Section 321.384, Code 2017, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 3. Notwithstanding subsection 1, a 1 4 motor vehicle operating upon a highway within the state that 1 5 is equipped with automatic headlamps or headlamps lighted 1 6 by default shall at all times display lighted headlamps as 1 7 provided in section 321.415. 1 8 EXPLANATION 1 9 The inclusion of this explanation does not constitute agreement with 1 10 the explanation's substance by the members of the general assembly. 1 11 Under current law, motor vehicles operating on a highway are 1 12 required to display lighted headlamps at any time from sunset 1 13 to sunrise, and at such other times when conditions such as 1 14 fog, snow, sleet, or rain provide insufficient lighting to 1 15 render clearly discernible persons and vehicles on the highway 1 16 at a distance of 500 feet ahead. 1 17 This bill requires motor vehicles operating on a highway 1 18 that are equipped with automatic headlamps or headlamps lighted 1 19 by default to display lighted headlamps at all times. By 1 20 operation of law, a violation of this provision is punishable 1 21 by a scheduled fine of $30. LSB 2136YH (2) 87 ns/nh
