A BILL FOR AN ACT

 

 

relating to Graffiti.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that throughout the State, graffiti is a problem in most communities.  Graffiti appears on public and private property, causes visual blight, and results in unsightly scenery.  Individuals engaging in graffiti typically tag buildings, walls, bus stops, bridges, underpasses, construction sites, concrete columns, postal mail boxes, signs, trees, vehicles, and other surfaces able to accommodate their marks and messages.  In some cases, taggers place themselves in dangerous situations that could lead to injury or death.  To date, the problem persists despite community efforts to combat graffiti.

     Accordingly, the purpose of this Act is to reduce graffiti by funding and creating an anti-graffiti program coordinator position under the office of the lieutenant governor and appropriating funds for the implementation of an anti-graffiti program to detect taggers on state property through the use of cameras and high resolution photos.  The coordinator will work with the department of education, county police departments, businesses, youth organizations, and other interested stakeholders to eliminate graffiti.

     SECTION 2.  There is established within the office of the lieutenant governor, for administrative purposes only, an anti-graffiti program that uses cameras and high resolution photos to detect taggers on state property.  The office of the lieutenant governor shall hire one full-time equivalent anti-graffiti program coordinator position beginning on July 1, 2017, to work with public agencies and other organizations to determine sites for implementation of the anti-graffiti program and to advocate against graffiti in the communities.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for the establishment of one full-time equivalent anti-graffiti program coordinator.

     The sums appropriated shall be expended by the office of the lieutenant governor for the purposes of this Act.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to implement an anti-graffiti program to detect taggers on state property through the use of cameras and high resolution photos on state property.

     The sums appropriated shall be expended by the office of the lieutenant governor for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2017, and shall be repealed on July 1, 2020.
