STATE OF HAWAII

A BILL FOR AN ACT

relating to Rental motor vehicleS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 437D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§437D- Safety information. (a) Upon delivery of a rental motor vehicle to a lessee, the lessor shall provide vehicle safety information that informs the lessee about the proper operation of the vehicle's safety equipment, including but not limited to:

(1) Headlights;

(2) Emergency brakes;

(3) Windshield wipers;

(4) Directional signal lights; and

(5) Seatbelts.

(b) Vehicle safety information provided by a lessor pursuant to this section shall be specific to the year, make, and model of the rental motor vehicle that the lessor provides to the lessee and shall be:

(1) Written;

(2) Illustrated; or

(3) Explained and demonstrated to the lessee by the lessor or an employee of the lessor.

(c) No lessor shall rent a motor vehicle to a lessee until the lessee has acknowledged that the lessee has received and understands the information described in subsections (a) and (b). The acknowledgement shall be written in plain language on the rental agreement and signed by the lessee."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2015.
