A BILL FOR AN ACT

 

 

Relating to counties.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Each county shall amend its ordinances relating to its zoning board of appeals or other equivalent body to authorize housing developers to:

     (1)  Appeal adverse zoning decisions concerning housing projects within the county; and

     (2)  Request reconsideration,

if the district in which the housing project is proposed has an inventory of low-income housing units that is less than ten per cent of the overall count of single-family and residential apartment units located in the district.  For purposes of this section, "district" means the same as defined in section 4-1, Hawaii Revised Statutes.

     SECTION 2.  This Act shall take effect upon its approval.
