A BILL FOR AN ACT

 

 

relating to transient accommodations.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaii is a highly desirable vacation destination and visitors are looking for a unique visitor experience.  The popularity of short-term vacation rentals has grown enormously in the last few years and jurisdictions across the country are dealing with how to handle this emerging enterprise.

     The legislature finds that requiring operators who reside in a different State or island from the location of their short-term vacation rental to designate a licensed real estate broker or salesperson as the local contact is important to protect consumers.

     The purpose of this Act is to protect consumers of short-term vacation rentals by requiring local contacts for transient accommodations to be real estate brokers or real estate salespersons.

     SECTION 2.  Section 237D-1, Hawaii Revised Statutes, is amended by amending the definition of "local contact" to read as follows:

     ""Local contact" means [an individual] a real estate broker or real estate salesperson, licensed under chapter 467, residing on the same island as the transient accommodation or resort time share vacation unit [or an entity with a place of business and at least one employee, officer, partner, member, or other person working on behalf of the company who is residing on the same island as the transient accommodation or resort time share vacation unit]."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
