SENATE CONCURRENT
RESOLUTION
requesting the environmental council to submit a report to the legislature on the revision of environmental impact statement rules, title 11, Chapter 200, hawaii administrative rules.
WHEREAS, the Environmental Council serves as a liaison between the Director of Environmental Quality Control and the public on matters concerning ecology and environmental quality; and
WHEREAS, the Environmental Council also monitors the progress of federal, state, and county agencies in achieving the State's environmental goals and policies and publishes its findings in its annual reports; and
WHEREAS, one of the Environmental Council's specific statutory responsibilities is to adopt administrative rules under chapter 343, Hawaii Revised Statutes, relating to environmental impact statements; and
WHEREAS, the Environmental Council's administrative rules were last revised in 1996; and
WHEREAS, the Environmental Council is composed of fifteen members, fourteen of whom are volunteers, who represent every major Hawaiian island and, with the help of law students from the University of Hawaii, have met throughout 2017 to prepare revised rules; and
WHEREAS, the Environmental Council is preparing to hold public hearings pursuant to chapter 91, Hawaii Revised Statutes, on the working draft version 0.4 of the proposed revised rules; and
WHEREAS, the Environmental Council is subject to additional requirements for final adoption, amendment, or repeal of administrative rules pursuant to chapter 343, Hawaii Revised Statutes, including holding at least one public hearing in each county; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the House of Representatives concurring, that the Environmental Council is requested to submit a report on the revision of the environmental impact statement rules, title 11, chapter 200, Hawaii Administrative Rules, outlining the process used to revise the rules, including the methodologies implemented to gather a wide range of public input, along with any recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2019; and
BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Environmental Quality Control.
