A BILL FOR AN ACT

 

 

relating to public housing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§356D-    Prohibition on smoking.  (a)  The Hawaii public housing authority shall adopt rules pursuant to chapter 91 to implement an incremental smoke-free policy to achieve one hundred per cent smoke-free public housing projects, as defined in section 356D-1, and state low-income housing projects by July 1, 2015.

     (b)  Notwithstanding subsection (a), the authority shall allow a permanent exception for use of medical marijuana pursuant to part IX of chapter 329 throughout the public housing projects, as defined in section 356D-1, and state low-income housing projects."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2013.
