A BILL FOR AN ACT

 

 

RELATING TO THE STATE ETHICS COMMISSION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  Act 151, Session Laws of Hawaii 2015, appropriated $130,000 in general funds for fiscal year 2015-2016 to the state ethics commission for the design and development of an electronic filing system.  The executive director of the state ethics commission, however, has indicated that the total amount of the appropriation will not be expended due to the implementation of an alternative, less costly design and development approach.

     The purpose of this part is to reduce the appropriation in Act 151, Session Laws of Hawaii 2015, from $130,000 to $         to design and develop the electronic filing system.

     SECTION 2.  Act 151, Session Laws of Hawaii 2015, is amended by amending section 2 to read as follows:

     "SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of [$130,000] $         or so much thereof as may be necessary for fiscal year 2015-2016 to design and develop a system that allows filers to electronically file required statements and reports with the state ethics commission.

     The sum appropriated shall be expended by the state ethics commission for the purposes of this Act."

PART II

     SECTION 3.  The legislature finds that the funds not necessary to cover the costs for the design and development of an electronic filing system should be reappropriated for other costs expected to be incurred by the state ethics commission.

     The purpose of this part is to:

     (1)  Establish a task force to review and make recommendations regarding the lobbyist laws under chapter 97, Hawaii Revised Statutes; and

     (2)  Appropriate funds to the state ethics commission to establish a task force to review state lobbyist laws.

     SECTION 4.  (a)  There is established a lobbyist law task force within the state ethics commission for administrative purposes only.  The purposes of the task force shall be to examine the State's lobbyist laws and make recommendations to the legislature to amend these laws, if deemed necessary.

     (b)  The task force shall:

     (1)  Review and analyze for effectiveness, efficiency, and enforceability the lobbyist laws under chapter 97, Hawaii Revised Statutes, and other state laws that affect the lobbyist laws;

     (2)  Explore and examine the lobbyist laws of other jurisdictions and determine whether the statutory models of other jurisdictions may be appropriate for the State's lobbyist laws;

     (3)  In addition to the review under paragraph (1), conduct a distinct review and examination of the State's lobbyist laws, not limited to chapter 97, Hawaii Revised Statutes, as they relate to the executive branch;

     (4)  Engage in discussions with stakeholders who engage in lobbying activities to gain perspective regarding the State's lobbyist laws; and

     (5)  Address any other issues that the state ethics commission deems necessary to accomplish the purposes of the task force.

     (c)  The task force shall comprise members to be selected by the state ethics commission who are:

     (1)  Registered lobbyists;

     (2)  Representatives of organizations involved in lobbying;

     (3)  Government accountability groups;

     (4)  Community stakeholders; and

     (5)  Other members whom the state ethics commission deems necessary to accomplish the purposes of the task force.

Members of the task force shall serve without compensation.  The state ethics commission shall provide the task force with the resources and staff support necessary for the accomplishment of its duties.  The task force shall cease to exist on June 30, 2017.

     (d)  The task force shall submit a written report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2017.

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2016-2017 for the payment of expenses incurred for administering and operating the lobbyist law task force established pursuant to this part.

     The sum appropriated shall be expended by the state ethics commission for the purposes of this part.

PART III

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect on July 1, 2030.
