H.F. 2382 Section 1. Section 904.808, subsection 1, paragraph b, Code 1 2014, is amended to read as follows: 2 b. When the state director of the department of 3 administrative services releases, in writing, the obligation 4 of the department or agency to purchase the product from 5 Iowa state industries, after determining that Iowa state 6 industries is unable to meet the performance characteristics 7 of the purchase request for the product, and a copy of the 8 release is attached to the request to the director of the 9 department of administrative services for payment for a similar 10 product, or when Iowa state industries is unable to furnish 11 needed products, comparable in both quality and price to those 12 available from alternative sources, within a reasonable length 13 of time. Any disputes arising between a purchasing department 14 or agency and Iowa state industries regarding similarity 15 of products, or comparability of quality or price, or the 16 availability of the product, shall be referred to the director 17 of the department of administrative services, whose decision 18 shall be subject to appeal as provided in section 8A.313 . 19 However, if the purchasing department is the department of 20 administrative services, any matter which would be referred 21 to the director under this paragraph shall be referred to the 22 executive council in the same manner as if the matter were to 23 be heard by the director of the department of administrative 24 services. The decision of the executive council is final. 25 Sec. 2. REPEAL. Section 8A.313, Code 2014, is repealed. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill concerns the purchase of products manufactured by 30 Iowa state (prison) industries by state agencies. 31 Code section 904.808, concerning state government 32 purchasing, is amended to provide that the director of the 33 department of administrative services, and not the director 34 of the Iowa department of corrections, has the authority to 35 -1- LSB 5631HV (2) 85 ec/nh 1/ 2
H.F. 2382 release a state agency from the requirement to purchase from 1 Iowa prison industries after determining that Iowa prison 2 industries is unable to meet the performance characteristics of 3 the purchase request for the product, or is unable to furnish 4 needed products, comparable in both quality and price to those 5 available from alternative sources, within a reasonable length 6 of time.
