The
terms
of
a
software
licensing
contract
entered
into

by
a
state
agency
for
a
software
application
designed
to
be

installed
and
run
on
generally
available
desktop
or
server

hardware
shall
not
limit
the
ability
of
the
state
agency
to

install
or
run
the
software
application
on
the
desktop
or
7
server
hardware
selected
by
the
state
agency.

2.
This
section
applies
to
software
licensing
contracts
and
9
software
licensing
addendums
entered
into
by
a
state
agency
on
10
or
after
July
1,
2023.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
a
software
licensing
contract
entered
15
into
by
a
state
agency
for
a
software
application
designed
16
to
be
installed
and
run
on
generally
available
desktop
or
17
server
hardware
from
limiting
the
ability
of
such
state
agency
18
to
install
or
run
the
software
application
on
the
desktop
or
19
server
hardware
selected
by
the
state
agency.

The
bill
applies
to
software
licensing
contracts
and
21
software
licensing
addendums
entered
into
by
a
state
agency
on
22
or
after
July
1,
2023.
