A BILL FOR AN ACT

RELATING TO RECYCLING.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§46- Plastic bottles and bottle caps; acceptance by counties. (a) For any county with a population less than five hundred thousand and notwithstanding any county ordinance adopted and enforced by the counties pursuant to section 46-1.5(14)(A)(ii) to the contrary, no county shall reject the following when presented for recycling:

(1) Any number 1 plastic bottle labeled pursuant to section 342H-42(1); or

(2) Any number 2 plastic bottle labeled pursuant to section 342H-42(2),

solely because the bottle is accompanied by or adjoined to a bottle cap composed of a material not recycled by the county, including polypropylene, or number 5 plastic.

(b) If, pursuant to subsection (a), the county accepts any bottle caps composed of a material not recycled by the county, the county shall separate the bottle caps from any recyclable plastic bottles and appropriately dispose of the bottle caps."

SECTION 2. Section 342G-1, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

""PP" means polypropylene plastic and containers manufactured from this material."

SECTION 3. Section 342G-26, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

"(c) The recycling and bioconversion component shall identify and assess:

(1) The level of waste reduction the county is achieving through existing recycling and bioconversion efforts;

(2) The type and amount of solid waste that it is technically and economically feasible to recycle or alter through bioconversion; and

(3) Methods to increase and improve the recycling and bioconversion efforts, including opportunities for backyard composting.

For recycling, the counties shall assess the type and amount of solid waste that it is technically feasible to recycle, giving consideration at a minimum to clear glass, colored glass, aluminum, steel and bimetallic cans, high-grade office paper, newsprint, mixed paper, corrugated paper, HDPE, PET, PP, and green waste.

For bioconversion, the counties shall assess the type and amount of solid waste that it is technically feasible to alter through bioconversion, giving consideration at a minimum to green waste, wood waste, animal manure, sewage sludge, and food wastes."

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for the counties to separate bottle caps composed of a material not recycled by the counties from any recyclable plastic bottles and appropriately dispose of the bottle caps, to be allocated as follows:

(1) $ to the county of Hawaii;

(2) $ to the county of Kauai; and

(3) $ to the county of Maui.

The sums appropriated shall be expended by the respective counties for the purposes of this Act.

SECTION 5. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.

SECTION 6. New statutory material is underscored.

SECTION 7. This Act shall take effect on July 1, 2050.

Description:

Prohibits counties with a population less than 500,000 from rejecting number 1 and 2 plastic bottles presented for recycling solely because the bottles are accompanied by or adjoined to nonrecyclable bottle caps. Requires and appropriates funds for the counties to separate and appropriately dispose of such nonrecyclable bottle caps. Requires the counties to include a feasibility assessment of recycling PP materials. (SB893 HD1)
