A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346‑    Non-therapeutic infant circumcision; medicaid coverage disallowed.  (a)  The department shall establish rules pursuant to chapter 91 to disallow medicaid coverage for the non-therapeutic circumcision of an infant.

     (b)  For the purposes of this section, "non-therapeutic circumcision" refers to a circumcision that is not medically necessary."

     SECTION 2.  If any part of this Act is found to be in conflict with federal requirements that are a prescribed condition for the allocation of federal funds to the State, the conflicting part of this Act is inoperative solely to the extent of the conflict and with respect to the agencies directly affected, and this finding shall not affect the operation of the remainder of this Act in its application to the agencies concerned.  The rules established under this Act shall meet federal requirements that are a necessary condition to the receipt of federal funds by the State.

     SECTION 3.  This Act shall not be applied so as to impair any contract existing as of the effective date of this Act in a manner violative of either the Hawaii Constitution or Article I, Section 10, of the United States Constitution.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2009, and shall apply to services provided on or after that date.
