TWENTY-SIXTH LEGISLATURE, 2012
STATE OF HAWAII

A BILL FOR AN ACT

 

 

relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  The legislature finds that the department of transportation has authority under section 261-7, Hawaii Revised Statutes, to establish terminal rental rates for air-carriers.

     The legislature further finds that turbo propeller air-carriers serve vital rural airports in the State.  The high operational costs for these air-carriers, which include terminal rental rates, may make it difficult for turbo propeller air-carriers to continue servicing rural airports.  If turbo propeller air-carriers discontinue or reduce their service because of high operational costs, it will likely impede air transportation services to the rural areas of our State.

     The purpose of this Act is to require the department of transportation to lower the current terminal rental rate for turbo propeller interisland air carriers.

SECTION 2.  (a)  The department of transportation shall reduce the terminal rental rate for turbo propeller interisland air carriers in effect as of the effective date of this Act by $           per square feet.

(b)  For purposes of this Act:

"Turbo propeller airplane" means an aircraft with a turbojet engine used to drive an external propeller.

     "Turbo propeller interisland air carrier" means a business, person, or entity that owns or operates one or more turbo propeller airplanes to transport or convey baggage, passengers, or goods between the islands of this State for a fee.

     SECTION 3.  This Act shall take effect on July 1, 2012.
