  1  1    Section 1.  NEW SECTION.  455A.14  Camping and rental
  1  2 facilities and other privileges ==== fees.
  1  3    1.  Notwithstanding any provision of law to the contrary,
  1  4 the department of natural resources is authorized to establish
  1  5 fees for camping and use of rental facilities and other special
  1  6 privileges at state parks and recreation areas under the
  1  7 jurisdiction of the department.
  1  8    2.  The fees established by the department pursuant to this
  1  9 section shall be in such amounts as may be determined by the
  1 10 department based on the cost of providing the privileges and
  1 11 the reasonable value of such privileges.  Such fees may be
  1 12 increased, reduced, or waived by the department for special
  1 13 promotional events or efforts or on the basis of special
  1 14 seasonal or holiday rates, on a statewide basis or on the basis
  1 15 of an individual state park or recreation area.
  1 16    3.  Fees established pursuant to this section shall be
  1 17 considered a specification of prices to be charged for goods or
  1 18 services as provided in section 17A.2, subsection 11, paragraph
  1 19 "g".
  1 20    4.  The department shall adopt rules pursuant to chapter 17A
  1 21 for the purpose of setting forth the methodology to be used in
  1 22 establishing fees pursuant to this section.
  1 23    Sec. 2.  REPEAL.  Sections 455A.12 and 461A.47, Code 2017,
  1 24 are repealed.
  1 25                           EXPLANATION
  1 26 The inclusion of this explanation does not constitute agreement with
  1 27 the explanation's substance by the members of the general assembly.
  1 28    This bill provides that, notwithstanding any provision of
  1 29 law to the contrary, the department of natural resources is
  1 30 authorized to establish fees for camping and use of rental
  1 31 facilities and other special privileges at state parks and
  1 32 recreation areas under the jurisdiction of the department.
  1 33 Currently, the natural resource commission is authorized to
  1 34 establish such fees under Code section 461A.47, which is
  1 35 repealed by the bill.
  2  1 The bill also provides that fees established by the
  2  2 department pursuant to the bill's provisions shall be in such
  2  3 amounts as may be determined by the department based on the
  2  4 cost of providing the privileges and the reasonable value
  2  5 of such privileges.  Such fees may be increased, reduced,
  2  6 or waived by the department for special promotional events
  2  7 or efforts or on the basis of special seasonal or holiday
  2  8 rates, on a statewide basis or on the basis of an individual
  2  9 state park or recreation area.  The bill provides that fees
  2 10 established pursuant to the bill are considered a specification
  2 11 of the prices to be charged for goods or services sold by
  2 12 an agency and are not considered rules for purposes of Code
  2 13 chapter 17A.  The department is required to adopt rules that
  2 14 set forth the methodology to be used in establishing the fees.
  2 15    Code section 455A.12 relating to the sale of gift
  2 16 certificates by the department for free camping and other
  2 17 special privileges at state parks and recreation areas is
  2 18 repealed.
