Automated
or
remote

systems
for
traffic
law
enforcement
——
use
of
moneys
from

citations.

1.
Moneys
received
by
the
state
or
a
local
authority
from
4
citations
issued
using
an
automated
or
remote
system
for
5
traffic
law
enforcement
that
exceed
the
amount
necessary
to
6
operate,
use,
maintain,
and
administer
such
system
shall
be
7
transferred
monthly
to
the
treasurer
of
state
and
deposited
in
8
the
road
use
tax
fund
created
in
section
312.1.

2.
Each
month,
the
applicable
state
entity
or
local
10
authority
that
received
moneys
from
citations
issued
using
11
an
automated
or
remote
system
for
traffic
law
enforcement
12
shall
submit
a
report
to
the
department
containing
a
full
and
13
complete
statement
of
all
moneys
received
by
and
expenses
paid
14
relating
to
the
automated
or
remote
system
for
traffic
law
15
enforcement
during
the
preceding
calendar
month.

For
purposes
of
this
section,
“automated
or
remote
system
17
for
traffic
law
enforcement”
means
a
camera
or
other
optical
18
device
designed
to
work
in
conjunction
with
an
official
traffic
19
control
signal
or
speed
measuring
device
to
identify
motor
20
vehicles
operating
in
violation
of
traffic
laws,
the
use
of
21
which
results
in
the
issuance
of
citations
sent
through
the
22
mail
or
by
electronic
means.

EXPLANATION
24
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
state
and
local
authorities
to
27
deposit
moneys
received
from
citations
issued
using
an
28
automated
or
remote
system
for
traffic
law
enforcement
(ATE
29
system)
into
the
road
use
tax
fund.
However,
such
entities
30
may
retain
moneys
necessary
to
operate,
use,
maintain,
and
31
administer
an
ATE
system.
The
bill
requires
such
entities
32
that
received
moneys
from
such
citations
to
submit
a
report
33
to
the
department
of
transportation
containing
a
statement
of
34
all
moneys
received
by
and
expenses
paid
relating
to
the
ATE
