A BILL FOR AN ACT

 

 

RELATING TO ANIMALS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the protection of the environment requires a prohibition on the uncontrolled propagation of unsterilized feral cats, which may carry disease and emit obnoxious odors and pollutants from cat feces.  Pet cats may become feral when they escape from their owners or are otherwise set loose by their owners.  Feral cats may form colonies and procreate to the extent of presenting an environmental problem as well as a humane issue.

     The purpose of this Act is to prohibit the retail sale of unsterilized cats.

     SECTION 2.  Chapter 143, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§143‑    Unsterilized cats; sales prohibited.  (a)  The sale by any pet retailer of an unsterilized cat in this State shall be prohibited.  If a retailer of pets gives an unsterilized cat to a purchaser of pet supplies or equipment from that retailer, free of charge, that act shall be considered a sale of an unsterilized cat for purposes of this subsection.

     (b)  As used in this section:

     (1)  "Retailer of pets" means any person, partnership firm, or corporation that sells pet animals to customers through a store operation; and

     (2)  "Unsterilized cat" means a female cat that has not been spayed or a male cat that has not been neutered.

     (c)  Notwithstanding section 143-19, any person violating this section shall be subject to a special penalty of a fine of $1,000 per violation."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2012.
