  1  1    Section 1.  NEW SECTION.  148.4A  Medical specialty board
  1  2 recertification not required.
  1  3    1.  Maintenance of certification or osteopathic continuous
  1  4 certification shall not be required for a physician as a
  1  5 condition of licensure, admitting privileges at a hospital in
  1  6 this state, reimbursement, malpractice insurance coverage, or
  1  7 employment.
  1  8    2.  For the purposes of this section:
  1  9    a.  "Maintenance of certification" and "osteopathic continuous
  1 10 certification" refer to proprietary programs, sponsored by
  1 11 one or more of the medical specialty boards recognized by
  1 12 the American board of medical specialties or the American
  1 13 osteopathic association, that require periodic medical
  1 14 specialty recertification examinations, self=assessments,
  1 15 peer evaluations, and other activities, necessary to maintain
  1 16 medical specialty board certification.
  1 17    b.  "Physician" means a person licensed to practice medicine
  1 18 and surgery or osteopathic medicine and surgery under this
  1 19 chapter.
  1 20                           EXPLANATION
  1 21 The inclusion of this explanation does not constitute agreement with
  1 22 the explanation's substance by the members of the general assembly.
  1 23    This bill prohibits the state, hospitals in the state,
  1 24 employers, and insurers from requiring physicians to
  1 25 participate in a maintenance of certification or osteopathic
  1 26 continuous certification program in order to maintain a
  1 27 license, admitting privileges, malpractice insurance, or
  1 28 employment, or to receive reimbursement. The bill does not
  1 29 alter the current continuing medical education requirements for
  1 30 physicians established by the board of medicine.
