A BILL FOR AN ACT

 

 

relating to assault against a child in a child care facility.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Part III of Chapter 707, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§707-    Assault against a child in a child care facility.  (1)  A person commits the offense of assault against a child in a child care facility if at least     incidents of injury to any child or children occur while in the care of the person.

     (2)  Assault against a child in a child care facility is a class C felony.

     (3)  As used in this section:

     "Injury" means physical pain, illness, or any impairment of physical condition that did not exist at the time at which the child was placed in the care of the person.

     "Person" means a person who operates, maintains, or conducts a child care facility, as defined in section 346-151."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
