SENATE CONCURRENT

RESOLUTION

 

 

requesting the auditor to conduct an audit on the contractors license board's IMPLEMENTATION of recommendations from previous audits AND ITS REPORT TO THE LEGISLATURE.

 

 


     WHEREAS, the Contractors License Board (Board) is the governing board for contractors licensed in the State; and

 

     WHEREAS, the State's contractor licensing law, chapter 444, Hawaii Revised Statutes, is a consumer protection statute intended to protect the public's health, safety, and welfare when dealing with persons engaged in the construction industry, and therefore requires a licensee to show experience for each license obtained; and

 

     WHEREAS, the Board has been audited by the Auditor in 1983, Report No. 83-3, Sunset Evaluation Report, Contractors, Chapter 444, Hawaii Revised Statutes, and 1989, Report No. 89-3, Sunset Evaluation Update, Contractors, Chapter 444, Hawaii Revised Statutes; and

 

     WHEREAS, it is unclear whether the Board has implemented any of the findings or recommendations from the audits conducted in 1983 and 1989; and

 

     WHEREAS, the Board was requested to review the criteria, requirements, and procedures for "A" general engineering contractor licenses, "B" general building contractor licenses, and "C" general specialty licenses and submit a report of proposed recommendations for amendments to chapter 444, Hawaii Revised Statutes, and chapter 77, Hawaii Administrative Rules, to the Legislature pursuant to S.C.R. No. 84, S.D. 1, Regular Session of 2013; and

 

     WHEREAS, the Board failed to act on its proposed recommendations since submitting its report to the Legislature in November 2013; and

 

     WHEREAS, an audit of the Board is necessary to instill greater confidence in the public that the Board is protecting the public's health, safety, and welfare; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the House of Representatives concurring, that the Auditor is requested to conduct an audit of the Contractors License Board's implementation of recommendations from the audits conducted in 1983 and 1989; and

 

     BE IT FURTHER RESOLVED that the Department of Commerce and Consumer Affairs, Professional and Vocational Licensing Division, and Contractors License Board are requested to cooperate and provide all relevant data and other information to the Auditor during the planning and implementation of the audit; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to include the following in the audit:

 

     (1)  An examination of the general operations of the Contractors License Board;

 

     (2)  A description of the organizational structure of the Contractors License Board, including personnel practices and staffing coverage;

 

     (3)  A description of the Contractors License Board's internal budgeting and fiscal controls;

 

     (4)  The status of the Contractors License Board's implementation of recommendations in the 1983 and 1989 audits;

 

     (5)  The status of the Contractors License Board's implementation of recommendations in its November 2013 report to the Legislature; and

 

     (6)  Any other matters the Auditor deems appropriate; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 2019; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Commerce and Consumer Affairs, Auditor, Licensing Administrator of the Professional and Vocational Licensing Division, and Chairperson of the Contractors License Board.
