A BILL FOR AN ACT

 

 

relating to the bureau of conveyances.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that there are numerous highways, roads, lanes, alleys, and streams throughout the State that are privately owned.  In many instance the ownership of these roads and streams cannot be readily determined by a search of public records.  For example, the subdivision plans for Hau Springs road located in the Waiohino subdivision, on the island of Hawaii, do not indicate ownership for the access road that has been widely used for years.  There are numerous plantation roads in the Ka'u district on the island of Hawaii that are utilized without the determination of ownership.  Similarly, ownership of the following right of ways in Honolulu, Akau lane, Eu lane, Hikina lane, and Auld lane, are not known.  Furthermore, a home was lost when it partially fell into the Kaipapau stream in Laie after heavy rains.  This could have been avoided had ownership information for the stream and adjoining land been available.

     Ownership information should be easily and publicly available in the interest of the public's safety and health.  Without this information many residents have no recourse when maintenance of publicly used streets and water courses is needed or when hazardous conditions occur.

     The purpose of this Act is to require the registrar to provide adjacent landowners with any information available concerning ownership of those roads and streams.

     SECTION 2.  Chapter 502, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§502-     Adjoining public right-of-way.  Upon the request of any adjoining landowner, the registrar shall provide to the landowner any information of record relating to the management, control, and title of any public road, alley, trail, street, way, or other public highway and any waterway or water course, including rivers, streams, ditches, and auwai.  The request shall be made in a form prescribed by the registrar."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2011.
