Section
1.
Section
279.9,
Code
2024,
is
amended
to
read
as
1
follows:

279.9
Use
of
tobacco,
alcoholic
beverages,
or
controlled
3
substances.

1.
The
rules
adopted
under
section
279.8
shall
include
5
rules
prohibiting
the
use
of
tobacco
and
the
use
or
possession
6
of
alcoholic
liquor,
wine,
or
beer
or
any
controlled
substance
7
as
defined
in
section
124.101,
subsection
5
,
by
any
student
of
8
the
schools.
The
board
may
suspend
or
expel
a
student
for
a
9
violation
of
a
rule
described
under
this
section
or
require
the
10
student
to
participate
in
a
rehabilitation
program
designated
11
by
the
board
.

The
department
of
health
and
human
services,
in
13
consultation
with
the
department
of
education,
shall
14
establish
and
maintain
a
list
of
organizations
that
administer
15
rehabilitation
programs
suitable
for
participation
by
students
16
under
this
section.
The
department
of
health
and
human
17
services
shall
make
the
list
available
to
the
department
18
of
education,
which
shall
disseminate
the
list
to
school
19
districts.

EXPLANATION
21
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
a
school
board
may
suspend
or
expel
a
24
student
for
a
violation
of
a
school
board
rule
prohibiting
the
25
use
of
tobacco
and
the
use
or
possession
of
alcoholic
liquor,
26
wine,
or
beer
or
any
controlled
substance
by
any
student.
This
27
bill
provides
that
as
an
additional
option,
a
school
board
may
28
require
the
student
to
participate
in
a
rehabilitation
program
29
designated
by
the
board.

The
bill
requires
the
department
of
health
and
human
31
services,
in
consultation
with
the
department
of
education,
to
32
establish
and
maintain
a
list
of
organizations
that
administer
33
rehabilitation
programs
suitable
for
participation
by
students
34
for
this
purpose.
