SENATE RESOLUTION
REQUESTING THE Hawaii Supreme Court Standing Committee on the Rules of Evidence TO STUDY AND REPORT ON THE IMPLEMENTATION OF THE Hawaii UNIFORM COLLABORATIVE LAW ACT.
WHEREAS, the State of Hawaii has adopted numerous
uniform laws promulgated by the Uniform Law Commission, which was established to provide rules and procedures that are consistent from state to state; and
WHEREAS, the Uniform Collaborative Law Act, one such measure crafted by the Uniform Law Commission, provides a framework to authorize disputants to voluntarily enter into collaborative law participation agreements signifying interest to resolve disputes without the intervention of a tribunal; and
WHEREAS, the Legislature is considering enacting the
Hawaii Uniform Collaborative Law Act, as indicated by the introduction of House Bill No. 626 during the Regular Session of 2011; and
WHEREAS, the Hawaii Supreme Court Standing Committee on the Rules of Evidence was created by the Chief Justice to study and evaluate proposed evidence law measures referred to it by the Legislature; and
WHEREAS, an analysis by the Hawaii Supreme Court Standing Committee on the Rules of Evidence is desired prior to enacting a new law effecting the current dispute resolution mechanisms; now, therefore,
BE IT RESOLVED by the Senate
of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of
2011, that the Hawaii Supreme Court Standing Committee on the Rules of Evidence
is requested to conduct a study on the implementation of the Hawaii Uniform
Collaborative Law Act; and
BE IT FURTHER RESOLVED that the Hawaii Supreme Court Standing Committee on
the Rules of Evidence is requested to report its findings and recommendations
to the Legislature by November 1, 2011; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chief Justice of the Hawaii Supreme Court.
