Centralized
state
school

bus
purchasing
program.

1.
The
department
shall
develop
procedures
and
3
specifications
for
the
solicitation
of
bids
for
the
purchase
of
4
school
buses,
in
consultation
with
the
department
of
education,
5
school
districts,
and
nonpublic
schools.
In
soliciting
bids,
6
the
department
shall
conform
to
all
applicable
state
and
7
federal
laws,
rules,
and
regulations
regarding
standards
for
8
school
buses.

2.
As
a
condition
of
participating
in
the
state
school
bus
10
purchasing
program,
each
bidder
shall
agree
that
if
the
bidder
11
subsequently
offers
a
substantially
similar
bid
to
another
12
purchaser
for
a
lower
price,
the
bidder’s
contract
price
with
13
the
state
shall
be
automatically
reduced
to
match
the
lower
14
price.

As
a
condition
of
participating
in
the
state
school
16
bus
purchasing
program,
each
bidder
shall
agree
to
include
an
17
option
for
school
districts
to
trade
in
school
buses
currently
18
in
use.

The
department
may
award
a
contract
for
purchase
to
20
any
bidder
or
bidders
responsive
to
the
needs
of
at
least
21
one
school
district
or
nonpublic
school
participating
in
the
22
program.

5.
Participation
in
the
state
school
bus
purchasing
program

by
school
districts
and
nonpublic
schools
is
voluntary.
A
25
school
district
or
nonpublic
school
may
accept
any
bid
for
26
which
the
department
awards
a
contract
for
purchase.
A
school
27
district
or
nonpublic
school
participating
in
the
program
shall
28
conform
to
all
applicable
local,
state,
and
federal
laws,
29
rules,
and
regulations
regarding
standards
for
school
buses.

A
school
district
or
nonpublic
school
may
participate
in
the
31
program
in
lieu
of
following
the
procedures
for
the
purchase
of

school
buses
prescribed
by
chapter
285.

The
department,
in
conjunction
with
the
department
of

education,
shall
adopt
rules
to
administer
this
section.

subsection
7,
paragraph
b,
Code

2013,
is
amended
to
read
as
follows:

b.
By
purchasing
buses
and
entering
into
contracts
to
pay
3
for
such
buses
in
accordance
with
section
8A.319
or
over
a
4
five-year
period
as
follows:
one-fourth
of
the
cost
when
the
5
bus
is
delivered
and
the
balance
in
equal
annual
installments,
6
plus
simple
interest
due.
The
interest
rate
shall
be
the
7
lowest
rate
available
and
shall
not
exceed
the
rate
in
effect
8
under
section
74A.2
.
The
bus
shall
serve
as
security
for
9
balance
due.
Competitive
bids
on
comparable
equipment
shall
be
10
requested
on
all
school
bus
purchases
and
shall
be
based
upon
11
minimum
construction
standards
established
by
the
department
of
12
education.
Bids
shall
be
requested
unless
the
bus
is
a
used
or
13
demonstrator
bus.

EXPLANATION

This
bill
establishes
a
centralized
state
school
bus
16
purchasing
program
administered
by
the
department
of
17
administrative
services.
The
bill
directs
the
department
18
of
administrative
services
to
develop
procedures
and
19
specifications
for
the
solicitation
of
bids
for
the
purchase
of
20
school
buses,
in
consultation
with
the
department
of
education,
21
school
districts,
and
nonpublic
schools.
In

bids,

the
department
must
