Prompt
payment
of
claims

right
of
subrogation.

As
used
in
this
section,
unless
the
context
otherwise

requires:

a.
“Covered
person”
means
the
same
as
defined
in
section
5
514J.102.
6
b.
“Health
benefit
plan”
means
the
same
as
defined
in
7
section
514J.102.
8
c.
“Health
care
provider”
means
the
same
as
defined
in
9
section
514J.102.
10
d.
“Health
care
services”
means
the
same
as
defined
in
11
section
514J.102.

2.
If
a
covered
person
injured
by
reason
of
an
accident
13
provides
proof
of
insurance
coverage
under
a
health
benefit
14
plan
for
health
care
services
received
from
a
health
care
15
provider,
a
health
care
provider
shall
submit
all
charges
to
16
the
covered
person’s
health
benefit
plan.
The
covered
person’s
17
health
benefit
plan
shall
not
deny
payment
for
health
care
18
services
the
covered
person
received
on
the
basis
that
a
third
19
party
or
other
insurance
carrier
is
responsible
for
the
covered
20
person’s
injuries.
This
section
shall
not
be
construed
to
21
prohibit
a
health
benefit
plan
from
seeking
subrogation
or
22
indemnification
for
third-party
liability.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
health
insurance
coverage
and
27
subrogation
and
indemnification.
Under
the
bill,
a
health
care
28
provider
shall
submit
all
charges
for
health
care
services
to
29
an
injured
covered
person’s
health
benefit
plan,
and
the
health
30
benefit
plan
shall
not
deny
payment
on
the
basis
that
a
third
31
party
or
other
insurance
carrier
is
responsible
for
the
covered
32
person’s
injuries.
The
bill
does
not
prohibit
a
health
benefit
33
plan
from
seeking
subrogation
or
indemnification
from
a
third
34
party.
