GENERAL FUND ==== DEPARTMENT. 1 5 1. There is appropriated from the general fund of the state 1 6 to the department of agriculture and land stewardship for the 1 7 fiscal year beginning July 1, 2017, and ending June 30, 2018, 1 8 the following amount, or so much thereof as is necessary, to be 1 9 used for the purposes designated: 1 10 For purposes of supporting the department, including its 1 11 divisions, for administration, regulation, and programs; for 1 12 salaries, support, maintenance, and miscellaneous purposes; and 1 13 for not more than the following full=time equivalent positions: 1 14 .................................................. $ 17,640,576 1 15 ............................................... The department shall submit a report each quarter of the 1 22 fiscal year to the legislative services agency, the department 1 23 of management, the members of the joint appropriations 1 24 subcommittee on agriculture and natural resources, and the 1 25 chairpersons and ranking members of the senate and house 1 26 committees on appropriations. The report shall describe in 1 27 detail the expenditure of moneys appropriated in this section 1 28 to support the department's administration, regulation, and 1 29 programs. 1 30 DESIGNATED APPROPRIATIONS 1 31 MISCELLANEOUS FUNDS 1 32 Sec. 2. UNCLAIMED PARI=MUTUEL WAGERING WINNINGS ==== 1 33 HORSE AND DOG RACING. There is appropriated from the moneys 1 34 available under section 99D.13 to the department of agriculture 1 35 and land stewardship for the fiscal year beginning July 1, 2 1 2017, and ending June 30, 2018, the following amount, or so 2 2 much thereof as is necessary, to be used for the purposes 2 3 designated: 2 4 For purposes of supporting the department's administration 2 5 and enforcement of horse and dog racing law pursuant to section 2 6 99D.22, including for salaries, support, maintenance, and 2 7 miscellaneous purposes: 2 8 .................................................. $ 295,516 2 9 Sec. 3. RENEWABLE FUEL INFRASTRUCTURE FUND ==== MOTOR FUEL 2 10 INSPECTION. 2 11 1. There is appropriated from the renewable fuel 2 12 infrastructure fund created in section 159A.16 to the 2 13 department of agriculture and land stewardship for the fiscal 2 14 year beginning July 1, 2017, and ending June 30, 2018, the 2 15 following amount, or so much thereof as is necessary, to be 2 16 used for the purposes designated: 2 17 For purposes of the inspection of motor fuel, including 2 18 salaries, support, maintenance, and miscellaneous purposes: 2 19 .................................................. $ 500,000 2 20 2. The department shall establish and administer programs 2 21 for the auditing of motor fuel including biofuel processing 2 22 and production plants, for screening and testing motor fuel, 2 23 including renewable fuel, and for the inspection of motor fuel 2 24 sold by dealers including retail dealers who sell and dispense 2 25 motor fuel from motor fuel pumps. 2 26 SPECIAL APPROPRIATIONS 2 27 GENERAL FUND 2 28 Sec. 4. DAIRY REGULATION. 2 29 1. There is appropriated from the general fund of the state 2 30 to the department of agriculture and land stewardship for the 2 31 fiscal year beginning July 1, 2017, and ending June 30, 2018, 2 32 the following amount, or so much thereof as is necessary, to be 2 33 used for the purposes designated: 2 34 For purposes of performing functions pursuant to section 2 35 192.109, including conducting a survey of grade "A" milk and 3 1 certifying the results to the secretary of agriculture: 3 2 .................................................. $ 189,196 3 3 2. Notwithstanding section 8.33, moneys appropriated in 3 4 this section that remain unencumbered or unobligated at the 3 5 close of the fiscal year shall not revert but shall remain 3 6 available to be used for the purposes designated until the 3 7 close of the succeeding fiscal year. 3 8 Sec. 5. LOCAL FOOD AND FARM PROGRAM. 3 9 1. There is appropriated from the general fund of the state 3 10 to the department of agriculture and land stewardship for the 3 11 fiscal year beginning July 1, 2017, and ending June 30, 2018, 3 12 the following amount, or so much thereof as is necessary, to be 3 13 used for the purposes designated: 3 14 For purposes of supporting the local food and farm program 3 15 pursuant to chapter 267A: 3 16 .................................................. $ 75,000 3 17 2. The department shall enter into a cost=sharing agreement 3 18 with Iowa state university of science and technology to support 3 19 the local food and farm program coordinator position as part of 3 20 the university's cooperative extension service in agriculture 3 21 and home economics pursuant to chapter 267A. 3 22 3. Notwithstanding section 8.33, moneys appropriated in 3 23 this section that remain unencumbered or unobligated at the 3 24 close of the fiscal year shall not revert but shall remain 3 25 available to be used for the purposes designated until the 3 26 close of the succeeding fiscal year. 3 27 Sec. 6. AGRICULTURAL EDUCATION. 3 28 1. There is appropriated from the general fund of the state 3 29 to the department of agriculture and land stewardship for the 3 30 fiscal year beginning July 1, 2017, and ending June 30, 2018, 3 31 the following amount, or so much thereof as is necessary, to be 3 32 used for the purposes designated: 3 33 For purposes of allocating moneys to an Iowa association 3 34 affiliated with a national organization which promotes 3 35 agricultural education providing for future farmers: 4 1 .................................................. $ 25,000 4 2 2. Notwithstanding section 8.33, moneys appropriated in 4 3 this section that remain unencumbered or unobligated at the 4 4 close of the fiscal year shall not revert but shall remain 4 5 available to be used for the purposes designated until the 4 6 close of the succeeding fiscal year. 4 7 Sec. 7. FARMERS WITH DISABILITIES PROGRAM. 4 8 1. There is appropriated from the general fund of the state 4 9 to the department of agriculture and land stewardship for the 4 10 fiscal year beginning July 1, 2017, and ending June 30, 2018, 4 11 the following amount, or so much thereof as is necessary, to be 4 12 used for the purposes designated: 4 13 For purposes of supporting a program for farmers with 4 14 disabilities: 4 15 .................................................. $ 130,000 4 16 2. The moneys appropriated in subsection 1 shall be used for 4 17 the public purpose of providing a grant to a national nonprofit 4 18 organization with over 80 years of experience in assisting 4 19 children and adults with disabilities and special needs. The 4 20 moneys shall be used to support a nationally recognized program 4 21 that began in 1986 and has been replicated in at least 30 other 4 22 states, but which is not available through any other entity 4 23 in this state, and that provides assistance to farmers with 4 24 disabilities in all 99 counties to allow the farmers to remain 4 25 in their own homes and be gainfully engaged in farming through 4 26 provision of agricultural worksite and home modification 4 27 consultations, peer support services, services to families, 4 28 information and referral, and equipment loan services. 4 29 3. Notwithstanding section 8.33, moneys appropriated in 4 30 this section that remain unencumbered or unobligated at the 4 31 close of the fiscal year shall not revert but shall remain 4 32 available for expenditure for the purposes designated until the 4 33 close of the succeeding fiscal year. 4 34 DIVISION II 4 35 GENERAL FUND 5 1 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 5 2 WATER QUALITY INITIATIVE 5 3 APPROPRIATIONS FOR FY 2017=2018 5 4 Sec. 8. WATER QUALITY INITIATIVE ==== GENERAL. 5 5 1. There is appropriated from the general fund of the state 5 6 to the department of agriculture and land stewardship for the 5 7 fiscal year beginning July 1, 2017, and ending June 30, 2018, 5 8 the following amount, or so much thereof as is necessary, to be 5 9 used for the purposes designated: 5 10 For deposit in the water quality initiative fund created in 5 11 section 466B.45, for purposes of supporting the water quality 5 12 initiative administered by the division of soil conservation 5 13 and water quality as provided in section 466B.42, including 5 14 salaries, support, maintenance, and miscellaneous purposes: 5 15 .................................................. $ 3,000,000 5 16 2. a. The moneys appropriated in subsection 1 shall be 5 17 used to support projects in subwatersheds as designated by the 5 18 division that are part of high=priority watersheds identified 5 19 by the water resources coordinating council established 5 20 pursuant to section 466B.3. 5 21 b. The moneys appropriated in subsection 1 shall be used to 5 22 support projects in watersheds generally, including regional 5 23 watersheds, as designated by the division and high=priority 5 24 watersheds identified by the water resources coordinating 5 25 council established pursuant to section 466B.3. 5 26 3. In supporting projects in subwatersheds and watersheds 5 27 as provided in subsection 2, all of the following shall apply: 5 28 a. The demonstration projects shall utilize water quality 5 29 practices as described in the latest revision of the document 5 30 entitled "Iowa Nutrient Reduction Strategy" initially presented 5 31 in November 2012 by the department of agriculture and land 5 32 stewardship, the department of natural resources, and Iowa 5 33 state university of science and technology. 5 34 b. The division shall implement demonstration projects as 5 35 provided in paragraph "a" by providing for participation by 6 1 persons who hold a legal interest in agricultural land used in 6 2 farming. To every extent practical, the division shall provide 6 3 for collaborative participation by such persons who hold a 6 4 legal interest in agricultural land located within the same 6 5 subwatershed. 6 6 c. The division shall implement a demonstration project on 6 7 a cost=share basis as determined by the division. However, the 6 8 state's share of the amount shall not exceed 50 percent of the 6 9 estimated cost of establishing the practice as determined by 6 10 the division or 50 percent of the actual cost of establishing 6 11 the practice, whichever is less. 6 12 d. The demonstration projects shall be used to educate other 6 13 persons about the feasibility and value of establishing similar 6 14 water quality practices. The division shall promote field day 6 15 events for purposes of allowing interested persons to establish 6 16 water quality practices on their agricultural land. 6 17 e. The division shall conduct water quality evaluations 6 18 within supported subwatersheds. Within a reasonable period 6 19 after accumulating information from such evaluations, the 6 20 division shall create an aggregated database of water quality 6 21 practices. Any information identifying a person holding a 6 22 legal interest in agricultural land or specific agricultural 6 23 land shall be a confidential record under section 22.7. 6 24 4. The moneys appropriated in subsection 1 shall be used 6 25 to support education and outreach in a manner that encourages 6 26 persons who hold a legal interest in agricultural land used for 6 27 farming to implement water quality practices, including the 6 28 establishment of such practices in watersheds generally, and 6 29 not limited to subwatersheds or high=priority watersheds. 6 30 5. The moneys appropriated in subsection 1 may be used 6 31 to contract with persons to coordinate the implementation of 6 32 efforts provided in this section. 6 33 6. The moneys appropriated in subsection 1 may be used by 6 34 the department to support urban soil and water conservation 6 35 efforts, which may include but are not limited to management 7 1 practices related to bioretention, landscaping, the use of 7 2 permeable or pervious pavement, and soil quality restoration. 7 3 The moneys shall be allocated on a cost=share basis as provided 7 4 in chapter 161A. 7 5 7. Notwithstanding any other provision of law to the 7 6 contrary, the department may use moneys appropriated in 7 7 subsection 1 to carry out the provisions of this section on a 7 8 cost=share basis in combination with other moneys available to 7 9 the department from a state or federal source. 7 10 8. Not more than 10 percent of the moneys appropriated in 7 11 this section may be used to pay for the costs of administering 7 12 and implementing the water quality initiative by the 7 13 department's division of soil conservation and water quality as 7 14 provided in section 466B.42 and this section. 7 15 DIVISION III 7 16 DEPARTMENT OF NATURAL RESOURCES 7 17 GENERAL APPROPRIATIONS FOR FY 2017=2018 7 18 Sec. 9. GENERAL FUND ==== DEPARTMENT. 7 19 1. There is appropriated from the general fund of the state 7 20 to the department of natural resources for the fiscal year 7 21 beginning July 1, 2017, and ending June 30, 2018, the following 7 22 amount, or so much thereof as is necessary, to be used for the 7 23 purposes designated: 7 24 For purposes of supporting the department, including its 7 25 divisions, for administration, regulation, and programs; for 7 26 salaries, support, maintenance, and miscellaneous purposes; and 7 27 for not more than the following full=time equivalent positions: 7 28 .................................................. $ 11,299,811 7 29 ............................................... FTEs 1,145.95 7 30 2. Of the number of full=time equivalent positions 7 31 authorized to the department pursuant to subsection 1, 50 7 32 full=time equivalent positions shall be allocated by the 7 33 department for seasonal employees for purposes of providing 7 34 maintenance, upkeep, and sanitary services at state parks. 7 35 This subsection shall not impact park ranger or park manager 8 1 positions within the department. 8 2 3. The department shall submit a report each quarter of the 8 3 fiscal year to the legislative services agency, the department 8 4 of management, the members of the joint appropriations 8 5 subcommittee on agriculture and natural resources, and the 8 6 chairpersons and ranking members of the senate and house 8 7 committees on appropriations. The report shall describe in 8 8 detail the expenditure of moneys appropriated under this 8 9 section to support the department's administration, regulation, 8 10 and programs. 8 11 Sec. 10. STATE FISH AND GAME PROTECTION FUND ==== REGULATION 8 12 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 8 13 1. There is appropriated from the state fish and game 8 14 protection fund to the department of natural resources for the 8 15 fiscal year beginning July 1, 2017, and ending June 30, 2018, 8 16 the following amount, or so much thereof as is necessary, to be 8 17 used for the purposes designated: 8 18 For purposes of supporting the regulation or advancement of 8 19 hunting, fishing, or trapping, or the protection, propagation, 8 20 restoration, management, or harvest of fish or wildlife, 8 21 including for administration, regulation, law enforcement, and 8 22 programs; and for salaries, support, maintenance, equipment, 8 23 and miscellaneous purposes: 8 24 .................................................. $ 43,147,993 8 25 2. Notwithstanding section 455A.10, the department may use 8 26 the unappropriated balance remaining in the state fish and game 8 27 protection fund to provide for the funding of health and life 8 28 insurance premium payments from unused sick leave balances of 8 29 conservation peace officers employed in a protection occupation 8 30 who retire, pursuant to section 97B.49B. 8 31 3. Notwithstanding section 455A.10, the department of 8 32 natural resources may use the unappropriated balance remaining 8 33 in the state fish and game protection fund for the fiscal 8 34 year beginning July 1, 2017, and ending June 30, 2018, as is 8 35 necessary to fund salary adjustments for departmental employees 9 1 for which the general assembly has made an operating budget 9 2 appropriation in subsection 1. 9 3 Sec. 11. GROUNDWATER PROTECTION FUND ==== WATER 9 4 QUALITY. There is appropriated from the groundwater protection 9 5 fund created in section 455E.11 to the department of natural 9 6 resources for the fiscal year beginning July 1, 2017, 9 7 and ending June 30, 2018, from those moneys which are not 9 8 allocated pursuant to that section, the following amount, or 9 9 so much thereof as is necessary, to be used for the purposes 9 10 designated: 9 11 For purposes of supporting the department's protection 9 12 of the state's groundwater, including for administration, 9 13 regulation, and programs, and for salaries, support, 9 14 maintenance, equipment, and miscellaneous purposes: 9 15 .................................................. $ 3,455,832 9 16 DESIGNATED APPROPRIATIONS 9 17 MISCELLANEOUS FUNDS 9 18 Sec. 12. SPECIAL SNOWMOBILE FUND ==== SNOWMOBILE 9 19 PROGRAM. There is appropriated from the special snowmobile 9 20 fund created under section 321G.7 to the department of natural 9 21 resources for the fiscal year beginning July 1, 2017, and 9 22 ending June 30, 2018, the following amount, or so much thereof 9 23 as is necessary, to be used for the purpose designated: 9 24 For purposes of administering and enforcing the state 9 25 snowmobile programs: 9 26 .................................................. $ 100,000 9 27 Sec. 13. UNASSIGNED REVENUE FUND ==== UNDERGROUND STORAGE 9 28 TANKS SECTION EXPENSES. There is appropriated from the 9 29 unassigned revenue fund administered by the Iowa comprehensive 9 30 petroleum underground storage tank fund board established 9 31 pursuant to section 455G.4 to the department of natural 9 32 resources for the fiscal year beginning July 1, 2017, and 9 33 ending June 30, 2018, the following amount, or so much thereof 9 34 as is necessary, to be used for the purpose designated: 9 35 For purposes of paying for administration expenses of the 10 1 department's underground storage tanks section: 10 2 .................................................. $ 200,000 10 3 SPECIAL APPROPRIATIONS 10 4 GENERAL FUND 10 5 Sec. 14. FLOODPLAIN MANAGEMENT AND DAM SAFETY. 10 6 1. There is appropriated from the general fund of the state 10 7 to the department of natural resources for the fiscal year 10 8 beginning July 1, 2017, and ending June 30, 2018, the following 10 9 amount, or so much thereof as is necessary, to be used for the 10 10 purpose designated: 10 11 For purposes of supporting floodplain management and dam 10 12 safety: 10 13 .................................................. $ 1,885,000 10 14 2. Of the amount appropriated in subsection 1, up to 10 15 $400,000 may be used by the department to acquire or install 10 16 stream gages for purposes of tracking and predicting flood 10 17 events and for compiling necessary data to improve flood 10 18 frequency analysis. 10 19 3. Notwithstanding section 8.33, moneys appropriated in 10 20 subsection 1 that remain unencumbered or unobligated at the 10 21 close of the fiscal year shall not revert but shall remain 10 22 available for expenditure for the purposes designated until the 10 23 close of the succeeding fiscal year. 10 24 Sec. 15. FORESTRY HEALTH MANAGEMENT. 10 25 1. There is appropriated from the general fund of the state 10 26 to the department of natural resources for the fiscal year 10 27 beginning July 1, 2017, and ending June 30, 2018, the following 10 28 amount, or so much thereof as is necessary, to be used for the 10 29 purposes designated: 10 30 For purposes of providing for forestry health management 10 31 programs: 10 32 .................................................. $ 500,000 10 33 2. Notwithstanding section 8.33, moneys appropriated in 10 34 this section that remain unencumbered or unobligated at the 10 35 close of the fiscal year shall not revert but shall remain 11 1 available to be used for the purposes designated until the 11 2 close of the succeeding fiscal year. 11 3 DIVISION IV 11 4 IOWA STATE UNIVERSITY 11 5 SPECIAL GENERAL FUND APPROPRIATIONS FOR FY 2017=2018 11 6 VETERINARY DIAGNOSTIC LABORATORY 11 7 Sec. 16. VETERINARY DIAGNOSTIC LABORATORY. 11 8 1. There is appropriated from the general fund of the state 11 9 to Iowa state university of science and technology for the 11 10 fiscal year beginning July 1, 2017, and ending June 30, 2018, 11 11 the following amount, or so much thereof as is necessary, to be 11 12 used for the purposes designated: 11 13 For purposes of supporting the college of veterinary 11 14 medicine for the operation of the veterinary diagnostic 11 15 laboratory and for not more than the following full=time 11 16 equivalent positions: 11 17 .................................................. $ 4,000,000 11 18 ............................................... FTEs 51.00 11 19 2. a. Iowa state university of science and technology 11 20 shall not reduce the amount that it allocates to support the 11 21 college of veterinary medicine from any other source due to the 11 22 appropriation made in this section. 11 23 b. Paragraph "a" does not apply to a reduction made to 11 24 support the college of veterinary medicine, if the same 11 25 percentage of reduction imposed on the college of veterinary 11 26 medicine is also imposed on all of Iowa state university of 11 27 science and technology's budget units. 11 28 3. If by June 30, 2018, Iowa state university of science and 11 29 technology fails to allocate the moneys appropriated in this 11 30 section to the college of veterinary medicine in accordance 11 31 with this section, the moneys appropriated in this section for 11 32 that fiscal year shall revert to the general fund of the state. 11 33 DIVISION V 11 34 ENVIRONMENT FIRST FUND 11 35 GENERAL APPROPRIATIONS FOR FY 2017=2018 12 1 Sec. 17. DEPARTMENT OF AGRICULTURE AND LAND 12 2 STEWARDSHIP. There is appropriated from the environment first 12 3 fund created in section 8.57A to the department of agriculture 12 4 and land stewardship for the fiscal year beginning July 1, 12 5 2017, and ending June 30, 2018, the following amounts, or so 12 6 much thereof as is necessary, to be used for the purposes 12 7 designated: 12 8 1. CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP) 12 9 a. For the conservation reserve enhancement program to 12 10 restore and construct wetlands for the purposes of intercepting 12 11 tile line runoff, reducing nutrient loss, improving water 12 12 quality, and enhancing agricultural production practices: 12 13 .................................................. $ 1,000,000 12 14 b. Not more than 10 percent of the moneys appropriated 12 15 in paragraph "a" may be used for costs of administration and 12 16 implementation of soil and water conservation practices. 12 17 c. Notwithstanding any other provision in law, the 12 18 department may use moneys appropriated in this subsection, 12 19 in combination with other appropriate environment first 12 20 fund appropriations, for cost sharing to match United States 12 21 department of agriculture, natural resources conservation 12 22 service, wetlands reserve enhancement program (WREP) funding 12 23 available to Iowa. 12 24 2. WATERSHED PROTECTION 12 25 a. For continuation of a program that provides 12 26 multiobjective resource protections for flood control, water 12 27 quality, erosion control, and natural resource conservation: 12 28 .................................................. $ 900,000 12 29 b. Not more than 10 percent of the moneys appropriated 12 30 in paragraph "a" may be used for costs of administration and 12 31 implementation of soil and water conservation practices. 12 32 3. FARM MANAGEMENT DEMONSTRATION PROGRAM 12 33 a. For continuation of a statewide voluntary farm 12 34 management demonstration program to demonstrate the 12 35 effectiveness and adaptability of emerging practices in 13 1 agronomy that protect water resources and provide other 13 2 environmental benefits: 13 3 .................................................. $ 375,000 13 4 b. The amount appropriated in paragraph "a", shall be 13 5 allocated to an organization representing soybean growers to 13 6 provide for an agriculture and environment performance program. 13 7 4. SOIL AND WATER CONSERVATION ==== ADMINISTRATION 13 8 a. For use by the department for costs of administration and 13 9 implementation of soil and water conservation practices: 13 10 .................................................. $ 3,800,000 13 11 b. Of the moneys appropriated in paragraph "a", $150,000 13 12 is allocated to support field staff providing technical 13 13 assistance. 13 14 5. CONSERVATION RESERVE PROGRAM (CRP) 13 15 a. To encourage and assist farmers in enrolling in and the 13 16 implementation of the federal conservation reserve program and 13 17 to work with them to enhance their revegetation efforts to 13 18 improve water quality and habitat: 13 19 .................................................. $ 900,000 13 20 b. Not more than 10 percent of the moneys appropriated 13 21 in paragraph "a" may be used for costs of administration and 13 22 implementation of soil and water conservation practices. 13 23 6. SOIL AND WATER CONSERVATION 13 24 a. For use by the department in providing for soil and water 13 25 conservation: 13 26 .................................................. $ 8,325,000 13 27 b. (1) Of the amount appropriated in paragraph "a", for 13 28 transfer to the hungry canyons account of the loess hills 13 29 development and conservation fund created in section 161D.2: 13 30 .................................................. $ 450,000 13 31 (2) Of the amount transferred to the hungry canyons account 13 32 pursuant to subparagraph (1), not more than 10 percent of the 13 33 moneys may be used for administrative costs. 13 34 c. Of the remaining amount appropriated in paragraph "a", 13 35 for use by the department in providing for soil and water 14 1 conservation administration, the conservation of soil and 14 2 water resources, or the support of soil and water conservation 14 3 districts: 14 4 .................................................. $ 7,875,000 14 5 d. Of the amount appropriated in paragraph "c" that the 14 6 department allocates to a soil and water conservation district, 14 7 the first $15,000 may be expended by the district for the 14 8 purpose of providing financial incentives under section 161A.73 14 9 to establish management practices for the control of soil 14 10 erosion on land that is row=cropped, including but not limited 14 11 to nontill planting, ridge=till planting, and contouring 14 12 strip=cropping. Of any remaining amount of that appropriation 14 13 allocated by the department to a district, 30 percent may be 14 14 expended by the district for that same purpose. 14 15 e. Not more than 5 percent of the moneys appropriated in 14 16 paragraph "c" may be allocated for cost sharing to address 14 17 complaints filed under section 161A.47. 14 18 f. Of the moneys appropriated in paragraph "c", 5 percent 14 19 shall be allocated for financial incentives to establish 14 20 practices to protect watersheds above publicly owned lakes of 14 21 the state from soil erosion and sediment as provided in section 14 22 161A.73. 14 23 g. The state soil conservation committee established by 14 24 section 161A.4 may allocate moneys appropriated in paragraph 14 25 "c" to conduct research and demonstration projects to promote 14 26 conservation tillage and nonpoint source pollution control 14 27 practices. 14 28 h. The allocation of moneys as financial incentives as 14 29 provided in section 161A.73 may be used in combination with 14 30 moneys allocated by the department of natural resources. 14 31 i. Not more than 15 percent of the moneys appropriated 14 32 in paragraph "c" may be used for costs of administration and 14 33 implementation of soil and water conservation practices. 14 34 j. In lieu of moneys appropriated in section 466A.5, not 14 35 more than $25,000 of the moneys appropriated in paragraph "c" 15 1 shall be used by the division of soil conservation and water 15 2 quality of the department of agriculture and land stewardship 15 3 to provide administrative support to the watershed improvement 15 4 review board established in section 466A.3. 15 5 Sec. 18. DEPARTMENT OF NATURAL RESOURCES. There is 15 6 appropriated from the environment first fund created in section 15 7 8.57A to the department of natural resources for the fiscal 15 8 year beginning July 1, 2017, and ending June 30, 2018, the 15 9 following amounts, or so much thereof as is necessary, to be 15 10 used for the purposes designated: 15 11 1. STATE PARKS MAINTENANCE AND OPERATIONS 15 12 a. For regular maintenance and operations of state parks and 15 13 staff time associated with these activities: 15 14 .................................................. $ 6,235,000 15 15 b. REVERSION. 16 21 1. a. Except as provided in paragraph "b", and 16 22 notwithstanding section 8.33, moneys appropriated for the 16 23 fiscal year beginning July 1, 2017, in this division of this 16 24 Act that remain unencumbered or unobligated at the close of the 16 25 fiscal year shall not revert but instead shall remain available 16 26 to be used for the purposes designated until the close of the 16 27 succeeding fiscal year, or until the project for which the 16 28 appropriation was made is completed, whichever is earlier. 16 29 b. Notwithstanding section 8.33, moneys appropriated for 16 30 the fiscal year beginning July 1, 2017, in this division of 16 31 this Act to the department of agriculture and land stewardship 16 32 to provide financial assistance for the establishment of 16 33 permanent soil and water conservation practices that remain 16 34 unencumbered or unobligated at the close of the fiscal year 16 35 shall not revert but instead shall remain available for 17 1 expenditure for the purposes designated until the close of the 17 2 fiscal year beginning July 1, 2020. 17 3 2. Subsection 1 does not apply to moneys transferred 17 4 pursuant to this division to the hungry canyons account of 17 5 the loess hills development and conservation fund created in 17 6 section 161D.2 which shall not revert as provided in that 17 7 section. 17 8 DIVISION VI 17 9 ENVIRONMENT FIRST FUND 17 10 SPECIAL APPROPRIATIONS FOR FY 2017=2018 17 11 Sec. 20. WATER QUALITY INITIATIVE ==== DEPARTMENT OF 17 12 AGRICULTURE AND LAND STEWARDSHIP. 17 13 1. There is appropriated from the environment first fund 17 14 created in section 8.57A to the department of agriculture 17 15 and land stewardship for the fiscal year beginning July 1, 17 16 2017, and ending June 30, 2018, the following amount, or so 17 17 much thereof as is necessary, to be used for the purposes 17 18 designated: 17 19 For deposit in the water quality initiative fund created in 17 20 section 466B.45, for purposes of supporting the water quality 17 21 initiative administered by the division of soil conservation 17 22 and water quality as provided in section 466B.42, including 17 23 salaries, support, maintenance, and miscellaneous purposes: 17 24 .................................................. $ 2,375,000 17 25 2. a. The moneys appropriated in subsection 1 shall be 17 26 used to support projects in subwatersheds as designated by the 17 27 division that are part of high=priority watersheds identified 17 28 by the water resources coordinating council established 17 29 pursuant to section 466B.3. 17 30 b. The moneys appropriated in subsection 1 shall be used to 17 31 support projects in watersheds generally, including regional 17 32 watersheds, as designated by the division and high=priority 17 33 watersheds identified by the water resources coordinating 17 34 council established pursuant to section 466B.3. 17 35 3. In supporting projects in subwatersheds and watersheds 18 1 as provided in subsection 2, all of the following shall apply: 18 2 a. The demonstration projects shall utilize water quality 18 3 practices as described in the latest revision of the document 18 4 entitled "Iowa Nutrient Reduction Strategy" initially presented 18 5 in November 2012 by the department of agriculture and land 18 6 stewardship, the department of natural resources, and Iowa 18 7 state university of science and technology. 18 8 b. The division shall implement demonstration projects as 18 9 provided in paragraph "a" by providing for participation by 18 10 persons who hold a legal interest in agricultural land used in 18 11 farming. To every extent practical, the division shall provide 18 12 for collaborative participation by such persons who hold a 18 13 legal interest in agricultural land located within the same 18 14 subwatershed. 18 15 c. The division shall implement a demonstration project on 18 16 a cost=share basis as determined by the division. However, the 18 17 state's share of the amount shall not exceed 50 percent of the 18 18 estimated cost of establishing the practice as determined by 18 19 the division or 50 percent of the actual cost of establishing 18 20 the practice, whichever is less. 18 21 d. The demonstration projects shall be used to educate other 18 22 persons about the feasibility and value of establishing similar 18 23 water quality practices. The division shall promote field day 18 24 events for purposes of allowing interested persons to establish 18 25 water quality practices on their agricultural land. 18 26 e. The division shall conduct water quality evaluations 18 27 within supported subwatersheds. Within a reasonable period 18 28 after accumulating information from such evaluations, the 18 29 division shall create an aggregated database of water quality 18 30 practices. Any information identifying a person holding a 18 31 legal interest in agricultural land or specific agricultural 18 32 land shall be a confidential record under section 22.7. 18 33 4. The moneys appropriated in subsection 1 shall be used 18 34 to support education and outreach in a manner that encourages 18 35 persons who hold a legal interest in agricultural land used for 19 1 farming to implement water quality practices, including the 19 2 establishment of such practices in watersheds generally, and 19 3 not limited to subwatersheds or high=priority watersheds. 19 4 5. The moneys appropriated in subsection 1 may be used 19 5 to contract with persons to coordinate the implementation of 19 6 efforts provided in this section. 19 7 6. The moneys appropriated in subsection 1 may be used by 19 8 the department to support urban soil and water conservation 19 9 efforts, which may include but are not limited to management 19 10 practices related to bioretention, landscaping, the use of 19 11 permeable or pervious pavement, and soil quality restoration. 19 12 The moneys shall be allocated on a cost=share basis as provided 19 13 in chapter 161A. 19 14 7. Notwithstanding any other provision of law to the 19 15 contrary, the department may use moneys appropriated in 19 16 subsection 1 to carry out the provisions of this section on a 19 17 cost=share basis in combination with other moneys available to 19 18 the department from a state or federal source. 19 19 8. Not more than 10 percent of the moneys appropriated in 19 20 this section may be used to pay for the costs of administering 19 21 and implementing the water quality initiative by the 19 22 department's division of soil conservation and water quality as 19 23 provided in section 466B.42 and this section. 19 24 Sec. 21. REAP ==== IN LIEU OF GENERAL FUND APPROPRIATION. 19 25 Notwithstanding the standing appropriation in section 455A.18, 19 26 there is appropriated from the environment first fund created 19 27 in section 8.57A to the Iowa resources enhancement and 19 28 protection fund, in lieu of the appropriation made in section 19 29 455A.18, for the fiscal year beginning July 1, 2017, and 19 30 ending June 30, 2018, the following amount, to be allocated as 19 31 provided in section 455A.19: 19 32 .................................................. $ 12,000,000 19 33 DIVISION VII 19 34 ELIMINATION OF WATERSHED IMPROVEMENT REVIEW BOARD 19 35 SPECIAL APPROPRIATION FOR FY 2017=2018 20 1 RELATED STATUTORY CHANGES 20 2 Sec. 22. MANAGEMENT OF MONEYS IN THE WATERSHED IMPROVEMENT 20 3 FUND ==== APPROPRIATION. 20 4 1. Notwithstanding section 466A.2, and the repeal of 20 5 chapter 466A as provided in this division of this Act, on and 20 6 after December 31, 2017, the department of agriculture and land 20 7 stewardship shall manage the watershed improvement fund in the 20 8 same manner as required in 2016 Acts, chapter 1134, section 20 9 35, including by making necessary payments to satisfy any 20 10 outstanding obligations incurred by the watershed improvement 20 11 review board prior to December 31, 2017. 20 12 2. Any unobligated and unencumbered moneys remaining in 20 13 the watershed improvement fund on December 31, 2017, are 20 14 appropriated to the department for use by the department in 20 15 providing for soil and water conservation administration, the 20 16 conservation of soil and water resources, or the support of 20 17 soil and water conservation districts in the same manner as 20 18 provided in the section of this Act appropriating moneys to the 20 19 department from the environment first fund created in section 20 20 8.57A. 20 21 Sec. 23. Section 461.33, subsection 2, paragraph a, Code 20 22 2017, is amended to read as follows: 20 23 a. Soil conservation and watershed protection, including by 20 24 supporting the division of soil conservation and water quality 20 25 within the department of agriculture and land stewardship 20 26 and soil and water conservation district commissioners. The 20 27 department may provide for the installation of conservation 20 28 practices and watershed protection improvements as provided in 20 29 chapters 161A, 161C, 461A, and 466, and 466A. 20 30 Sec. 24. REPEAL. Chapter 466A, Code 2017, is repealed. 20 31 Sec. 25. EFFECTIVE DATES. 20 32 1. The section of this division of this Act repealing 20 33 chapter 466A takes effect January 1, 2018. 20 34 2. The remainder of the provisions in this division take 20 35 effect July 1, 2017. 21 1 DIVISION VIII 21 2 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND 21 3 SPECIAL USE OF MONEYS FOR FY 2017=2018 21 4 Sec. 26. OPEN SPACES ACCOUNT ==== PARK MAINTENANCE AND 21 5 REPAIR. Notwithstanding section 455A.19, subsection 1, 21 6 paragraph "a", subparagraph (1), of the moneys allocated to 21 7 the open spaces account of the Iowa resources enhancement and 21 8 protection fund, $288,000 shall be used by the department of 21 9 natural resources for state park maintenance and repair for 21 10 the fiscal year beginning July 1, 2017, and ending on June 30, 21 11 2018. 21 12 DIVISION IX 21 13 LIVESTOCK HEALTH SPECIAL APPROPRIATION FOR FY 2017=2018 21 14 GENERAL FUND ==== RELATED STATUTORY CHANGES 21 15 Sec. 27. FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK ==== 21 16 APPROPRIATION. There is appropriated from the general fund of 21 17 the state to the department of agriculture and land stewardship 21 18 for the fiscal year beginning July 1, 2017, and ending June 30, 21 19 2018, the following amount, or so much thereof as is necessary, 21 20 to be used for the purposes designated: 21 21 1. For deposit in the foreign animal disease preparedness 21 22 and response fund created in section 163.3B as enacted in this 21 23 division of this Act: 21 24 .................................................. $ 100,000 21 25 2. In developing a foreign animal disease preparedness and 21 26 response strategy as required in section 163.3C as enacted in 21 27 this division of this Act, the department shall prepare an 21 28 interim report to be submitted to the joint appropriations 21 29 subcommittee on agriculture and natural resources not later 21 30 than January 10, 2018. The interim report shall include 21 31 preliminary findings and recommendations together with plans 21 32 for completing the strategy. The department shall prepare 21 33 a final report to be submitted to the joint appropriations 21 34 subcommittee on agriculture and natural resources not later 21 35 than January 10, 2019. The report shall include final 22 1 findings and recommendations for establishing the strategy, 22 2 and may include any proposed notice of intended action for 22 3 consideration by the department or proposed legislation for 22 4 consideration by the general assembly. 22 5 Sec. 28. NEW SECTION. 163.3B Foreign animal disease 22 6 preparedness and response fund. 22 7 1. A foreign animal disease preparedness and response 22 8 fund is created in the state treasury under the control and 22 9 management of the department. 22 10 2. The fund shall include moneys appropriated by the general 22 11 assembly credited to the fund. The fund may include other 22 12 moneys available to and obtained or accepted by the department 22 13 as provided in section 159.6A, including but not limited to the 22 14 federal government, other public sources, or private sources. 22 15 3. Moneys in the fund are appropriated to the department and 22 16 shall be used exclusively to develop, establish, and implement 22 17 a foreign animal disease preparedness and response strategy 22 18 as described in section 163.3C, and shall not require further 22 19 special authorization by the general assembly. 22 20 4. a. Notwithstanding section 12C.7, interest or earnings 22 21 on moneys in the fund shall be credited to the fund. 22 22 b. Notwithstanding section 8.33, moneys credited to the fund 22 23 that remain unexpended or unobligated at the end of a fiscal 22 24 year shall not revert to any other fund. 22 25 Sec. 29. NEW SECTION. 163.3C Foreign animal disease 22 26 preparedness and response strategy. 22 27 1. As used in this section, unless the context otherwise 22 28 requires: 22 29 a. "Foreign animal disease" means a disease introduced into 22 30 this state that negatively affects the health of livestock 22 31 and is transmittable between the same or different species of 22 32 livestock. 22 33 b. "Livestock" means an animal belonging to the bovine, 22 34 caprine, equine, ovine, or porcine species, ostriches, rheas, 22 35 emus; farm deer as defined in section 170.1; or turkeys, 23 1 chickens, or other poultry. 23 2 2. The department shall develop and establish a foreign 23 3 animal disease preparedness and response strategy for use by 23 4 the department in order to prevent, control, or eradicate the 23 5 transmission of foreign animal diseases among populations 23 6 of livestock. The strategy may be part of the department's 23 7 veterinary emergency preparedness and response services 23 8 as provided in section 163.3A. The strategy shall provide 23 9 additional expertise and resources to increase biosecurity 23 10 efforts that assist in the prevention of a foreign animal 23 11 disease outbreak in this state. In developing and establishing 23 12 the strategy, the department shall consult with interested 23 13 persons including but not limited to the following: 23 14 a. The Iowa cattlemen's association. 23 15 b. The Iowa state dairy association. 23 16 c. The Iowa pork producers association. 23 17 d. The Iowa sheep producers industry association. 23 18 e. The Iowa turkey federation. 23 19 f. The Iowa poultry association. 23 20 g. The college of veterinary medicine at Iowa state 23 21 university. 23 22 h. The livestock health advisory council created in section 23 23 267.2. 23 24 3. The department shall implement the foreign animal 23 25 disease preparedness and response strategy if necessary 23 26 to prevent, control, or eradicate the transmission and 23 27 incidence of foreign animal diseases that may threaten or 23 28 actually threaten livestock in this state. In implementing 23 29 the strategy, the department may utilize emergency response 23 30 measures as otherwise required under section 163.3A. The 23 31 department may but is not required to consult with interested 23 32 persons when implementing the strategy. 23 33 DIVISION X 23 34 APPROPRIATION AND STATUTORY CHANGES ==== ELIMINATION 23 35 OF LEOPOLD CENTER FOR SUSTAINABLE AGRICULTURE 24 1 Sec. 30. Section 266.39A, Code 2017, is amended to read as 24 2 follows: 24 3 266.39A Agricultural research. 24 4 Iowa state university of science and technology shall 24 5 conduct continuing agricultural research to provide information 24 6 about environmental and social impacts of agricultural research 24 7 on the small or family farm and information about population 24 8 trends and impact of the trends on Iowa agriculture, in 24 9 addition to research that may include the categories specified 24 10 in section 266.39B, subsection 2. The research shall include 24 11 an agricultural land tenure study conducted every five years to 24 12 determine the ownership of farmland, and to analyze ownership 24 13 trends, using the categories of land ownership defined in 24 14 chapter 9H. The study shall be conducted on the basis of 24 15 regions established by the university. A region shall be 24 16 composed of not more than twenty=three contiguous counties. 24 17 Sec. 31. Section 455E.11, subsection 2, paragraph b, 24 18 subparagraph (3), subparagraph division (a), Code 2017, is 24 19 amended to read as follows: 24 20 (a) Thirty=five percent is appropriated annuallyfor 24 21 the Leopold center for sustainable agriculture at Iowa state 24 22 university of science and technologyto the Iowa nutrient 24 23 research fund created in section 466B.46. 24 24 Sec. 32. Section 466B.46, subsection 2, Code 2017, is 24 25 amended by adding the following new paragraph: 24 26 NEW PARAGRAPH. 0b. Moneys appropriated from the agriculture 24 27 management account of the groundwater protection fund pursuant 24 28 to section 455E.11, subsection 2, paragraph "b", subparagraph 24 29 (3), subparagraph division (a). 24 30 Sec. 33. ONGOING ACTIVITIES AND EXPENSES. 24 31 1. Until July 1, 2017, the Leopold center for sustainable 24 32 agriculture established in section 266.39 shall not initiate 24 33 any new activity that otherwise could be conducted under 24 34 section 266.39 or 266.39B, including but not limited to 24 35 research grants and projects. The Leopold center for 25 1 sustainable agriculture shall not incur any obligation or 25 2 expense unless approved by the college of agriculture and life 25 3 sciences at Iowa state university of science and technology. 25 4 The Leopold center for sustainable agriculture shall cancel 25 5 any existing grant or project that is not in the process of 25 6 being immediately completed. However, the Leopold center 25 7 for sustainable agriculture shall not cancel a grant or 25 8 project that would result in a default of a legal or equitable 25 9 obligation, including breach of contract. 25 10 2. On and after July 1, 2017, the college of agriculture 25 11 and life sciences at Iowa state university of science and 25 12 technology shall administer any ongoing activity that the 25 13 Leopold center for sustainable agriculture had administered 25 14 under section 266.39 or 266.39B prior to that date. The 25 15 college may expend moneys appropriated from the Iowa nutrient 25 16 research fund created in section 466B.46 in order to pay for 25 17 any necessary expenses associated with the Leopold center 25 18 for sustainable agriculture and for completing any ongoing 25 19 activity. The college shall cancel any existing grant 25 20 or project that is not in the process of being completed. 25 21 However, the college shall not cancel a grant or project that 25 22 would result in a default of a legal or equitable obligation, 25 23 including breach of contract. The college shall submit a 25 24 report to the general assembly by January 10, 2018, which 25 25 shall include a summary of the ongoing activities and expenses 25 26 described in this section and the expected completion date of 25 27 those activities and expenses. 25 28 Sec. 34. REPEAL. Sections 266.39 and 266.39B, Code 2017, 25 29 are repealed. 25 30 Sec. 35. EFFECTIVE DATES. 25 31 1. The section of this division of this Act providing for 25 32 ongoing activities and expenses, being deemed of immediate 25 33 importance, takes effect upon enactment. 25 34 2. The section of this division of this Act repealing 25 35 sections 266.39 and 266.39B takes effect on July 1, 2017. 26 1 DIVISION XI 26 2 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 26 3 GENERAL APPROPRIATION FOR FY 2018=2019 26 4 Sec. 36. GENERAL FUND ==== DEPARTMENT. 26 5 1. The department shall submit a report each quarter of the 26 22 fiscal year to the legislative services agency, the department 26 23 of management, the members of the joint appropriations 26 24 subcommittee on agriculture and natural resources, and the 26 25 chairpersons and ranking members of the senate and house 26 26 committees on appropriations. The report shall describe in 26 27 detail the expenditure of moneys appropriated in this section 26 28 to support the department's administration, regulation, and 26 29 programs. 26 30 DESIGNATED APPROPRIATIONS 26 31 MISCELLANEOUS FUNDS 26 32 Sec. 37. UNCLAIMED PARI=MUTUEL WAGERING WINNINGS ==== 26 33 HORSE AND DOG RACING. There is appropriated from the moneys 26 34 available under section 99D.13 to the department of agriculture 26 35 and land stewardship for the fiscal year beginning July 1, 27 1 2018, and ending June 30, 2019, the following amount, or so 27 2 much thereof as is necessary, to be used for the purposes 27 3 designated: 27 4 For purposes of supporting the department's administration 27 5 and enforcement of horse and dog racing law pursuant to section 27 6 99D.22, including for salaries, support, maintenance, and 27 7 miscellaneous purposes: 27 8 .................................................. $ 147,758 27 9 Sec. 38. RENEWABLE FUEL INFRASTRUCTURE FUND ==== MOTOR FUEL 27 10 INSPECTION. 27 11 1. There is appropriated from the renewable fuel 27 12 infrastructure fund created in section 159A.16 to the 27 13 department of agriculture and land stewardship for the fiscal 27 14 year beginning July 1, 2018, and ending June 30, 2019, the 27 15 following amount, or so much thereof as is necessary, to be 27 16 used for the purposes designated: 27 17 For purposes of the inspection of motor fuel, including 27 18 salaries, support, maintenance, and miscellaneous purposes: 27 19 .................................................. $ 250,000 27 20 2. The department shall establish and administer programs 27 21 for the auditing of motor fuel including biofuel processing 27 22 and production plants, for screening and testing motor fuel, 27 23 including renewable fuel, and for the inspection of motor fuel 27 24 sold by dealers including retail dealers who sell and dispense 27 25 motor fuel from motor fuel pumps. 27 26 SPECIAL APPROPRIATIONS 27 27 GENERAL FUND 27 28 Sec. 39. DAIRY REGULATION. 27 29 1. There is appropriated from the general fund of the state 27 30 to the department of agriculture and land stewardship for the 27 31 fiscal year beginning July 1, 2018, and ending June 30, 2019, 27 32 the following amount, or so much thereof as is necessary, to be 27 33 used for the purposes designated: 27 34 For purposes of performing functions pursuant to section 27 35 192.109, including conducting a survey of grade "A" milk and 28 1 certifying the results to the secretary of agriculture: 28 2 .................................................. $ 94,598 28 3 2. LOCAL FOOD AND FARM PROGRAM. 28 9 1. There is appropriated from the general fund of the state 28 10 to the department of agriculture and land stewardship for the 28 11 fiscal year beginning July 1, 2018, and ending June 30, 2019, 28 12 the following amount, or so much thereof as is necessary, to be 28 13 used for the purposes designated: 28 14 For purposes of supporting the local food and farm program 28 15 pursuant to chapter 267A: 28 16 .................................................. $ 37,500 28 17 2. The department shall enter into a cost=sharing agreement 28 18 with Iowa state university of science and technology to support 28 19 the local food and farm program coordinator position as part of 28 20 the university's cooperative extension service in agriculture 28 21 and home economics pursuant to chapter 267A. 28 22 3. Notwithstanding section 8.33, moneys appropriated in 28 23 this section that remain unencumbered or unobligated at the 28 24 close of the fiscal year shall not revert but shall remain 28 25 available to be used for the purposes designated until the 28 26 close of the succeeding fiscal year. 28 27 Sec. 41. AGRICULTURAL EDUCATION. 28 28 1. There is appropriated from the general fund of the state 28 29 to the department of agriculture and land stewardship for the 28 30 fiscal year beginning July 1, 2018, and ending June 30, 2019, 28 31 the following amount, or so much thereof as is necessary, to be 28 32 used for the purposes designated: 28 33 For purposes of allocating moneys to an Iowa association 28 34 affiliated with a national organization which promotes 28 35 agricultural education providing for future farmers: 29 1 .................................................. $ 12,500 29 2 2. Notwithstanding section 8.33, moneys appropriated in 29 3 this section that remain unencumbered or unobligated at the 29 4 close of the fiscal year shall not revert but shall remain 29 5 available to be used for the purposes designated until the 29 6 close of the succeeding fiscal year. 29 7 Sec. 42. FARMERS WITH DISABILITIES PROGRAM. 29 8 1. There is appropriated from the general fund of the state 29 9 to the department of agriculture and land stewardship for the 29 10 fiscal year beginning July 1, 2018, and ending June 30, 2019, 29 11 the following amount, or so much thereof as is necessary, to be 29 12 used for the purposes designated: 29 13 For purposes of supporting a program for farmers with 29 14 disabilities: 29 15 .................................................. $ 65,000 29 16 2. The moneys appropriated in subsection 1 shall be used for 29 17 the public purpose of providing a grant to a national nonprofit 29 18 organization with over 80 years of experience in assisting 29 19 children and adults with disabilities and special needs. The 29 20 moneys shall be used to support a nationally recognized program 29 21 that began in 1986 and has been replicated in at least 30 other 29 22 states, but which is not available through any other entity 29 23 in this state, and that provides assistance to farmers with 29 24 disabilities in all 99 counties to allow the farmers to remain 29 25 in their own homes and be gainfully engaged in farming through 29 26 provision of agricultural worksite and home modification 29 27 consultations, peer support services, services to families, 29 28 information and referral, and equipment loan services. 29 29 3. Notwithstanding section 8.33, moneys appropriated in 29 30 this section that remain unencumbered or unobligated at the 29 31 close of the fiscal year shall not revert but shall remain 29 32 available for expenditure for the purposes designated until the 29 33 close of the succeeding fiscal year. 29 34 DIVISION XII 29 35 GENERAL FUND 30 1 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 30 2 WATER QUALITY INITIATIVE 30 3 APPROPRIATIONS FOR FY 2018=2019 30 4 Sec. 43. WATER QUALITY INITIATIVE ==== GENERAL. 30 5 1. There is appropriated from the general fund of the state 30 6 to the department of agriculture and land stewardship for the 30 7 fiscal year beginning July 1, 2018, and ending June 30, 2019, 30 8 the following amount, or so much thereof as is necessary, to be 30 9 used for the purposes designated: 30 10 For deposit in the water quality initiative fund created in 30 11 section 466B.45, for purposes of supporting the water quality 30 12 initiative administered by the division of soil conservation 30 13 and water quality as provided in section 466B.42, including 30 14 salaries, support, maintenance, and miscellaneous purposes: 30 15 .................................................. $ 1,500,000 30 16 2. a. The moneys appropriated in subsection 1 shall be 30 17 used to support projects in subwatersheds as designated by the 30 18 division that are part of high=priority watersheds identified 30 19 by the water resources coordinating council established 30 20 pursuant to section 466B.3. 30 21 b. The moneys appropriated in subsection 1 shall be used to 30 22 support projects in watersheds generally, including regional 30 23 watersheds, as designated by the division and high=priority 30 24 watersheds identified by the water resources coordinating 30 25 council established pursuant to section 466B.3. 30 26 3. In supporting projects in subwatersheds and watersheds 30 27 as provided in subsection 2, all of the following shall apply: 30 28 a. The demonstration projects shall utilize water quality 30 29 practices as described in the latest revision of the document 30 30 entitled "Iowa Nutrient Reduction Strategy" initially presented 30 31 in November 2012 by the department of agriculture and land 30 32 stewardship, the department of natural resources, and Iowa 30 33 state university of science and technology. 30 34 b. The division shall implement demonstration projects as 30 35 provided in paragraph "a" by providing for participation by 31 1 persons who hold a legal interest in agricultural land used in 31 2 farming. To every extent practical, the division shall provide 31 3 for collaborative participation by such persons who hold a 31 4 legal interest in agricultural land located within the same 31 5 subwatershed. 31 6 c. The division shall implement a demonstration project on 31 7 a cost=share basis as determined by the division. However, the 31 8 state's share of the amount shall not exceed 50 percent of the 31 9 estimated cost of establishing the practice as determined by 31 10 the division or 50 percent of the actual cost of establishing 31 11 the practice, whichever is less. 31 12 d. The demonstration projects shall be used to educate other 31 13 persons about the feasibility and value of establishing similar 31 14 water quality practices. The division shall promote field day 31 15 events for purposes of allowing interested persons to establish 31 16 water quality practices on their agricultural land. 31 17 e. The division shall conduct water quality evaluations 31 18 within supported subwatersheds. Within a reasonable period 31 19 after accumulating information from such evaluations, the 31 20 division shall create an aggregated database of water quality 31 21 practices. Any information identifying a person holding a 31 22 legal interest in agricultural land or specific agricultural 31 23 land shall be a confidential record under section 22.7. 31 24 4. The moneys appropriated in subsection 1 shall be used 31 25 to support education and outreach in a manner that encourages 31 26 persons who hold a legal interest in agricultural land used for 31 27 farming to implement water quality practices, including the 31 28 establishment of such practices in watersheds generally, and 31 29 not limited to subwatersheds or high=priority watersheds. 31 30 5. The moneys appropriated in subsection 1 may be used 31 31 to contract with persons to coordinate the implementation of 31 32 efforts provided in this section. 31 33 6. The moneys appropriated in subsection 1 may be used by 31 34 the department to support urban soil and water conservation 31 35 efforts, which may include but are not limited to management 32 1 practices related to bioretention, landscaping, the use of 32 2 permeable or pervious pavement, and soil quality restoration. 32 3 The moneys shall be allocated on a cost=share basis as provided 32 4 in chapter 161A. 32 5 7. Notwithstanding any other provision of law to the 32 6 contrary, the department may use moneys appropriated in 32 7 subsection 1 to carry out the provisions of this section on a 32 8 cost=share basis in combination with other moneys available to 32 9 the department from a state or federal source. 32 10 8. Not more than 10 percent of the moneys appropriated in 32 11 this section may be used to pay for the costs of administering 32 12 and implementing the water quality initiative by the 32 13 department's division of soil conservation and water quality as 32 14 provided in section 466B.42 and this section. 32 15 DIVISION XIII 32 16 DEPARTMENT OF NATURAL RESOURCES 32 17 GENERAL APPROPRIATIONS FOR FY 2018=2019 32 18 Sec. 44. GENERAL FUND ==== DEPARTMENT. 32 19 1. There is appropriated from the general fund of the state 32 20 to the department of natural resources for the fiscal year 32 21 beginning July 1, 2018, and ending June 30, 2019, the following 32 22 amount, or so much thereof as is necessary, to be used for the 32 23 purposes designated: 32 24 For purposes of supporting the department, including its 32 25 divisions, for administration, regulation, and programs; for 32 26 salaries, support, maintenance, and miscellaneous purposes; and 32 27 for not more than the following full=time equivalent positions: 32 28 .................................................. $5,649,905.50 32 29 ............................................... FTEs 1,145.95 32 30 2. Of the number of full=time equivalent positions 32 31 authorized to the department pursuant to subsection 1, 50 32 32 full=time equivalent positions shall be allocated by the 32 33 department for seasonal employees for purposes of providing 32 34 maintenance, upkeep, and sanitary services at state parks. 32 35 This subsection shall not impact park ranger or park manager 33 1 positions within the department. 33 2 3. The department shall submit a report each quarter of the 33 3 fiscal year to the legislative services agency, the department 33 4 of management, the members of the joint appropriations 33 5 subcommittee on agriculture and natural resources, and the 33 6 chairpersons and ranking members of the senate and house 33 7 committees on appropriations. The report shall describe in 33 8 detail the expenditure of moneys appropriated under this 33 9 section to support the department's administration, regulation, 33 10 and programs. 33 11 Sec. 45. STATE FISH AND GAME PROTECTION FUND ==== REGULATION 33 12 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 33 13 1. There is appropriated from the state fish and game 33 14 protection fund to the department of natural resources for the 33 15 fiscal year beginning July 1, 2018, and ending June 30, 2019, 33 16 the following amount, or so much thereof as is necessary, to be 33 17 used for the purposes designated: 33 18 For purposes of supporting the regulation or advancement of 33 19 hunting, fishing, or trapping, or the protection, propagation, 33 20 restoration, management, or harvest of fish or wildlife, 33 21 including for administration, regulation, law enforcement, and 33 22 programs; and for salaries, support, maintenance, equipment, 33 23 and miscellaneous purposes: 33 24 .................................................. $21,573,996.50 33 25 2. Notwithstanding section 455A.10, the department may use 33 26 the unappropriated balance remaining in the state fish and game 33 27 protection fund to provide for the funding of health and life 33 28 insurance premium payments from unused sick leave balances of 33 29 conservation peace officers employed in a protection occupation 33 30 who retire, pursuant to section 97B.49B. 33 31 3. Notwithstanding section 455A.10, the department of 33 32 natural resources may use the unappropriated balance remaining 33 33 in the state fish and game protection fund for the fiscal 33 34 year beginning July 1, 2018, and ending June 30, 2019, as is 33 35 necessary to fund salary adjustments for departmental employees 34 1 for which the general assembly has made an operating budget 34 2 appropriation in subsection 1. 34 3 Sec. 46. GROUNDWATER PROTECTION FUND ==== WATER 34 4 QUALITY. FORESTRY HEALTH MANAGEMENT. 35 25 1. There is appropriated from the general fund of the state 35 26 to the department of natural resources for the fiscal year 35 27 beginning July 1, 2018, and ending June 30, 2019, the following 35 28 amount, or so much thereof as is necessary, to be used for the 35 29 purposes designated: 35 30 For purposes of providing for forestry health management 35 31 programs: 35 32 .................................................. $ 250,000 35 33 2. If by June 30, 2019, Iowa state university of science and 36 29 technology fails to allocate the moneys appropriated in this 36 30 section to the college of veterinary medicine in accordance 36 31 with this section, the moneys appropriated in this section for 36 32 that fiscal year shall revert to the general fund of the state. 36 33 DIVISION XV 36 34 ENVIRONMENT FIRST FUND 36 35 GENERAL APPROPRIATIONS FOR FY 2018=2019 37 1 Sec. 52. DEPARTMENT OF AGRICULTURE AND LAND 37 2 STEWARDSHIP. There is appropriated from the environment first 37 3 fund created in section 8.57A to the department of agriculture 37 4 and land stewardship for the fiscal year beginning July 1, 37 5 2018, and ending June 30, 2019, the following amounts, or so 37 6 much thereof as is necessary, to be used for the purposes 37 7 designated: 37 8 1. CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP) 37 9 a. For the conservation reserve enhancement program to 37 10 restore and construct wetlands for the purposes of intercepting 37 11 tile line runoff, reducing nutrient loss, improving water 37 12 quality, and enhancing agricultural production practices: 37 13 .................................................. $ 500,000 37 14 b. Not more than 5 percent of the moneys appropriated in 39 16 paragraph "c" may be allocated for cost sharing to address 39 17 complaints filed under section 161A.47. 39 18 f. Of the moneys appropriated in paragraph "c", 5 percent 39 19 shall be allocated for financial incentives to establish 39 20 practices to protect watersheds above publicly owned lakes of 39 21 the state from soil erosion and sediment as provided in section 39 22 161A.73. 39 23 g. The state soil conservation committee established by 39 24 section 161A.4 may allocate moneys appropriated in paragraph 39 25 "c" to conduct research and demonstration projects to promote 39 26 conservation tillage and nonpoint source pollution control 39 27 practices. 39 28 h. The allocation of moneys as financial incentives as 39 29 provided in section 161A.73 may be used in combination with 39 30 moneys allocated by the department of natural resources. 39 31 i. Not more than 15 percent of the moneys appropriated 39 32 in paragraph "c" may be used for costs of administration and 39 33 implementation of soil and water conservation practices. 39 34 Sec. 53. DEPARTMENT OF NATURAL RESOURCES. REVERSION. 41 15 1. a. Except as provided in paragraph "b", and 41 16 notwithstanding section 8.33, moneys appropriated for the 41 17 fiscal year beginning July 1, 2018, in this division of this 41 18 Act that remain unencumbered or unobligated at the close of the 41 19 fiscal year shall not revert but instead shall remain available 41 20 to be used for the purposes designated until the close of the 41 21 succeeding fiscal year, or until the project for which the 41 22 appropriation was made is completed, whichever is earlier. 41 23 b. Notwithstanding section 8.33, moneys appropriated for 41 24 the fiscal year beginning July 1, 2018, in this division of 41 25 this Act to the department of agriculture and land stewardship 41 26 to provide financial assistance for the establishment of 41 27 permanent soil and water conservation practices that remain 41 28 unencumbered or unobligated at the close of the fiscal year 41 29 shall not revert but instead shall remain available for 41 30 expenditure for the purposes designated until the close of the 41 31 fiscal year beginning July 1, 2021. 41 32 2. Subsection 1 does not apply to moneys transferred 41 33 pursuant to this division to the hungry canyons account of 41 34 the loess hills development and conservation fund created in 41 35 section 161D.2 which shall not revert as provided in that 42 1 section. 42 2 DIVISION XVI 42 3 ENVIRONMENT FIRST FUND 42 4 SPECIAL APPROPRIATION FOR FY 2018=2019 42 5 Sec. 55. WATER QUALITY INITIATIVE ==== DEPARTMENT OF 42 6 AGRICULTURE AND LAND STEWARDSHIP. 42 7 1. There is appropriated from the environment first fund 42 8 created in section 8.57A to the department of agriculture 42 9 and land stewardship for the fiscal year beginning July 1, 42 10 2018, and ending June 30, 2019, the following amount, or so 42 11 much thereof as is necessary, to be used for the purposes 42 12 designated: 42 13 For deposit in the water quality initiative fund created in 42 14 section 466B.45, for purposes of supporting the water quality 42 15 initiative administered by the division of soil conservation 42 16 and water quality as provided in section 466B.42, including 42 17 salaries, support, maintenance, and miscellaneous purposes: 42 18 .................................................. $ 1,187,500 42 19 2. a. The moneys appropriated in subsection 1 shall be 42 20 used to support projects in subwatersheds as designated by the 42 21 division that are part of high=priority watersheds identified 42 22 by the water resources coordinating council established 42 23 pursuant to section 466B.3. 42 24 b. The moneys appropriated in subsection 1 shall be used to 42 25 support projects in watersheds generally, including regional 42 26 watersheds, as designated by the division and high=priority 42 27 watersheds identified by the water resources coordinating 42 28 council established pursuant to section 466B.3. 42 29 3. In supporting projects in subwatersheds and watersheds 42 30 as provided in subsection 2, all of the following shall apply: 42 31 a. The demonstration projects shall utilize water quality 42 32 practices as described in the latest revision of the document 42 33 entitled "Iowa Nutrient Reduction Strategy" initially presented 42 34 in November 2012 by the department of agriculture and land 42 35 stewardship, the department of natural resources, and Iowa 43 1 state university of science and technology. 43 2 b. The division shall implement demonstration projects as 43 3 provided in paragraph "a" by providing for participation by 43 4 persons who hold a legal interest in agricultural land used in 43 5 farming. To every extent practical, the division shall provide 43 6 for collaborative participation by such persons who hold a 43 7 legal interest in agricultural land located within the same 43 8 subwatershed. 43 9 c. The division shall implement a demonstration project on 43 10 a cost=share basis as determined by the division. However, the 43 11 state's share of the amount shall not exceed 50 percent of the 43 12 estimated cost of establishing the practice as determined by 43 13 the division or 50 percent of the actual cost of establishing 43 14 the practice, whichever is less. 43 15 d. The demonstration projects shall be used to educate other 43 16 persons about the feasibility and value of establishing similar 43 17 water quality practices. The division shall promote field day 43 18 events for purposes of allowing interested persons to establish 43 19 water quality practices on their agricultural land. 43 20 e. The division shall conduct water quality evaluations 43 21 within supported subwatersheds. Within a reasonable period 43 22 after accumulating information from such evaluations, the 43 23 division shall create an aggregated database of water quality 43 24 practices. Any information identifying a person holding a 43 25 legal interest in agricultural land or specific agricultural 43 26 land shall be a confidential record under section 22.7. 43 27 4. The moneys appropriated in subsection 1 shall be used 43 28 to support education and outreach in a manner that encourages 43 29 persons who hold a legal interest in agricultural land used for 43 30 farming to implement water quality practices, including the 43 31 establishment of such practices in watersheds generally, and 43 32 not limited to subwatersheds or high=priority watersheds. 43 33 5. The moneys appropriated in subsection 1 may be used 43 34 to contract with persons to coordinate the implementation of 43 35 efforts provided in this section. 44 1 6. The moneys appropriated in subsection 1 may be used by 44 2 the department to support urban soil and water conservation 44 3 efforts, which may include but are not limited to management 44 4 practices related to bioretention, landscaping, the use of 44 5 permeable or pervious pavement, and soil quality restoration. 44 6 The moneys shall be allocated on a cost=share basis as provided 44 7 in chapter 161A. 44 8 7. Notwithstanding any other provision of law to the 44 9 contrary, the department may use moneys appropriated in 44 10 subsection 1 to carry out the provisions of this section on a 44 11 cost=share basis in combination with other moneys available to 44 12 the department from a state or federal source. 44 13 8. Not more than 10 percent of the moneys appropriated in 44 14 this section may be used to pay for the costs of administering 44 15 and implementing the water quality initiative by the 44 16 department's division of soil conservation and water quality as 44 17 provided in section 466B.42 and this section. 44 18 EXPLANATION 44 19 The inclusion of this explanation does not constitute agreement with 44 20 the explanation's substance by the members of the general assembly. 44 21 GENERAL. This bill relates to agriculture and natural 44 22 resources by making appropriations for the fiscal years 44 23 2017=2018 and 2018=2019 to support related entities, including 44 24 the department of agriculture and land stewardship (DALS), 44 25 the department of natural resources (DNR), and Iowa state 44 26 university (ISU). 44 27 The bill primarily appropriates moneys to DALS and DNR. 44 28 The appropriations are made to support those departments for 44 29 administration, regulation, and support of programs. The bill 44 30 requires the departments to submit quarterly reports to the 44 31 general assembly and department of management regarding the 44 32 expenditure of appropriated moneys. The bill also provides 44 33 moneys to support specific programs or projects administered by 44 34 those departments. The bill appropriates moneys from a number 44 35 of sources, including the general fund of the state (general 45 1 fund), the state fish and game protection fund, the groundwater 45 2 protection fund (Code section 455E.11), and the environment 45 3 first fund (EFF) (Code section 8.57A). Special appropriations 45 4 are made from the open spaces account of the Iowa resources 45 5 enhancement and protection fund (REAP) (Code sections 455A.18 45 6 and 455A.19). Appropriations are made from a number of sources 45 7 to support the water quality initiative (WQI) (Code chapter 45 8 466B). The 45 10 bill appropriates moneys to DALS from the general fund for FY 45 11 2017=2018 in order to support its administrative divisions, 45 12 including consumer protection and industry services, soil 45 13 conservation, and food safety and animal health. Moneys are 45 14 transferred to ISU to support its midwest grape and wine 45 15 institute. 45 16 DALS ==== MISCELLANEOUS FUNDS == DESIGNATED APPROPRIATIONS 45 17 ==== FY 2017=2018. The reversion of the appropriated 47 4 moneys is delayed. 47 5 EFF ==== SPECIAL APPROPRIATIONS FOR WQI AND REAP ==== FY 47 6 2018=2019. Moneys are appropriated to the water quality 47 7 initiative fund subject to the same conditions applicable to 47 8 moneys appropriated to the fund from the general fund. Moneys 47 9 are appropriated to support REAP from the EFF in lieu of the 47 10 general fund. 47 11 DALS ==== WATERSHED IMPROVEMENT FUND ==== ADMINISTRATION 47 12 AND RELATED STATUTORY CHANGES TO ELIMINATE THE WATERSHED 47 13 IMPROVEMENT REVIEW BOARD. The bill eliminates powers, duties, 47 14 and funding for the watershed improvement review board. DALS 47 15 is required to manage the watershed improvement fund and make 47 16 necessary payments to satisfy outstanding obligations incurred 47 17 by the board prior to December 31, 2017. Any unobligated and 47 18 unencumbered moneys remaining in the fund are appropriated to 47 19 DALS to support soil conservation efforts. 47 20 DNR ==== OPEN SPACES ACCOUNT OF REAP ==== PARK MAINTENANCE AND 47 21 REPAIR ==== FY 2017=2018. A portion of moneys allocated to 47 22 REAP's open spaces account are to be used by DNR for state park 47 23 maintenance and repair. 47 24 DALS ==== GENERAL FUND ==== LIVESTOCK HEALTH AND RELATED 47 25 STATUTORY CHANGES ==== FY 2017=2018. The bill appropriates 47 26 moneys to DALS for purposes of developing a foreign animal 47 27 disease preparedness and response strategy and for the possible 47 28 implementation of that strategy. The bill makes a number of 47 29 statutory changes including the establishment of a foreign 47 30 animal disease preparedness and response fund. 47 31 ISU ==== ELIMINATION OF LEOPOLD CENTER FOR SUSTAINABLE 47 32 AGRICULTURE FY 2017=2018. The bill eliminates ISU's Leopold 47 33 center for sustainable agriculture. ISU's college of 47 34 agriculture and life sciences is to oversee the process 47 35 of winding up the center's affairs. Remaining moneys are 48 1 appropriated to the Iowa nutrient research fund (Code section 48 2 466B.46).
