A BILL FOR AN ACT
relating to emergency management.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 127A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§127A- Designated shelter in buildings open to
the public; immunities. (a) In cases of emergency or disaster, the owner
of any building open to the public shall provide shelter in or on the premises
of the building to any member of the public visiting or conducting business in
or on the premises of the building at the onset of an emergency or disaster.
(b) The owner of each building open to the public
shall inform the appropriate county emergency management agency of the area designated
for use as shelter in cases of emergency or disaster pursuant to subsection (a)
in a manner to be determined by the county emergency management agency.
(c) No building owner subject to the duties of this section shall be civilly liable for the death or injury to any person or damage to any personal property as a result of any act done pursuant to the duties of this section."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
