A BILL FOR AN ACT
RELATING to motor vehicles.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that, according to the National Highway Traffic Safety Administration, forty per cent of all cyclist fatalities are caused by a motor vehicle striking the cyclist from behind. Fourteen cyclists have been killed on Hawaii's roads in the last five years and twelve per cent felt their personal safety was threatened during their last ride. One common reason why many cyclists feel threatened for personal safety while riding on the road is the close proximity in which motor vehicles are operated in relation to cyclists. As of 2015, safe passing zone laws or safe passing distance requirements exist in thirty-eight states, but Hawaii is not among them.
The purpose of this Act is to establish a safe passing zone of three feet between cyclists and motor vehicles to increase cycling safety.
SECTION 2. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§291C- Operation of a motor vehicle within safe passing zone prohibited. The driver of a motor vehicle shall not operate the motor vehicle within the safe passing zone of a person operating a bicycle. For purposes of this section, "safe passing zone" means a space of three feet surrounding a person operating a bicycle."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
