A BILL FOR AN ACT

 

 

relating to THE STATE BUILDING code.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State has traditionally allowed the individual counties to establish their own building codes.  The counties have adopted various portions of the Uniform Building Code, but historically the code differed from county to county.  The status of fragmented building requirements in Hawaii is of serious concern to those involved in building ownership, design, construction, and insurance.  To remedy this problem, the State adopted Act 82, Session Laws of Hawaii 2007, and Act 164 Session Laws of Hawaii 2014, which sought to establish a set of statewide building codes with the goal of applying consistent standards for building owners, architects, contractors, and inspectors.

     The legislature notes that Act 164, Session Laws of Hawaii 2014, amended part II of chapter 107, Hawaii Revised Statutes, refines and clarifies provisions relating to the state building code council and the adoption of Hawaii state building codes and standards.  The legislature finds that these legislative attempts have not obtained the desired result of a uniformed building code throughout the State.

     The purpose of this Act is to repeal the state building code council.

     SECTION 2.  Chapter 107, part II, Hawaii Revised Statutes, is repealed.

     SECTION 3.  This Act shall take effect upon its approval.
