SENATE CONCURRENT

RESOLUTION

 

 

requesting the auditor to conduct a sunrise review of the regulation of body piercing.

 

 


     WHEREAS, Senate Bill No.    (2012) proposes to regulate body piercing, that is presently unregulated;

 

     WHEREAS, the Legislature finds that body piercing has become very popular in the United States since the 1990s; and

 

     WHEREAS, various areas of the body are subject to piercing, such as the ears, tongue, nose, navel, and eyebrows; and

 

     WHEREAS, body piercing can be associated with health problems such as infection, allergies to the type of jewelry used, nerve damage, tetanus, and tearing of the skin; and

    

     WHEREAS, body piercing, if sterile techniques are not used,  also carries a risk of spreading potentially life-threatening diseases such as hepatitis B or hepatitis C, or tuberculosis; and

 

     WHEREAS, Senate Bill No.    requires body piercers to be licensed by the Department of Commerce and Consumer Affairs; and

 

     WHEREAS, Senate Bill No.    would require body piercers to perform body piercing only in permitted shops or other locations; and

 

     WHEREAS, section 26H-6, Hawaii Revised Statutes, requires the Auditor to review proposals to regulate professions, vocations, or occupations that are currently unregulated and to assess alternative forms of regulation; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2012, the House of Representatives concurring, that the Auditor is respectfully requested to conduct a sunrise review of the regulation of body piercers as proposed under Senate Bill No.              , including an assessment of alternative forms of regulation, pursuant to section 26H-6, Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit findings, recommendations, and any proposed legislation to the Legislature no later than twenty days prior to the convening of the Regular Session of 2013; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Director of Commerce and Consumer Affairs.
