A BILL FOR AN ACT

 

 

relating to the vehicle weight tax exemption for Military Personnel.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that current law requires a member of the National Guard, military reserve, or armed forces to be assigned to a unit in the State to be eligible for an exemption from the vehicle weight tax.  This requirement has had the unintended consequence of disqualifying Hawaii service members serving out-of-state from being able to claim the exemption.

     Therefore, the purpose of this Act is to:

     (1)  Repeal the requirement that a member of the National Guard, military reserve, or armed forces must be assigned to a unit in the State in order to be eligible for the vehicle weight tax exemption; and

     (2)  Clarify that the vehicle weight tax exemption is available to service members who claim Hawaii as their residence of record.

     SECTION 2.  Section 249-6.5, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§249-6.5[]]  Exemption for National Guard, military reserves, and other active duty military personnel claiming Hawaii as their residence of record.  One noncommercial motor vehicle registered to a member of the:

     (1)  National Guard[, military];

     (2)  Military reserve[,]; or [armed]

     (3)  Armed service, including the Coast Guard,

who is[:

     (1)  Assigned to a unit in the State; and

     (2)  A] a member in good standing[,]

and who claims Hawaii as their residence of record shall be exempt from the vehicle weight tax provided for in this chapter."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
