A BILL FOR AN ACT

 

 

PROPOSING AN AMENDMENT TO ARTICLE IX, SECTION 5, OF THE HAWAII STATE CONSTITUTION, TO REQUIRE THE STATE TO PRODUCE ENOUGH HOUSING TO MEET DEMAND.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Article IX, section 5, of the Constitution of the State of Hawaii is amended to read as follows:

"HOUSING, SLUM CLEARANCE, DEVELOPMENT

AND REHABILITATION

     Section 5.  The State shall produce enough housing to meet demand.  The legislature shall provide standards and criteria to accomplish the foregoing.  The State shall have the power to provide for, or assist in, housing, slum clearance and the development or rehabilitation of substandard areas.  The exercise of such power is deemed to be for a public use and purpose."

     SECTION 2.  The question to be printed on the ballot shall be as follows:

    "Shall the State be required to produce enough housing to meet demand, subject to the standards and criteria provided by the Legislature?"

     SECTION 3.  New constitutional material is underscored.

     SECTION 4.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
