  1  1    Section 1.  Section 257.11, subsection 5, Code 2017, is
  1  2 amended to read as follows:
  1  3    5.  Shared operational functions == increased student
  1  4 opportunities == budget years beginning in 2014 through 2019.
  1  5    a.  (1)  In order to provide additional funding to increase
  1  6 student opportunities and redirect more resources to student
  1  7 programming for school districts that share operational
  1  8 functions, a district that shares with a political subdivision
  1  9 one or more operational functions of a curriculum director,
  1 10 principal, or school counselor, or one or more operational
  1 11 functions in the areas of superintendent management, business
  1 12 management, human resources, transportation, or operation
  1 13 and maintenance for at least twenty percent of the school
  1 14 year shall be assigned a supplementary weighting for each
  1 15 shared operational function. A school district that shares an
  1 16 operational function in the area of superintendent management
  1 17 shall be assigned a supplementary weighting of eight pupils for
  1 18 the function. A school district that shares the operational
  1 19 functions of a principal or an operational function in the area
  1 20 of business management, human resources, transportation, or
  1 21 operation and maintenance shall be assigned a supplementary
  1 22 weighting of five pupils for the function. A school district
  1 23 that shares the operational functions of a curriculum director
  1 24 or a school counselor shall be assigned a supplementary
  1 25 weighting of three pupils for the function. The additional
  1 26 weighting shall be assigned for each discrete operational
  1 27 function shared. However, a school district may receive the
  1 28 additional weighting under this subsection for sharing the
  1 29 services of an individual with a political subdivision even if
  1 30 the type of operational function performed by the individual
  1 31 for the school district and the type of operational function
  1 32 performed by the individual for the political subdivision are
  1 33 not the same operational function, so long as both operational
  1 34 functions are eligible for weighting under this subsection. In
  1 35 such case, the school district shall be assigned the additional
  2  1 weighting for the type of operational function that the
  2  2 individual performs for the school district, and the school
  2  3 district shall not receive additional weighting for any other
  2  4 function performed by the individual. The operational function
  2  5 sharing arrangement does not need to be a newly implemented
  2  6 sharing arrangement to receive supplementary weighting under
  2  7 this subsection.
  2  8    (2)  For the purposes of this section, "political
  2  9 subdivision" means a city, township, county, school corporation,
  2 10 merged area, area education agency, institution governed by the
  2 11 state board of regents, or any other governmental subdivision.
  2 12    b.  School districts that share operational functions with
  2 13 other school districts are not required to be contiguous school
  2 14 districts. If two or more districts sharing operational
  2 15 functions are not contiguous to each other, the districts
  2 16 separating those districts are not required to be a party to
  2 17 the operational functions sharing arrangement.
  2 18    c.  Supplementary weighting pursuant to this subsection
  2 19 shall be available to a school district for a maximum of
  2 20 five years during the period commencing with the budget year
  2 21 beginning July 1, 2014, through the budget year beginning
  2 22 July 1, 2019 and succeeding budget years. The maximum amount
  2 23 of additional weighting for which a school district shall be
  2 24 eligible in a budget year is twenty=one additional pupils.
  2 25 Criteria for determining the qualification of operational
  2 26 functions for supplementary weighting shall be determined by
  2 27 the department by rule, through consideration of increased
  2 28 student opportunities.
  2 29    d.  Supplementary weighting pursuant to this subsection
  2 30 shall be available to an area education agency for a maximum of
  2 31 five years during the period commencing with the budget year
  2 32 beginning July 1, 2014, through the budget year beginning July
  2 33 1, 2019 and succeeding budget years. The minimum amount of
  2 34 additional funding for which an area education agency shall
  2 35 be eligible in a budget year is thirty thousand dollars, and
  3  1 the maximum amount of additional funding for which an area
  3  2 education agency shall be eligible is two hundred thousand
  3  3 dollars. The department of management shall annually set
  3  4 a weighting for each area education agency to generate the
  3  5 approved operational sharing expense using the area education
  3  6 agency's special education cost per pupil amount and foundation
  3  7 level. Criteria for determining the qualification of
  3  8 operational functions for supplementary weighting shall be
  3  9 determined by the department by rule, through consideration of
  3 10 increased student opportunities.
  3 11    e.  This subsection is repealed effective July 1, 2020.
  3 12    Sec. 2.  APPLICABILITY.  This Act applies to school budget
  3 13 years beginning on or after January 1, 2018.
  3 14                           EXPLANATION
  3 15 The inclusion of this explanation does not constitute agreement with
  3 16 the explanation's substance by the members of the general assembly.
  3 17    Code section 257.11(5) provides supplementary weighting
  3 18 for school districts and area education agencies that share
  3 19 operational functions. A district that shares with a political
  3 20 subdivision one or more operational functions of a curriculum
  3 21 director or school counselor, or one or more operational
  3 22 functions in the areas of superintendent management, business
  3 23 management, human resources, transportation, or operation and
  3 24 maintenance for at least 20 percent of the school year is
  3 25 assigned a supplementary weighting for each shared operational
  3 26 function. Supplementary weighting under this provision is
  3 27 available for a maximum of five school budget years beginning
  3 28 July 1, 2014, through the budget year beginning July 1, 2019.
  3 29    This bill adds the position of principal to the category of
  3 30 operational functions that receives supplementary weighting of
  3 31 five pupils. The bill also strikes the provisions limiting the
  3 32 number of years for which the supplemental weighting may be
  3 33 claimed and the provisions establishing the period of school
  3 34 budget years during which the supplementary weighting may be
  3 35 claimed.
  4  1 The bill applies to school budget years beginning on or after
  4  2 July 1, 2018.
