SMITH, and NIELSEN A BILL FOR 1 An Act relating to policies at public institutions of higher 2 education granting resident status for purposes of paying 3 postsecondary tuition and fees. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1793YH (3) 87 kh/nh PAG LIN 1 1 Section 1. Section 260C.14, Code 2017, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 25. Adopt a policy, to take effect 1 4 not later than January 1, 2018, relating to an additional 1 5 classification of students for purposes of determining tuition 1 6 and fees, to grant resident status to individuals who meet all 1 7 of the following conditions: 1 8 a. Attended an accredited school in this state for at least 1 9 five years as of the date the individual graduated from an 1 10 accredited high school or received a high school equivalency 1 11 diploma in this state. 1 12 b. Is accepted for enrollment by the community college. 1 13 c. Was not required to pay tuition to attend a public high 1 14 school in this state. 1 15 d. Signs an affidavit, if the individual does not have a 1 16 social security number, stating that the individual will pursue 1 17 citizenship in the United States at the earliest possible time 1 18 the individual is able to do so. 1 19 Sec. 2. Section 262.9, Code 2017, is amended by adding the 1 20 following new subsection: 1 21 NEW SUBSECTION. 39. Adopt a policy, to take effect 1 22 not later than January 1, 2018, relating to an additional 1 23 classification of students for purposes of determining tuition 1 24 and fees, to grant resident status to individuals who meet all 1 25 of the following conditions: 1 26 a. Attended an accredited school in this state for at least 1 27 five years as of the date the individual graduated from an 1 28 accredited high school or received a high school equivalency 1 29 diploma in this state. 1 30 b. Is accepted for enrollment by a university under the 1 31 control of the board. 1 32 c. Was not required to pay tuition to attend a public high 1 33 school in this state. 1 34 d. Signs an affidavit, if the individual does not have a 1 35 social security number, stating that the individual will pursue 2 1 citizenship in the United States at the earliest possible time 2 2 the individual is able to do so. 2 3 EXPLANATION 2 4 The inclusion of this explanation does not constitute agreement with 2 5 the explanation's substance by the members of the general assembly. 2 6 This bill directs the board of directors of a community 2 7 college and the state board of regents to adopt policies 2 8 that take effect not later than January 1, 2018, relating 2 9 to an additional classification of students for purposes of 2 10 determining tuition and fees, to grant resident status to 2 11 certain individuals. 2 12 To meet the requirements of the policy, an individual 2 13 must have attended an accredited school in this state for 2 14 at least five years or received a high school equivalency 2 15 diploma in this state, be accepted for enrollment by a public 2 16 postsecondary institution in this state, must not have been 2 17 required to pay tuition to attend a public high school in this 2 18 state, and must sign an affidavit, if the individual does not 2 19 have a social security number, stating that the individual 2 20 will pursue U.S. citizenship at the earliest possible time the 2 21 individual is able to do so.
