Section
1.
Section
216.2,
subsection
5,
Code
2024,
is

amended
to
read
as
follows:

5.
“Disability”
means
the
physical
or
mental
condition
3
of
a
person
which
constitutes
a
substantial
disability,
the
4
condition
of
whether
or
not
a
person
is
vaccinated
against
5
a
particular
disease,
and
the
condition
of
a
person
with
6
a
positive
human
immunodeficiency
virus
test
result,
a
7
diagnosis
of
acquired
immune
deficiency
syndrome,
a
diagnosis
8
of
acquired
immune
deficiency
syndrome-related
complex,
or
9
any
other
condition
related
to
acquired
immune
deficiency
10
syndrome.
The
inclusion
of
a
condition
related
to
a
positive
11
human
immunodeficiency
virus
test
result
in
the
meaning
of
12
“disability”
under
the
provisions
of
this
chapter
does
not
13
preclude
the
application
of
the
provisions
of
this
chapter
14
to
conditions
resulting
from
other
contagious
or
infectious
15
diseases.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
the
definition
of
“disability”
for
20
purposes
of
Code
chapter
216,
the
Iowa
civil
rights
Act
of
21
1965,
includes
the
condition
of
whether
or
not
a
person
is
22
vaccinated
against
a
particular
disease.
