Section
11.41,
subsection
3,
Code
2021,
is

amended
to
read
as
follows:

3.
If
the
information,
records,
instrumentalities,
and

properties
sought
by
the
auditor
of
state
are
required
by
law
4
to
be
kept
confidential,
the
auditor
of
state
shall
have
access
5
to
the
information,
records,
instrumentalities,
and
properties,
6
but
shall
maintain
the
confidentiality
of
all
such
information
7
and
is
subject
to
the
same
penalties
as
the
lawful
custodian
8
of
the
information
for
dissemination
of
the
information.
9
However,
the
auditor
of
state
shall
not
have
access
to
the
10
income
tax
returns
of
individuals
or
to
personally
identifiable
11
information
included
in
a
reportable
disease
report,
including
12
but
not
limited
to
the
information
required
to
be
included
in
13
such
a
report
as
specified
in
section
139A.3,
subsection
1
.

Section
139A.3,
Code
2021,
is
amended
by
adding
the
15
following
new
subsection:

SUBSECTION
.
1A.
A
state
or
local
agency
employee
17
or
agent
shall
not
have
access
to
personally
identifiable
18
information
included
in
a
reportable
disease
report
provided
19
to
or
maintained
by
the
department,
a
local
board,
or
a
20
local
department,
unless
the
employee
or
agent
has
completed
21
training
regarding
the
federal
Health
Insurance
Portability
and
22
Accountability
Act
of
1996,
Pub.
L.
No.
104–191.

The
inclusion
of
this
explanation
does
not
constitute
agreement

the
explanation’s

the
general

This
bill
relates
to
personally
identifiable
information

included
in
a
reportable
disease
report.

The
bill
provides
that
the
auditor
of
state
shall
not
have
29
access
to
personally
identifiable
information
included
in
a
30
reportable
disease
report,
including
but
not
limited
to
the
31
information
required
to
be
included
in
such
a
report
by
law.

The
bill
also
prohibits
a
state
or
local
agency
employee
or
33
agent
from
having
access
to
personally
identifiable
information

included
in
a
reportable
disease
report
provided
to
or
