TITLE OF ACT. This Act shall be known and may be 1 4 cited as the "Future Ready Iowa Act". 1 5 DIVISION II 1 6 ECONOMIC DEVELOPMENT AUTHORITY == FUTURE READY IOWA REGISTERED 1 7 APPRENTICESHIP DEVELOPMENT PROGRAM 1 8 Sec. 2. Section 15.106A, subsection 2, paragraph a, Code 1 9 2018, is amended to read as follows: 1 10 a. That through this section and section 15.106B, the 1 11 authority has been granted broad general powers and specific 1 12 program powers over all of the authority's statutory programs, 1 13 including but not limited to the programs created pursuant to 1 14 chapters 15, 15A, 15B, 15C, 15E, and 15J. 1 15 Sec. 3. Section 15B.4, Code 2018, is amended by adding the 1 16 following new subsection: 1 17 NEW SUBSECTION. 5. An apprenticeship sponsor receiving 1 18 financial assistance under this chapter is ineligible for 1 19 financial assistance under section 15C.1 during the same fiscal 1 20 year. 1 21 Sec. 4. NEW SECTION. 15C.1 Future ready Iowa registered 1 22 apprenticeship development program. 1 23 1. Definitions. For purposes of this section, unless the 1 24 context otherwise requires: 1 25 a. "Applicant" means a new or existing apprenticeship 1 26 sponsor located in Iowa that has established an apprenticeship 1 27 program involving an eligible apprenticeable occupation that is 1 28 located in Iowa and approved by the United States department of 1 29 labor, office of apprenticeship. 1 30 b. "Apprentice" means a person who is at least sixteen 1 31 years of age, except where a higher minimum age is required by 1 32 law, who is employed in an apprenticeable occupation, and is 1 33 registered in Iowa with the United States department of labor, 1 34 office of apprenticeship. 1 35 c. "Apprenticeable occupation" means an occupation approved 2 1 for apprenticeship by the United States department of labor, 2 2 office of apprenticeship. 2 3 d. "Apprenticeship program" means a program registered 2 4 with the United States department of labor, office of 2 5 apprenticeship, which includes terms and conditions for the 2 6 qualification, recruitment, selection, employment, and training 2 7 of apprentices, including the requirement for a written 2 8 apprenticeship agreement. 2 9 e. "Apprenticeship sponsor" means an entity operating 2 10 an apprenticeship program or an entity in whose name an 2 11 apprenticeship program is being operated, which is registered 2 12 with or approved by the United States department of labor, 2 13 office of apprenticeship. 2 14 f. "Authority" means the economic development authority 2 15 created in section 15.105. 2 16 g. "Eligible apprenticeable occupation" means an 2 17 apprenticeable occupation identified by the workforce 2 18 development board or a community college pursuant to 2 19 section 84A.1B, subsection 13A, as a high=demand job, after 2 20 consultation with the authority. 2 21 h. "Financial assistance" means assistance provided only 2 22 from the funds, rights, and assets legally available to the 2 23 authority and includes but is not limited to assistance in the 2 24 form of a reimbursement grant to support the costs associated 2 25 with establishing a new eligible apprenticeable occupation 2 26 or an additional eligible apprenticeable occupation in an 2 27 applicant's apprenticeship program. 2 28 2. Program created. Subject to an appropriation of funds 2 29 by the general assembly for this purpose, a future ready Iowa 2 30 registered apprenticeship development program is created which 2 31 shall be administered by the authority. The purpose of the 2 32 program is to provide financial assistance to incentivize 2 33 small and medium=sized apprenticeship sponsors to establish 2 34 new or additional eligible apprenticeable occupations in the 2 35 apprenticeship sponsor's apprenticeship program in order to 3 1 support the growth of apprenticeship programs and expand 3 2 high=quality work=based learning experiences in high=demand 3 3 fields and careers for persons who are employed in eligible 3 4 apprenticeable occupations in Iowa. 3 5 3. Application requirements == restriction. An 3 6 apprenticeship sponsor may apply to the authority, on 3 7 forms provided by the authority and in accordance with the 3 8 authority's instructions, to receive financial assistance under 3 9 the program. The authority shall provide upon request and on 3 10 the authority's internet site information about the program, 3 11 the application, application instructions, and the application 3 12 period established each year for funding available under the 3 13 program. The application shall include a description of how 3 14 the financial assistance awarded under this section would be 3 15 used to establish an apprenticeship program or add new or 3 16 additional apprenticeable occupations to the apprenticeship 3 17 sponsor's apprenticeship program and the anticipated program 3 18 expenses identified by the applicant. 3 19 a. An apprenticeship sponsor is eligible to apply for 3 20 financial assistance for a new or additional eligible 3 21 apprenticeable occupation, in addition to existing 3 22 apprenticeship occupations in the apprenticeship sponsor's 3 23 apprenticeship program, if all of the following conditions are 3 24 met: 3 25 (1) Twenty or fewer apprentices are registered in the 3 26 existing apprenticeship program as of December 31 of the 3 27 calendar year prior to the date the authority receives the 3 28 apprenticeship sponsor's application. 3 29 (2) More than seventy percent of the applicant's 3 30 apprentices shall be residents of Iowa, and the remainder 3 31 of the applicant's apprentices shall be residents of states 3 32 contiguous to Iowa. In determining the number of apprentices 3 33 in an applicant's apprenticeship program, the authority may 3 34 calculate the average number of apprentices in the program 3 35 within the most recent two=year period. 4 1 b. An apprenticeship sponsor receiving financial assistance 4 2 under chapter 15B is ineligible for financial assistance under 4 3 this section during the same fiscal year. 4 4 4. Rules. The authority shall adopt rules pursuant to 4 5 chapter 17A establishing a staff review and application 4 6 approval process, application scoring criteria, the minimum 4 7 score necessary for approval of financial assistance, 4 8 procedures for notification of an award of financial 4 9 assistance, the terms of agreement between the apprenticeship 4 10 sponsor and the authority, and any other rules deemed necessary 4 11 for the implementation and administration of this section. 4 12 5. Agreement. Prior to distributing financial assistance 4 13 under this section, the authority shall enter into an agreement 4 14 with the apprenticeship sponsor awarded financial assistance 4 15 in accordance with this section, and the financial assistance 4 16 recipient shall confirm the expenses for establishing the 4 17 program or adding the additional occupations as identified in 4 18 the approved application, and shall meet all terms established 4 19 by the authority for receipt of financial assistance under this 4 20 section. 4 21 6. Use of moneys appropriated == administration. 4 22 a. The annual administrative expenditures as a percent of 4 23 the moneys appropriated for a fiscal year for purposes of this 4 24 section shall not exceed two percent. 4 25 b. Notwithstanding section 8.33, moneys appropriated to 4 26 the authority by the general assembly for purposes of this 4 27 section that remain unencumbered or unobligated at the end of 4 28 the fiscal year shall not revert to the general fund but shall 4 29 remain available for expenditure for the purposes designated in 4 30 subsequent fiscal years. 4 31 DIVISION III 4 32 FUTURE READY IOWA == VARIOUS PROGRAMS 4 33 Sec. 5. Section 15H.1A, Code 2018, is amended by adding the 4 34 following new subsection: 4 35 NEW SUBSECTION. 1A. "Commission" means the Iowa commission 5 1 on volunteer service created in section 15H.2. 5 2 Sec. 6. NEW SECTION. 15H.9 Volunteer mentor program. 5 3 1. Subject to an appropriation of funds by the general 5 4 assembly for this purpose, the commission shall establish a 5 5 volunteer mentor program to support implementation of the 5 6 future ready Iowa skilled workforce last=dollar scholarship 5 7 and the future ready Iowa skilled workforce grant programs 5 8 created in sections 261.131 and 261.132. The commission, in 5 9 collaboration with the department of workforce development and 5 10 the college student aid commission, shall adopt rules pursuant 5 11 to chapter 17A to implement and administer the volunteer 5 12 mentor program, and shall establish standards, guidelines, and 5 13 expectations for a productive and appropriate relationship 5 14 between mentors and mentees, including helping students 5 15 meet the future ready Iowa skilled workforce last=dollar 5 16 scholarship program or future ready Iowa skilled workforce 5 17 grant requirements, as appropriate; identify work=based 5 18 learning opportunities; and make career=related connections 5 19 that are advantageous to persons participating in the volunteer 5 20 mentor program. 5 21 2. The prospective volunteer mentor shall have successfully 5 22 passed a background investigation conducted by the division of 5 23 criminal investigation of the department of public safety and a 5 24 check of the national sex offender registry. 5 25 3. The commission shall enter into written agreements with 5 26 prospective mentors and mentees under the program. Under such 5 27 an agreement, prospective mentors and mentees agree to abide by 5 28 the standards, guidelines, and expectations established by the 5 29 commission pursuant to subsection 1. 5 30 4. The commission, in collaboration with the department of 5 31 workforce development and the college student aid commission, 5 32 and in cooperation with an eligible institution as defined 5 33 in section 261.131 or 261.132, as appropriate, shall assign 5 34 a student, who is a recipient of a future ready Iowa skilled 5 35 workforce last=dollar scholarship under section 261.131 or 6 1 a future ready Iowa skilled workforce grant under section 6 2 261.132, who requests the assignment of a mentor, and who 6 3 enters into an agreement under subsection 3, to a mentor 6 4 appropriate to the prospective mentee's field of study whenever 6 5 possible. 6 6 5. The commission shall maintain, and regularly update, 6 7 a list of the mentor and mentee pairings and the dates of 6 8 inception of the mentor and mentee pairings. 6 9 6. Notwithstanding section 8.33, moneys appropriated to the 6 10 economic development authority for allocation to the commission 6 11 for purposes of this section that remain unencumbered or 6 12 unobligated at the close of a fiscal year shall not revert but 6 13 shall remain available to be used for the purposes designated 6 14 in this section until the close of the succeeding fiscal year. 6 15 Sec. 7. Section 84A.1B, Code 2018, is amended by adding the 6 16 following new subsections: 6 17 NEW SUBSECTION. 13A. Create, and update as necessary, a 6 18 list of high=demand jobs statewide for purposes of the future 6 19 ready Iowa registered apprenticeship development program 6 20 created in section 15C.1, the summer youth intern pilot 6 21 program established under section 84A.12, the Iowa employer 6 22 innovation program established under section 84A.13, the 6 23 future ready Iowa skilled workforce last=dollar scholarship 6 24 program established under section 261.131, the future ready 6 25 Iowa skilled workforce grant program established under section 6 26 261.132, and postsecondary summer classes for high school 6 27 students as provided under section 261E.8, subsection 7A. In 6 28 addition to the list created by the workforce development 6 29 board under this subsection, each community college, in 6 30 consultation with regional career and technical education 6 31 planning partnerships, and with the approval of the board of 6 32 directors of the community college, may identify and maintain 6 33 a list of not more than five regional high=demand jobs in the 6 34 community college region, and shall share the lists with the 6 35 workforce development board. The lists submitted by community 7 1 colleges under the subsection may be used in that community 7 2 college region for purposes of programs identified under this 7 3 subsection. The workforce development board shall have full 7 4 discretion to select and prioritize statewide high=demand jobs 7 5 after consulting with business and education stakeholders, 7 6 as appropriate, and seeking public comment. For purposes of 7 7 this subsection, "high=demand job" means a job in the state for 7 8 which the board, or a community college in accordance with this 7 9 subsection, determines work opportunities are available and 7 10 qualified applicants are lacking. 7 11 NEW SUBSECTION. 13B. Compile an annual report, in an 7 12 aggregate form to protect the confidentiality of each eligible 7 13 program's participants, that includes the number of students 7 14 receiving scholarships under section 261.131, the number of 7 15 students receiving grants under section 261.132, the number 7 16 of scholarship and grant recipients completing a program 7 17 of study or major annually and in the prescribed timeframe 7 18 under sections 261.131 and 261.132, the number of eligible 7 19 institutions participating in the scholarship and grant 7 20 programs established under sections 261.131 and 261.132, the 7 21 number of written agreements entered into by the volunteer 7 22 mentor program under section 15H.9, statistics on employment 7 23 outcomes for future ready Iowa skilled workforce last=dollar 7 24 scholarship and future ready Iowa skilled workforce grant 7 25 program participants by industry, and other data as may be 7 26 deemed pertinent by the department or the college student aid 7 27 commission. The department shall submit the initial report by 7 28 January 15, 2021, and by January 15 annually thereafter, to the 7 29 governor and the general assembly. 7 30 Sec. 8. Section 84A.5, subsection 7, Code 2018, is amended 7 31 by adding the following new paragraph: 7 32 NEW PARAGRAPH. 0d. The Iowa employer innovation program 7 33 established under section 84A.13. 7 34 Sec. 9. Section 84A.6, subsection 4, Code 2018, is amended 7 35 by striking the subsection. 8 1 Sec. 10. NEW SECTION. 84A.12 Summer youth intern pilot 8 2 program. 8 3 1. A summer youth intern pilot program is established 8 4 within the department of workforce development to provide 8 5 youths who are at risk of not graduating from high school, 8 6 who are from low=income households, who are from communities 8 7 underrepresented in the Iowa workforce, or who otherwise face 8 8 barriers to success and upward mobility in the labor market, 8 9 with internship opportunities that allow these youths to 8 10 explore and prepare for high=demand careers, to gain work 8 11 experience, and to develop personal attributes necessary to 8 12 succeed in the workplace. 8 13 2. Subject to an appropriation of funds by the general 8 14 assembly for this purpose, the department of workforce 8 15 development shall award grants for summer youth intern 8 16 pilot projects on a competitive basis as provided in this 8 17 section. The department shall work with employers, nonprofit 8 18 organizations, and educational institutions to place youth in 8 19 internships primarily in high=demand career fields. 8 20 3. The department of workforce development shall annually 8 21 issue a request for proposals to the public, specifying the 8 22 expectations and requirements for summer youth intern pilot 8 23 project grant qualification, including but not limited to the 8 24 provision of facilities, programming, staffing, and outcomes. 8 25 4. The department of workforce development shall give 8 26 full and fair consideration to each proposal submitted under 8 27 subsection 3, and shall award grants after considering, at a 8 28 minimum, the following: 8 29 a. The bidder's history and experience in the community. 8 30 b. The capacity to serve a substantial number of youth. 8 31 c. The suitability of the available facilities. 8 32 d. The bidder's contacts and partnerships in the community 8 33 that can be leveraged to maximize opportunity for project 8 34 participants. 8 35 e. The capacity to provide employability skills, including 9 1 but not limited to training relating to soft skills, financial 9 2 literacy, and career development. 9 3 Sec. 11. NEW SECTION. 84A.13 Iowa employer innovation 9 4 program == fund. 9 5 1. For purposes of this section, "high=demand job" means 9 6 a job identified by the workforce development board or a 9 7 community college pursuant to section 84A.1B, subsection 13A, 9 8 as a high=demand job. 9 9 2. Subject to an appropriation of funds by the general 9 10 assembly for this purpose, the Iowa employer innovation program 9 11 is established in the department of workforce development. 9 12 The department shall administer the program in consultation 9 13 with the workforce development board. The purpose of the 9 14 Iowa employer innovation program is to expand opportunities 9 15 for credit and noncredit education and training leading to 9 16 high=demand jobs for the residents of Iowa and to encourage 9 17 Iowa employers, community leaders, and others to provide 9 18 leadership and support for regional workforce talent pools 9 19 throughout the state. 9 20 3. The department of workforce development shall adopt 9 21 rules under chapter 17A establishing a program application and 9 22 award process to match employer moneys and the criteria for 9 23 the allocation of moneys in the fund established pursuant to 9 24 subsection 4. An employer, employer consortium, community 9 25 organization, or other entity seeking matching moneys shall 9 26 submit an application and a proposal to the department. In 9 27 awarding matching moneys, the department shall take into 9 28 account various factors, including but not limited to all of 9 29 the following: 9 30 a. The range of high=demand jobs, innovative measures, and 9 31 geographic fairness and equity included in the proposal. 9 32 b. Whether the proposal increases the number of eligible 9 33 students receiving financial assistance under the future ready 9 34 Iowa skilled workforce last=dollar scholarship or future 9 35 ready Iowa skilled workforce grant programs established under 10 1 sections 261.131 and 261.132; or increases the donation of 10 2 books, transportation, child care, and other wrap=around 10 3 support to assist eligible students receiving financial 10 4 assistance under section 261.131 or 261.132. 10 5 c. Whether the proposal includes performance=based 10 6 bonuses paid when high school students earn national 10 7 industry=recognized credentials aligned with high=demand jobs 10 8 that meet regional workforce needs. 10 9 d. Whether the proposal expands internships leading to 10 10 high=demand jobs. 10 11 e. Whether the proposal offers innovative ways of expanding 10 12 opportunities for credit and noncredit education and training 10 13 leading to high=demand jobs. 10 14 f. Whether the proposal addresses areas of workforce need 10 15 throughout the region. 10 16 4. An Iowa employer innovation fund is created in the 10 17 state treasury as a separate fund under the control of the 10 18 department of workforce development, in consultation with the 10 19 workforce development board. The fund shall consist of any 10 20 moneys appropriated by the general assembly and any other 10 21 moneys available to and obtained or accepted by the department 10 22 from the federal government. The assets of the fund shall be 10 23 used by the department only for purposes of this section. All 10 24 moneys deposited or paid into the fund are appropriated and 10 25 made available to the board to be used for purposes of this 10 26 section. Notwithstanding section 8.33, any balance in the fund 10 27 on June 30 of each fiscal year shall not revert to the general 10 28 fund of the state, but shall be available for purposes of this 10 29 section in subsequent fiscal years. 10 30 Sec. 12. NEW SECTION. 261.131 Future ready Iowa skilled 10 31 workforce last=dollar scholarship program. 10 32 1. Definitions. As used in this section, unless the context 10 33 otherwise requires: 10 34 a. "Commission" means the college student aid commission. 10 35 b. "Credential" means a postsecondary certificate, diploma, 11 1 or degree, conferring no more than an associate degree, awarded 11 2 by an eligible institution and earned in a program of study 11 3 that leads to a high=demand job and is authorized for federal 11 4 student aid under Tit. IV of the federal Higher Education Act 11 5 of 1965, as amended. 11 6 c. "Eligible institution" means a community college as 11 7 defined in section 260C.2 or an accredited private institution 11 8 as defined in section 261.9, that meets all of the following 11 9 criteria: 11 10 (1) Applies to and is approved by the commission to 11 11 participate in the future ready Iowa skilled workforce 11 12 last=dollar scholarship program. 11 13 (2) Requires eligible students to complete and file 11 14 application forms required by the commission, apply for 11 15 all available state and federal financial aid, apply to the 11 16 eligible institution to participate in the program, attend 11 17 orientation in person or virtually, register for classes 11 18 with the assistance of an academic advisor, and participate 11 19 in academic and career advising sessions offered under the 11 20 program. 11 21 (3) Facilitates, in collaboration with the commission on 11 22 volunteer service created in section 15H.2, the assignment 11 23 of a volunteer mentor to each eligible student, based on the 11 24 eligible student's interest. The volunteer mentor shall have 11 25 successfully passed a background investigation and a check of 11 26 the national sex offender registry as required under section 11 27 15H.9, subsection 2, and both the eligible student and the 11 28 volunteer mentor shall have entered into a written agreement as 11 29 provided in section 15H.9, subsection 3. 11 30 (4) Facilitates connections through campus career centers 11 31 and services to internships and similar local, state, and 11 32 federal programs. 11 33 (5) Markets the eligible institution's future ready Iowa 11 34 program of study and optional incentives, which may include 11 35 but not be limited to credit for military experience, on the 12 1 eligible institution's internet site and to other relevant 12 2 agencies and organizations as recommended by the college 12 3 student aid commission, the commission on volunteer service, or 12 4 the department of workforce development. 12 5 (6) Submits annually information and data regarding the 12 6 eligible program operated by the eligible institution, the 12 7 students and volunteer mentors participating in the eligible 12 8 program, scholarship recipient eligible program completion 12 9 results, and statistics on employment outcomes for eligible 12 10 program participants by industry, to the commission in the 12 11 manner required by the commission. 12 12 d. "Eligible program" means a program of study or an 12 13 academic major jointly approved by the commission and the 12 14 department of workforce development, in consultation with an 12 15 eligible institution, that leads to a credential aligned with a 12 16 high=demand job designated by the workforce development board 12 17 or community college pursuant to section 84A.1B, subsection 12 18 13A. If the board or a community college removes a high=demand 12 19 job from a list created under section 84A.1B, subsection 13A, 12 20 an eligible student who received a scholarship for a program 12 21 based on that high=demand job shall continue to receive the 12 22 scholarship until achieving a postsecondary credential, up to 12 23 an associate degree, as long as the student continues to meet 12 24 all other eligibility requirements. 12 25 e. "Eligible student" means an Iowa resident who meets all 12 26 of the following requirements: 12 27 (1) Is either a new graduate of an Iowa high school who 12 28 enrolls full=time in an eligible program at an eligible 12 29 institution by the fall semester, or the equivalent, 12 30 following graduation from high school or completion of private 12 31 instruction under chapter 299A; or is an adult learner who has 12 32 received a high school diploma or a high school equivalency 12 33 diploma, who enrolls in an eligible program in an eligible 12 34 institution as a full=time or part=time student. 12 35 (2) Completes and submits application forms required by the 13 1 commission, including the free application for federal student 13 2 aid; applies for all available state and federal financial 13 3 aid; attends orientation in person or virtually; registers 13 4 for classes with the assistance of an academic advisor; 13 5 and participates in academic and career advising sessions 13 6 required under the eligible program. To receive a renewal of 13 7 a scholarship awarded under this section, an eligible student 13 8 must annually submit a new application to the commission for 13 9 reevaluation of eligibility. 13 10 (3) Is making satisfactory academic progress as defined by 13 11 the eligible institution. 13 12 (4) Remains continuously enrolled unless granted a leave of 13 13 absence by the eligible institution based on criteria adopted 13 14 by rule by the commission. 13 15 f. "Full=time" means enrollment in at least twelve semester 13 16 hours or the equivalent. 13 17 g. "Part=time" means enrollment in at least six but less 13 18 than twelve semester hours or the equivalent. 13 19 2. Allowable activities. An eligible student may work 13 20 with an assigned volunteer mentor to help the student meet the 13 21 requirements of this section or the requirements of an eligible 13 22 program, identify and participate in work=based learning 13 23 opportunities with the approval of the eligible institution, 13 24 and make other career=related connections. 13 25 3. Scholarship limitations == requirements. 13 26 a. For an eligible student who is attending an eligible 13 27 institution that is a community college during the fall, 13 28 spring, or summer term of enrollment, and is pursuing a 13 29 postsecondary credential up to an associate degree, the annual 13 30 amount of a future ready Iowa skilled workforce last=dollar 13 31 scholarship, when combined with other state and federal 13 32 nonrepayable student aid, shall not exceed an amount equivalent 13 33 to the tuition and any mandatory institution=wide fees charged 13 34 by the community college for the eligible program. For an 13 35 eligible student pursuing a postsecondary credential up to 14 1 an associate degree at an eligible institution that is an 14 2 accredited private institution during the fall, spring, or 14 3 summer term of enrollment, the annual amount of a future ready 14 4 Iowa skilled workforce last=dollar scholarship, when combined 14 5 with other state and federal nonrepayable student aid, shall 14 6 not exceed an amount equivalent to the average tuition rate 14 7 plus the average institution=wide mandatory fees charged during 14 8 the same term of enrollment by the eligible institutions that 14 9 are community colleges. 14 10 b. If an eligible student receives nonrepayable financial 14 11 aid under any other state or federal program, the full amount 14 12 of that aid shall be considered part of the student's available 14 13 financial resources before determining the amount of the 14 14 student's future ready Iowa skilled workforce last=dollar 14 15 scholarship for the same period during which the student 14 16 receives other state or federal financial aid. However, each 14 17 eligible student enrolled full=time in an eligible program 14 18 shall receive at least five hundred dollars annually, and the 14 19 amount received by each eligible part=time student shall be 14 20 the same amount prorated by the commission based on the number 14 21 of semester hours, or the equivalent, for which the part=time 14 22 student is enrolled. 14 23 c. A full=time eligible student may receive a future 14 24 ready Iowa skilled workforce last=dollar scholarship for 14 25 not more than five semesters, or the equivalent, or until 14 26 the eligible student earns the credential sought, up to an 14 27 associate degree, under the program, whichever occurs first. 14 28 A part=time eligible student may receive the scholarship for 14 29 not more than eight semesters, or the equivalent, on a prorated 14 30 basis, or until the eligible student earns the credential 14 31 sought, up to an associate degree, under the eligible program, 14 32 whichever occurs first. All classes identified by an eligible 14 33 institution as required for completion of the eligible program 14 34 by the eligible student shall be considered required under the 14 35 eligible program for purposes of this section. 15 1 d. A future ready Iowa skilled workforce last=dollar 15 2 scholarship shall be awarded on an annual basis, requiring 15 3 reapplication by an eligible student each year. Scholarship 15 4 payments shall be allocated equally among the semesters, or 15 5 the equivalent, and paid upon certification by the eligible 15 6 institution that the student meets the requirements of 15 7 subsection 1, paragraph "e". 15 8 e. If a scholarship recipient discontinues attendance before 15 9 the end of any semester, or the equivalent, after receiving 15 10 scholarship payments, the entire amount of any refund due 15 11 that recipient, up to the full amount of all of the annual 15 12 scholarship payments made, shall be paid by the eligible 15 13 institution to the commission. A scholarship recipient, 15 14 who is not approved for a leave of absence by the eligible 15 15 institution, who discontinues attendance before the end of a 15 16 semester, or the equivalent, is ineligible to receive future 15 17 scholarships under this section. 15 18 4. Commission's duties and responsibilities. Subject to an 15 19 appropriation of funds by the general assembly for purposes of 15 20 this section, the commission shall administer the future ready 15 21 Iowa skilled workforce last=dollar scholarship program and 15 22 shall do all of the following: 15 23 a. Provide application forms for distribution to students by 15 24 high schools and eligible institutions. 15 25 b. Adopt rules under chapter 17A, in collaboration with 15 26 the department of workforce development, for administration of 15 27 this section, including but not limited to establishing the 15 28 duties and responsibilities of eligible institutions under the 15 29 program; defining residence and satisfactory academic progress 15 30 for purposes of the program; and establishing procedures 15 31 for scholarship application, processing, and approval. The 15 32 rules shall provide for determining the priority awarding of 15 33 scholarships if funds available for purposes of this section 15 34 are insufficient to pay all eligible students. Priority shall 15 35 be given to fully awarding each eligible student approved for a 16 1 scholarship rather than to prorating scholarship awards among 16 2 all eligible students. 16 3 c. Approve and award future ready Iowa skilled workforce 16 4 last=dollar scholarships on an annual basis. 16 5 d. Transmit to the department of workforce development the 16 6 compilation of information, data, and statistics submitted in 16 7 accordance with subsection 1, paragraph "c", subparagraph (6), 16 8 for the annual report required under section 84A.1B. 16 9 5. Fund created. A future ready Iowa skilled workforce 16 10 last=dollar scholarship fund is created in the state treasury 16 11 as a separate fund under the control of the commission. All 16 12 moneys deposited or paid into the fund are appropriated and 16 13 made available to the commission to be used for scholarships 16 14 awarded as provided under this section. Notwithstanding 16 15 section 8.33, any balance in the fund on June 30 of each fiscal 16 16 year shall not revert to the general fund of the state, but 16 17 shall be available for purposes of this section in subsequent 16 18 fiscal years. 16 19 Sec. 13. NEW SECTION. 261.132 Future ready Iowa skilled 16 20 workforce grant program. 16 21 1. Definitions. As used in this section, unless the context 16 22 otherwise requires: 16 23 a. "Commission" means the college student aid commission. 16 24 b. "Eligible institution" means an institution of higher 16 25 learning governed by the state board of regents or an 16 26 accredited private institution as defined in section 261.9, 16 27 that meets all of the following criteria: 16 28 (1) Applies to and is approved by the commission to 16 29 participate in the future ready Iowa skilled workforce grant 16 30 program. 16 31 (2) Requires eligible students to complete and file 16 32 application forms required by the commission, apply for 16 33 all available state and federal financial aid, apply to the 16 34 eligible institution to participate in the program, attend 16 35 orientation in person or virtually, register for classes 17 1 with the assistance of an academic advisor, and participate 17 2 in academic and career advising sessions required under the 17 3 program. 17 4 (3) Certifies that prior to participating in the program 17 5 an eligible student has earned at least half of the credits 17 6 necessary for a bachelor's degree and is able to complete a 17 7 bachelor's degree in an eligible program of study or academic 17 8 major leading to a designated high=demand job in the prescribed 17 9 grant time frame. 17 10 (4) Facilitates the assignment of a volunteer mentor to each 17 11 eligible student based on the eligible student's interest. The 17 12 volunteer mentor shall have successfully passed a background 17 13 investigation and a check of the national sex offender 17 14 registry as required under section 15H.9, subsection 2, and 17 15 both the eligible student and the volunteer mentor shall have 17 16 entered into a written agreement as provided in section 15H.9, 17 17 subsection 3. 17 18 (5) Facilitates connections through campus career centers 17 19 and services to internships and similar local, state, and 17 20 federal programs. 17 21 (6) Markets the eligible institution's eligible program and 17 22 optional incentives, which may include but not be limited to 17 23 credit for military experience, on the eligible institution's 17 24 internet site and to other relevant agencies and organizations 17 25 as recommended by the college student aid commission, the 17 26 commission on volunteer service, or the department of workforce 17 27 development. 17 28 (7) Submits annually information and data regarding the 17 29 eligible program operated by the eligible institution, the 17 30 students and volunteer mentors participating in the eligible 17 31 program, and statistics on employment outcomes for eligible 17 32 program participants by industry, to the commission in the 17 33 manner required by the commission. 17 34 c. "Eligible program" means a program of study or an 17 35 academic major jointly approved by the commission and the 18 1 department of workforce development, in consultation with the 18 2 eligible institution, that leads to a bachelor's degree aligned 18 3 with a high=demand job designated by the workforce development 18 4 board pursuant to section 84A.1B, subsection 13A. If the 18 5 department removes a high=demand job from the list created 18 6 under section 84A.1B, subsection 13A, an eligible student 18 7 who received a grant for a program based on that high=demand 18 8 job shall continue to receive the grant until achieving a 18 9 bachelor's degree as long as the student continues to meet all 18 10 other eligibility requirements. 18 11 d. "Eligible student" means an Iowa resident who meets all 18 12 of the following requirements: 18 13 (1) Has earned at least half of the credits necessary for a 18 14 bachelor's degree and is able to complete a bachelor's degree 18 15 in an eligible program of study or academic major leading to a 18 16 designated high=demand job in the prescribed grant time frame. 18 17 (2) Completes and submits application forms required by the 18 18 commission, including the free application for federal student 18 19 aid; applies for all available state and federal financial 18 20 aid; attends orientation in person or virtually; registers 18 21 for classes with the assistance of an academic advisor; and 18 22 participates in academic and career advising sessions required 18 23 under the eligible program. To receive a renewal of a grant 18 24 awarded under this section, an eligible student must annually 18 25 submit a new application to the commission for reevaluation of 18 26 eligibility. 18 27 (3) Has not been enrolled in postsecondary education 18 28 during the twenty=four months preceding the date on which the 18 29 commission receives the individual's application to participate 18 30 in the program. 18 31 (4) Enrolls in at least six semester hours, or the 18 32 equivalent, in an eligible program. However, an eligible 18 33 student may enroll in fewer than six semester hours, or the 18 34 equivalent, if the eligible student needs fewer than six 18 35 semester hours of credit, or the equivalent, to achieve a 19 1 bachelor's degree under the eligible program. 19 2 (5) Is making satisfactory academic progress as defined by 19 3 the eligible institution. 19 4 (6) Remains continuously enrolled unless granted a leave of 19 5 absence by the eligible institution based on criteria adopted 19 6 by rule by the commission. 19 7 e. "Full=time" means enrollment in at least twelve semester 19 8 hours or the equivalent. 19 9 f. "Part=time" means enrollment in at least six but less 19 10 than twelve semester hours or the equivalent. 19 11 2. Allowable activities. An eligible student may work 19 12 with an assigned volunteer mentor to help the student meet the 19 13 requirements of this section or the requirements of an eligible 19 14 program, identify and participate in work=based learning 19 15 opportunities with the approval of the eligible institution, 19 16 and make other career=related connections. 19 17 3. Grant limitations == requirements. 19 18 a. A full=time eligible student may receive a future ready 19 19 Iowa skilled workforce grant annually for not more than four 19 20 semesters, or the equivalent, or until the eligible student 19 21 earns a bachelor's degree under the program, whichever occurs 19 22 first. A part=time eligible student may receive the grant for 19 23 not more than eight semesters, or the equivalent, on a prorated 19 24 basis, or until the eligible student earns a bachelor's degree 19 25 under the eligible program, whichever occurs first. 19 26 b. The amount of a future ready Iowa skilled workforce grant 19 27 to a full=time eligible student shall be at least one thousand 19 28 dollars annually. The amount of a future ready Iowa skilled 19 29 workforce grant to a part=time eligible student shall be equal 19 30 to the amount that would be awarded to a full=time student 19 31 except that the commission shall prorate the amount based on 19 32 the recipient student's semester hour or equivalent enrollment. 19 33 c. A future ready Iowa skilled workforce grant shall be 19 34 awarded on an annual basis, requiring reapplication by an 19 35 eligible student each year. Payments under the grant shall be 20 1 allocated equally among the semesters, or the equivalent, and 20 2 paid upon certification by the eligible institution that the 20 3 student meets the requirements of subsection 1, paragraph "d". 20 4 d. If a grant recipient discontinues attendance before the 20 5 end of any semester, or the equivalent, after receiving grant 20 6 payments, the entire amount of any refund due that recipient, 20 7 up to the full amount of grant payments made during that 20 8 semester, or the equivalent, shall be paid by the eligible 20 9 institution to the commission. 20 10 4. Commission's duties and responsibilities. Subject to an 20 11 appropriation of funds by the general assembly for purposes of 20 12 this section, the commission shall administer the future ready 20 13 Iowa skilled workforce grant program and shall do all of the 20 14 following: 20 15 a. Provide application forms for distribution to students by 20 16 eligible institutions. 20 17 b. Adopt rules under chapter 17A, in collaboration with 20 18 the department of workforce development, for administration of 20 19 this section, including but not limited to establishing the 20 20 duties and responsibilities of eligible institutions under the 20 21 program; defining residence and satisfactory academic progress 20 22 for purposes of the program; and establishing procedures for 20 23 grant application, processing, and approval. The rules shall 20 24 provide for determining the priority awarding of grants if 20 25 funds available for purposes of this section are insufficient 20 26 to pay all eligible students. Priority shall be given to fully 20 27 awarding eligible students approved for grants based on the 20 28 date of application, rather than prorating grant awards among 20 29 all eligible students. 20 30 c. Approve and award grants on an annual basis. 20 31 d. Transmit to the department of workforce development the 20 32 compilation of information, data, and statistics submitted in 20 33 accordance with subsection 1, paragraph "b", subparagraph (7), 20 34 for the annual report required under section 84A.1B. 20 35 5. Fund created. A future ready Iowa skilled workforce 21 1 grant fund is created in the state treasury as a separate fund 21 2 under the control of the commission. All moneys deposited or 21 3 paid into the fund are appropriated and made available to the 21 4 commission to be used for grants awarded as provided under this 21 5 section. Notwithstanding section 8.33, any balance in the fund 21 6 on June 30 of each fiscal year shall not revert to the general 21 7 fund of the state, but shall be available for purposes of this 21 8 section in subsequent fiscal years. 21 9 Sec. 14. Section 261E.8, Code 2018, is amended by adding the 21 10 following new subsection: 21 11 NEW SUBSECTION. 7A. Subject to an appropriation of funds 21 12 by the general assembly for this purpose, the department shall 21 13 establish a program to provide additional funds for resident 21 14 high school pupils enrolled in grades nine through twelve to 21 15 attend a community college for college=level classes or attend 21 16 a class taught by a community college=employed instructor 21 17 through a contractual agreement between a community college and 21 18 a school district that satisfies the requirements for classes 21 19 under section 257.11, subsection 3, except that the classes 21 20 eligible for funding under this program are offered during the 21 21 summer and outside of the regular school year and are aligned 21 22 with career pathways leading to postsecondary credentials and 21 23 high=demand jobs designated by the workforce development board 21 24 or a community college pursuant to section 84A.1B, subsection 21 25 13A. A community college shall not charge students tuition for 21 26 a class offered partially or completely outside of the regular 21 27 school year under this program. 21 28 Sec. 15. EFFECTIVE DATE.
