A BILL FOR AN ACT

 

 

RELATING TO ACUPUNCTURE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that many statutes concerning the practice of acupuncture have not been updated in over twenty years.  The legislature further finds that intramuscular needling and dry needling of trigger points and other nonspecific points throughout the body should be in accordance with acupuncture and eastern medicine training and principles.  To strengthen and modernize the acupuncture industry in the State to best serve patients with various conditions, existing law should be updated to accurately reflect the profession's modalities.

     Therefore, the purpose of this Act is to establish a working group to consider and make recommendations on the scope of practice for acupuncturists.

     SECTION 2.  (a)  There is established within the department of commerce and consumer affairs for administrative purposes a working group to consider and make recommendations on the scope of practice for acupuncturists.

     (b)  The working group shall consist of the following members:

     (1)  All members of the board of physical therapy;

     (2)  All members of the board of acupuncture;

     (3)  Any physical therapists or physical therapist assistants licensed pursuant to chapter 461J, Hawaii Revised Statutes, to serve at the invitation of the chairperson; and

     (4)  Any acupuncturists licensed pursuant to chapter 436E, Hawaii Revised Statutes, to serve at the invitation of the chairperson.

     (c)  The working group shall elect a chairperson from among its members.

     (d)  Members of the working group shall serve without compensation, but shall be reimbursed for reasonable expenses, including travel expenses, incurred in the performance of their duties.

     (e)  The working group shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2021.

     (f)  The working group shall be dissolved on June 30, 2021.

     SECTION 3.  This Act shall take effect on July 1, 2050.
