A BILL FOR AN ACT

 

 

RELATING TO childhood obesity.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    (a)  Beginning January 1, 2014, beverages other than water, milk, or one hundred per cent fruit juices shall not be sold to a pupil at an elementary school.

     (b)  An elementary school may permit the sale of beverages that do not comply with subsection (a) as part of a school fundraising event in any of the following circumstances:

     (1)  The items are sold by pupils of the school and the sale of those items takes place off the premises of the school; and

     (2)  The items are sold by pupils of the school and the sale of those items takes place one-half hour or more after the end of the schoolday.

     (c)  Beginning January 1, 2014, from one-half hour before the start of the schoolday to one-half hour after the end of the schoolday, only the following beverages may be sold to a pupil at a middle or intermediate school:

     (1)  Drinks that are one hundred per cent fruit juice;

     (2)  Drinking water; and

     (3)  Milk, including but not limited to chocolate milk, soy milk, rice milk, and other similar dairy or nondairy milk.

     (d)  A middle or intermediate school may permit the sale of beverages that do not comply with subsection (c) as part of a school event if the sale of those items are sold by pupils of the school and the sale of those items takes place:

     (1)  Off the premises of the school; and

     (2)  One-half hour or more after the end of the schoolday.

     (e)  This section does not prohibit an elementary, middle, or intermediate school from making available through a vending machine any beverage allowed during the schoolday under subsection (a) or (c) at any time of day; provided that no other beverages shall be sold in any vending machine on school property.

     (f)  For the purposes of this section, "added sweetener" means any additive that enhances the sweetness of the beverage, including but not limited to added sugar, but does not include natural sugar that is contained within a fruit juice that is a component of the beverage."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
