment on the 1 proposed action before the action is taken. 2 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS. 3 1. Unless otherwise necessary to meet federal requirements, 4 if funds received from the federal government in the form of 5 block grants exceed the amounts appropriated in sections 1, 2, 6 3, 4, 7, 9, and 13 of this Act, the excess shall be prorated 7 to the appropriate programs according to the percentages 8 specified in those sections, except additional funds shall not 9 be prorated for administrative expenses. 10 2. If actual funds received from the federal government 11 from block grants exceed the amount appropriated in section 12 12 of this Act for the low-income home energy assistance program, 13 not more than 15 percent of the excess may be allocated to the 14 low-income residential weatherization program and not more than 15 10 percent of the excess may be used for administrative costs. 16 3. If funds received from the federal government from 17 community services block grants exceed the amount appropriated 18 in section 8 of this Act, 100 percent of the excess is 19 allocated to the community services block grant program. 20 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL 21 FUNDS. If other federal grants, receipts, and funds and other 22 nonstate grants, receipts, and funds become available or are 23 awarded which are not available or awarded during the period 24 in which the general assembly is in session, but which require 25 expenditure by the applicable department or agency prior to 26 March 15 of the fiscal years beginning July 1, 2019, and July 27 1, 2020, these grants, receipts, and funds are appropriated to 28 the extent necessary, provided that the fiscal committee of 29 the legislative council is notified within 30 days of receipt 30 of the grants, receipts, or funds and the fiscal committee of 31 the legislative council has an opportunity to comment on the 32 expenditure of the grants, receipts, or funds. 33 Sec. 19. Department of workforce development. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill makes appropriations of federal block grants, 14 other federal funds, and nonstate funds. 15 The bill appropriates for the 2019-2020 federal fiscal year 16 and the 2020-2021 federal fiscal year block grants available 17 from the federal government and provides procedures for 18 increasing or decreasing the appropriations if the amounts 19 block grants are increased or decreased from the amounts 20 anticipated.
