SENATE CONCURRENT

RESOLUTION

 

 

REQUESTING THE DEPARTMENT OF TRANSPORTATION TO CONVENE A WORKING GROUP TO STUDY THE PEER-TO-PEER CAR SHARING INDUSTRY.

 

 


     WHEREAS, vehicles for hire as a mode of transportation have transformed over the years from traditional taxi services to individuals using their personal vehicles for transportation services via a transportation network company; and

 

     WHEREAS, a new mode of transportation, known as peer-to-peer car sharing, has recently developed where private individuals are renting their personal vehicles to other individuals as a commercial enterprise via a third party web-based platform; and

 

     WHEREAS, over one hundred fifty personal vehicles are available for rent via peer-to-peer car sharing, ranging from $30 to $350 per day, in the State; and

 

     WHEREAS, in many cases, these personal vehicles are being rented to visitors and residents without any regulation, resulting in a loss of revenue to the State; and

 

     WHEREAS, the State has a vested interest in ensuring that consumers who participate in peer-to-peer car sharing via a third party web-based platform are protected and that vehicles available in peer-to-peer car sharing are being rented to qualified individuals, have adequate insurance coverage, and meet vehicle safety standards; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the House of Representatives concurring, that the Department of Transportation is requested to convene a working group to evaluate the regulation of the peer-to-peer car sharing industry and consider practice standards for this industry to ensure the safety of the public; and

 

     BE IT FURTHER RESOLVED that the Director of Transportation is requested to serve as the chair of the working group and to invite the following individuals to serve as members of the working group:

 

     (1)  The Insurance Commissioner or the Commissioner's designee;

 

     (2)  The Executive Director of the Office of Consumer Protection or the Director's designee;

 

     (3)  One representative from the Department of Transportation;

 

     (4)  One representative from the Department of Business, Economic Development, and Tourism;

 

     (5)  One representative from the Public Utilities Commission;

 

     (6)  One representative from the motor vehicle rental industry conducting business in the State;

 

     (7)  Two representatives from the licensed automobile insurance industry conducting business in the State;

 

     (8)  Two representatives from the peer-to-peer car sharing industry; and

 

     (9)  One representative from the transportation network company industry; and

 

     BE IT FURTHER RESOLVED that the working group is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2020; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation; Insurance Commissioner; Executive Director of the Office of Consumer Protection; Director of Business, Economic Development, and Tourism; and Chair of the Public Utilities Commission.
