preceding
the
effective

a
school
reorganization
under
this
chapter,
who

was
a
resident
of
a
school
district
affected,
may
enroll
in

any
reorganized
school
district
to
which
territory
of
the
7
school
district
affected
is
now
included
until
the
student’s
8
graduation
from
high
school,
unless
the
student
was
expelled
9
or
suspended
from
school
and
the
conditions
of
expulsion
or
10
suspension
have
not
been
met.
The
student
under
expulsion
or
11
suspension
shall
not
be
enrolled
until
the
board
of
directors
12
of
the
school
district
to
which
territory
of
the
school
13
district
affected
was
attached
approves,
by
majority
vote,
the
14
enrollment
of
the
student.

2.
Notwithstanding
section
282.24,
the
district
of

residence
of
the
student,
determined
in
the
reorganization
17
proposal,
shall
pay
tuition
to
the
school
district
selected
by
18
the
student
in
an
amount
not
to
exceed
the
district
cost
per
19
pupil
of
the
district
of
residence,
and
the
school
district
20
selected
by
the
student
shall
accept
that
tuition
payment
and
21
enroll
the
student.

Section
275.55A,
Code
2011,
is
amended
to
read
as

follows:

the

3.
Section
282.9,
subsection
1,
Code
2011,
is
amended

to
read
as

,
and

282.18
,
or
any
other
provision
to
the
contrary,
prior
to
14
knowingly
enrolling
an
individual
who
is
required
to
register
15
as
a
sex
offender
under
chapter
692A
,
but
who
is
otherwise
16
eligible
to
enroll
in
a
public
school,
the
board
of
directors
17
of
a
school
district
shall
determine
the
educational
placement
18
of
the
individual.
Upon
receipt
of
notice
that
a
student
who
19
is
enrolled
in
the
district
is
required
to
register
as
a
sex
20
offender
under
chapter
692A
,
the
board
shall
determine
the
21
educational
placement
of
the
student.
The
tentative
agenda
22
for
the
meeting
of
the
board
of
directors
at
which
the
board
23
will
consider
such
enrollment
or
educational
placement
shall
24
specifically
state
that
the
board
is
considering
the
enrollment
25
or
educational
placement
of
an
individual
who
is
required
26
to
register
as
a
sex
offender
under
chapter
692A
.
If
the
27
individual
is
denied
enrollment
in
a
school
district
under
this
28
section
,
the
school
district
of
residence
shall
provide
the
29
individual
with
educational
services
in
an
alternative
setting.
30
Sec.
4.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
31
immediate
importance,
takes
effect
upon
enactment.

Sec.
5.
APPLICABILITY.
This
Act
applies
to
school
district
33
reorganizations
and
dissolutions
that
take
effect
under
chapter
34
275
on
or
after
the
effective
date
of
this
Act.

EXPLANATION
1
This
bill
provides
that
a
student
enrolled
in
grades
2
kindergarten
through
eleventh
grade
during
the
school
year
3
preceding
the
effective
date
of
a
school
reorganization
under
4
Code
chapter
275,
who
was
a
resident
of
a
school
district
5
affected
by
the
reorganization,
may
enroll
in
any
reorganized
6
school
district
to
which
territory
of
the
school
district
7
affected
is
now
included
until
the
student’s
graduation
from
8
high
school,
unless
the
student
was
expelled
or
suspended
from
9
school
and
the
conditions
of
expulsion
or
suspension
have
10
not
been
met.
Under
the
bill,
a
student
under
expulsion
or
11
suspension
shall
not
be
enrolled
until
the
board
of
directors
12
of
the
reorganized
school
district
approves,
by
majority
vote,
13
the
enrollment
of
the
student.

The
bill
modifies
similar
existing
enrollment
provisions
15
applicable
to
school
district
dissolutions
in
Code
section
16
275.55A
by
applying
such
enrollment
options
to
students
17
enrolled
in
kindergarten
through
eleventh
grade
during
the
18
school
year
preceding
the
dissolution.
Current
Code
section
19
275.55A
only
applies
to
students
enrolled
in
ninth,
tenth,
or
20
eleventh
grade.
21
The
bill
takes
effect
upon
enactment
and
applies
to
school
22
district
reorganizations
and
dissolutions
that
take
effect
23
under
Code
chapter
275
on
or
after
the
effective
date
of
the
24
bill.
