H.F. 2135 Section 1. Section 35A.11, subsection 2, Code 2022, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . 0i. Distinguished service medal special 3 plates issued pursuant to section 321.34, subsection 20D. 4 Sec. 2. Section 321.34, Code 2022, is amended by adding the 5 following new subsection: 6 NEW SUBSECTION . 20D. Distinguished service medal plates. 7 a. An owner referred to in subsection 12 who was 8 awarded a distinguished service medal by the United States 9 government may, upon written application to the department 10 and presentation of satisfactory proof of the award, order 11 special registration plates with a distinguished service 12 medal processed emblem. The emblem shall be designed by the 13 department in consultation with the adjutant general. The 14 special plate fees collected by the director under subsection 15 12, paragraph “a” , from the annual validation of letter-number 16 designated distinguished service medal plates, and subsection 17 12, paragraph “c” , from the issuance and annual validation of 18 personalized distinguished service medal plates shall be paid 19 monthly to the treasurer of state and deposited in the road 20 use tax fund. The treasurer of state shall transfer monthly 21 from the statutory allocations fund created under section 22 321.145, subsection 2, to the veterans license fee fund created 23 in section 35A.11 the amount of the special fees collected 24 under subsection 12, paragraph “a” , in the previous month for 25 distinguished service medal plates. 26 b. Notwithstanding subsection 12, paragraph “a” , an owner 27 who is approved for special registration plates under this 28 subsection shall be issued one set of special registration 29 plates with a distinguished service medal processed emblem at 30 no charge. 31 c. The surviving spouse of a person who was issued special 32 plates under this subsection may continue to use or apply for 33 and use the special plates subject to registration of the 34 special plates in the surviving spouse’s name and upon payment 35 -1- LSB 5374YH (1) 89 th/ns 1/ 3
H.F. 2135 of the annual five-dollar special plate fee and the regular 1 annual registration fee for the vehicle. If the surviving 2 spouse remarries, the surviving spouse shall return the special 3 plates to the department and the department shall issue regular 4 registration plates to the surviving spouse. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 This bill authorizes the department of transportation (DOT) 9 to issue special registration plates bearing a distinguished 10 service medal processed emblem designed by the DOT in 11 consultation with the adjutant general. 12 A person who was awarded a distinguished service medal by the 13 United States government may make a written application to the 14 DOT and present satisfactory proof of the award to order the 15 plates. 16 Under current law, the fee for the issuance of special 17 registration plates with a processed emblem is $25 which is 18 in addition to the regular annual registration fee. The bill 19 provides that a person who is approved for the distinguished 20 service medal special registration plates must be issued one 21 set of plates at no charge. 22 The bill requires the fees collected by the DOT for the 23 distinguished service medal plates to be paid monthly to the 24 treasurer of state and deposited in the road use tax fund. 25 The treasurer of state must credit monthly from the statutory 26 allocations fund to the veterans license fee fund the amount of 27 special fees for distinguished service medal plates collected 28 in the previous month. 29 The bill authorizes the surviving spouse of a person who was 30 issued distinguished service medal special plates to continue 31 to use or apply for and use the special plates subject to 32 registration of the special plates in the surviving spouse’s 33 name and upon payment of the annual $5 special plate fee and 34 the regular annual registration fee for the vehicle.
