SENATE CONCURRENT

RESOLUTION

 

 

requesting the Chairperson of the board of land and natural resources and the mayor of the city and county of honolulu to form a working group to address abandoned vehicles and boats on public roadways and streets.

 

 


     WHEREAS, residents of the City and County of Honolulu find that the high volume of vehicles and boats parked on residential streets makes driving on some streets difficult and unsafe; and

 

     WHEREAS, some of the troublesome vehicles and boats parked on public streets have been abandoned; and

 

     WHEREAS, it is unclear which authority has jurisdiction over abandoned vehicles and boats that are parked on public streets; and

 

     WHEREAS, responsibility for towing abandoned vehicles and boats needs to be determined so that residents know who to contact when they have concerns; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2015, the House of Representatives concurring, that the Chairperson of the Board of Land and Natural Resources and the Mayor of the City and County of Honolulu are requested to form a working group to address abandoned vehicles and boats on public roadways and streets; and

 

     BE IT FURTHER RESOLVED that the Chairperson of the Board of Land and Natural Resources or the Chairperson's designee serve as the chairperson of the working group; and

 

BE IT FURTHER RESOLVED that the working group consist of the following members:

 

     (1)  The Chairperson of the Board of Land and Natural Resources or the Chairperson's designee;

 

     (2)  The Director of Transportation or the Director's designee;

 

     (3)  A representative from the Department of Land and Natural Resources' Division of Boating and Ocean Recreation;

 

     (4)  A representative from the Honolulu Mayor's Office;

 

     (5)  A representative from the Honolulu City Council;

 

     (6)  The Director of the Department of Transportation Services of the City and County of Honolulu or the Director's designee;

 

     (7)  The Director of the Department of Customer Services of the City and County of Honolulu or the Director's designee;

 

     (8)  The Honolulu Police Department's Chief of Police or the Chief's designee; and

 

     (9)  Any other persons that the chairperson of the working group deems necessary; and

 

     BE IT FURTHER RESOLVED that the working group address:

 

     (1)  Which authority has jurisdiction over abandoned vehicles and boats on public roadways and streets;

 

     (2)  Procedures for removal of abandoned vehicles and boats from public roadways and streets;

 

     (3)  Process for notification when an abandoned vehicle or boat is identified on a public roadway or street; and

 

     (4)  Responsibility for the cost of removing an abandoned vehicle or boat from a public roadway or street; and

 

     BE IT FURTHER RESOLVED that the members of the working group serve without compensation but be reimbursed for expenses, including travel expenses, necessary for the performance of their duties; and

 

     BE IT FURTHER RESOLVED that the working group is requested to submit its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2016; and

 

     BE IT FURTHER RESOLVED that the working group be dissolved on June 30, 2016; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources, Director of Transportation, Mayor and Council of the City and County of Honolulu, Director of the Honolulu Department of Transportation Services, Director of the Honolulu Department of Customer Services, and Honolulu Chief of Police.
