H.F. 507 Section 1. PUBLIC HEALTH AND SAFETY —— PROHIBITIONS ON 1 CERTAIN MANDATES AND REQUIREMENTS. 2 1. The United States centers for disease control and 3 prevention or any other federal agency, department, or 4 official, and the world health organization or any other 5 similar multinational entity asserting authority under 6 color of law or pursuant to any alleged treaty shall have 7 no jurisdiction in Iowa, and any requirements, mandates, 8 recommendations, instructions, or guidance provided by these 9 entities shall not be used in this state to justify any mask, 10 vaccine, or medical testing requirements and shall have no 11 force or effect in Iowa. 12 2. Notwithstanding any other provision to the contrary, the 13 department of health and human services shall not do any of the 14 following: 15 a. Require a person to enroll in the statewide immunization 16 registry or otherwise submit to any form of immunization 17 tracking. 18 b. Include a person’s immunization record in any interstate 19 or federal immunization tracking system. 20 c. For the purpose of including a person’s immunization 21 record in any interstate or federal immunization tracking 22 system, allow any person, not otherwise authorized by law, to 23 have access to another person’s immunization record without 24 first obtaining written informed consent for release of the 25 record from the person who is the subject of the record or, if 26 that person is a minor, the minor’s parent or guardian. 27 3. The general assembly having found that the general 28 assembly has validly reserved its powers concerning the issues 29 specified in this section under the tenth amendment to the 30 Constitution of the United States and the Constitution of the 31 State of Iowa, the attorney general is authorized and directed 32 to request orders, injunctions, and such other writs as are 33 necessary to compel compliance with this section. 34 Sec. 2. H.F. 507 importance, takes effect upon enactment. 1 EXPLANATION 2 The inclusion of this explanation does not constitute agreement with 3 the explanation’s substance by the members of the general assembly. 4 This bill relates to public health and safety including 5 provisions relating to mask, vaccine, or medical testing 6 requirements and those relating to immunizations. 7 The bill provides that the United States centers for disease 8 control and prevention or any other federal agency, department, 9 or official, and the world health organization or any similar 10 multinational entity shall have no jurisdiction in Iowa, and 11 any requirements, mandates, recommendations, instructions, 12 or guidance provided by these entities shall not be used in 13 this state to justify any mask, vaccine, or medical testing 14 requirements and shall have no force or effect in Iowa. 15 The bill prohibits the department of health and human 16 services from requiring a person to enroll in the statewide 17 immunization registry or otherwise submit to any form of 18 immunization tracking; from including a person’s immunization 19 record in any interstate or federal immunization tracking 20 system; and for the purpose of including a person’s 21 immunization record in any interstate or federal immunization 22 tracking system, from allowing any person, not otherwise 23 authorized by law, to have access to another person’s 24 immunization record without first obtaining written informed 25 consent for release of the record from the person who is the 26 subject of the record or, if that person is a minor, the 27 minor’s parent or guardian. 28 The bill also authorizes and directs the attorney general to 29 request orders, injunctions, and other writs as are necessary 30 to compel compliance with the bill. 31 The bill takes effect upon enactment. 32 -2- LSB 2255YH (5) 90 pf/rh 2/ 2
