House File 2073 - Introduced HOUSE FILE BY FRY A BILL FOR 1 An Act relating to the authorized expenditure of funds for 2 school programs serving at=risk students, alternative 3 schools, returning dropouts, and potential dropouts and 4 including applicability provisions. 5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 5637YH (5) 87 md/jh PAG LIN 1 1 Section 1. Section 257.41, subsection 2, paragraphs a and b, 1 2 Code 2018, are amended to read as follows: 1 3 a. Salary and benefits for instructional staff, 1 4 instructional support staff, guidance counselors, psychologists 1 5 licensed under chapter 154B, licensed independent social 1 6 workers under chapter 154C, licensed mental health counselors 1 7 under chapter 154D, and school=based youth services staff who 1 8 are working with students who are participating in at=risk 1 9 or dropout prevention programs, alternative programs, and 1 10 alternative schools, in a traditional or alternative setting, 1 11 ifthe staffsuch person'sor counselor'stime is dedicated to 1 12 working with such students in order to provide services beyond 1 13 those which are provided by the school district to students 1 14 who are not participating in such programs or alternative 1 15 schools. However, ifthe staffsuch personor counselorworks 1 16 part=time with students who are participating in a program 1 17 or alternative school and thestaffpersonor counselorhas 1 18 another unrelatedstaffassignment, only the portion of the 1 19staffperson'sor counselor'stime that is related to the 1 20 program or alternative school may be charged to the program 1 21 or school. For each suchstaffpersonor counselorwho works 1 22 part time with students who are participating in a program 1 23 or alternative school, the school district shall have the 1 24 authority to designate the portion of thestaffperson'sor 1 25 counselor'stime and the corresponding amount of salary and 1 26 benefits that is related to the program or alternative school 1 27 and shall include such designation as part of the program plan 1 28 under section 257.38, if applicable. For purposes of this 1 29 paragraph, if an alternative setting is necessary to provide 1 30 for a program which is offered at a location off school grounds 1 31 and which is intended to serve student needs by improving 1 32 relationships and connections to school, decreasing truancy and 1 33 tardiness, providing opportunities for course credit recovery, 1 34 or helping students identified as at risk to accelerate through 1 35 multiple grade levels of achievement within a shortened time 2 1 frame, the tuition costs for a student identified as at risk 2 2 shall be considered an appropriate use of the program funding 2 3 under this section. 2 4 b. Professional development for all teachers, counselors, 2 5 psychologists, social workers, and staff identified in 2 6 paragraph "a" who are working with at=risk students under a 2 7 program or an alternative school setting. 2 8 Sec. 2. APPLICABILITY. This Act applies to school budget 2 9 years beginning on or after July 1, 2019. 2 10 EXPLANATION 2 11 The inclusion of this explanation does not constitute agreement with 2 12 the explanation's substance by the members of the general assembly. 2 13 Under current Code section 257.41, appropriate uses of the 2 14 funding for an approved program for at=risk students, secondary 2 15 students who attend alternative programs and schools, and 2 16 returning dropouts and dropout prevention include the salary, 2 17 benefits, and professional development for instructional 2 18 staff, instructional support staff, guidance counselors, 2 19 and school=based youth services staff who are working with 2 20 students who are participating in such programs. This bill 2 21 adds the salary, benefits, and professional development of 2 22 licensed psychologists, licensed independent social workers, 2 23 and licensed mental health counselors to the category of 2 24 permissible expenditures for such funds. 2 25 The bill applies to school budget years beginning on or after 2 26 July 1, 2019.
